HomeMy WebLinkAbout1753 EFFECTIVE 15'-A-15~ ORDINANCE NO. 1753 AN ORDINANCE OF THE CITY OF ARCADIA ~NDING THE ARCADIA MUNICIPAL CODE BY AMENDING SECTIONS 62l2.4, 62l3.3, 6214.3, 6214.3.1 AND 6216.3 AND BY REPEALING 62l3.5 AND 62l3.6 TO REQUIRE LICENSE DECALS ON WHEELED VEHICLES, ESTABLISHING A FEE THEREFOR, ESTABLISHING A TWELVE MONTH PERIOD FOR ANNUAL LICENSES, A~D ~NDING THE PENALTY FOR LATE PAYMENT OF LICENSE FEES AND COMMENCING BUSINESS WITHOUT A LICENSE AND FIND- ING SAID FEE AND PENALTIES DO NOT EXCEED COSTS OF SERVICE AND REGULATORY ENFORCEMENT. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOLLOWS: SECTION l. That the Arcadia Municipal Code is hereby amended by amending Section 62l2.4 thereof to read as follows: "62l2.4. VEHICLE DECALS. Every person operating any wheeled vehicle for which a license is required or who has a fixed place of business within the City which has been licensed under this Chapter, and who in the usual course of business uses a wheeled vehicle or vehicles for the delivery of personal property or ser- vices which has been sold from said fixed place of business, shall procure from the License Officer, in addition to such license certi- ficate, a license decal upon which the License Officer shall impress a serial number to be designated by him and license expiration date. The License Officer shall make a charge of ten dollars ($lO) for each license decal issued under the prov~s~ons of this section, which shall be paid by the licensee before the issuance thereof." SECTION 2. That the Arcadia Municipal Code is hereby amended by amending Section 62l6.3.thereof to read as follows: "62l6.3. SAME. VEHICLE DECAL. No person or. persons shall operate a wheeled vehicle for which a decal is required by Section 6212.4 unless said decal is at all times securely affixed to the left rear bumper of said vehicle for which the decal has been issued, in such a manner that said license decal shall be plainly visible." . -1- 1753 SECTION 3. That the Arcadia Municipal Code is hereby amended by amending Section 62l3.3 thereof to read as follows: "62l3.3. SAME. ANNUALLY. Where a yearly or annual license is provided for in this Chapter, the same shall apply to the twelve (12l month period commencing on the first day of the month during which the license is issued and terminating after the last 'day of the twelfth month.;' SECTION 4. That the Arcadia Municipal Code is hereby amended by repealing Section 6213.5 thereof. SECTION 5. That the Arcadia Municipal Code is hereby amended by repealing Section 6213.6 thereof. SECTION 6. That the Arcadia Muilicipal Code is hereby amended by amending Section 62l4.3 to read as follows: "6214.3. PENALTY. Except as provided in Section 6214.3.1, the License Officer shall, on the 30th day following.the due date there- of, add a penalty of $200 or fifty percent (50%) of the license fee, whichever is greater, for failure to pay any license fee when due. " SECTION 7. That the Arcadia Municipal Code is hereby amended by amending Section 62l4.3.l to read as follows: "6214.3.l. SAME. BUSINESS COMMENCED WITHOUT A LICENSE. The License Officer shall not issue a license to any person who has commenced business without a license unless there is first paid the license fee itself and a penalty equal to $200 or fifty percent (50%) of the license fee, whichever is greater." SECTION 8. The City Council hereby finds that the fees and penalties set forth in this ordinance do not exceed the estimated amount required to provide the service for which the fee is levied or the penalty is changed, and the costs of.regulatory enforcement. ___~'h______. . -2- 1'J SECTION 9. No person shall violate any provlslon, or fail to comply with any of the requirements of this ordinance. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this ordinance shall be guilty of a misdemeanor. ~ Any person convicted of a misdemeanor under any provision of this ordinance shall be punishable by a fine of not more than Five Hundred Dollars, or by imprisonment in the City Jailor County Jail for a period not exceeding six months; or by both such fine and imprisonment. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any pro- vision of the ordinance is committed,_continued, or permitted by such person and shall be punishable accordingly. SECTION lO. In addi~ion to the penalties provided in the preceding section, any condition caused or permitted to exist in violation of any of the provisions of this ordinance shall be deemed a public nuisance and may be, by the City, summarily abated as such, and each day such condition continues shall be regarded as a new and separate offense. SECTION ll. If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not'affect the validity of the remaining portions of this ordinance, The..City Council of the City of Arcadia hereby declares that it would have adopted this ordinance and' each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconsticutional. SECTION l2 Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in .lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. SECTION l~ The Clerk of the Council shall certify to the passage and adoption of this ordinance and shall cause the same to be published in the official newspaper of the City of Arcadia within fifteen (15) days after its adoption.
