ORDINANCE NO. 1711
AN ORDINANCE OF THE CITY OF ARCADIA N1ENDING
ARCADIA MUNICIPAL CODE SECTION 9233.8 OF THE
ZONING ORDINANCE OT RECLASSIFY PROPERTY AT
333-421 EAST HUNTINGTON DRIVE FROH CPD-l & H
(HIGH RISE OVERLAY) TO CPD-l
WHEREAS, the City Council at its regular meeting of
February 1, 1983 directed staff to initiate consideration of a zone
change for removing the existing H (High Rise) Overlay zone applic-
able to the oroperty described in attached Exhibit A, and
WHEREAS, the zone change was considered by the Planning
Commission pursuant to a public hearing conductea on March 22, 1983,
and
WHEREAS, the Planning Commission recommended approval of
Zone Change 83-2 from CPD-l & H to CPD-l, and
WHEREAS, the City Council of the City of Arcadia conducted
a oublic hearing on subject zone change at the meeting of April 19,
1983 at which time all interested persons were given full opportunity
to be heard, and review of the City's staff reports was completed
and supplemented and supplemented by a verbal report as part of the
evidence presented.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA
DOES HBREBY OHDAIN AS FOLLOWS:
SECTION 1. That Section 9233.8 of the Arcadia Municipal
Code is hereby amended, by amending the zoning map contained therein
so the property as described in Exhibit A attached hereto and by
this reference incorporated herein, presently classified as CPD-l & H
shall hereafter be classified as CPD-l.

SECTION 2. We find and determine that all written docu-
mentation presented by the Planning Department and City staff to the
City Council for the hearing on this zone change is true and correct,
and in view of all of the circumstances, the following f~nd~ngs are
rendered in support of subject zone change:
A. That pursuant to Arcadia Municipal Code Sections 9210,
9211 and 9293.1, the City desires to maintain legislative flexibility
with regard to application of the "H" overlay zone.
B. Application of subject zone can evolve into substantial
impacts on the City including traffic, public services, the sewer
system, which can affect the health, safety and welfare of the community.
C. The nature and character of the community has historically
mandated a cautious approach to application of high rise zoning.
D. Subject rezoning to apply the H overlay was pred~cated
on Conditional Use Permit 81-13 and other reasonable conditions of
development, which have not been satisfied.
E. The underlying zoning of the property and the existant
permitted use are not in any way altered by removal,of the H overlay
zone, nor is the property owner precluded from multi-level use under
CPD-l designation.
F. The property owner of subject property agreed to
application of development conditions to application of the
H overlay zone to subject property.
G. Application of development conditions to initial
application of the H overlay was committed to by the City as
an eXerc~se of the police power and for the pUblic benefit.

H. No action taken by the City Council including this
amendment of the zonlng to CPD-l shall be deemed to preclude any
further action or revision to subject zoning consistent with the
City's legislative authority under the police power.
I. The rendition of these findings are not necessarily
all-inclusive in that other considerations reasonably related thereto
may be implied in this exercise of the City's zone amendment process.

SECTION 3 If any section, subsection, sentence, clause,
phrase or portion of this ordinance is, for any reason, held to be
invalid or unconstitutional by the decision of any court of compe-
tent jurisdiction, such decision shall not affect the validity of
the remaining portions of this ordinance. The City Council of the
City of Arcadia hereby declares that it would have adopted this
ordinance and each section, subsection, sentence, clause, phrase or
portion thereof irrespective of the fact that anyone or more
sections, subsections, sentences, clauses, phrases or portions be
declared invalid or unconstitutional.
SECTION 4 Neither the adoption of this ordinance nor
the repeal hereby of any ordinance shall in any manner affect the
prosecution for violation of ordinances, which violations were
committed prior to the effective date hereof, nor be construed as
affecting any of the provisions of such ordinance relating to the
collection of any such license or penalty or the penal provisions
applicable to any violation thereof, nor to affect the validity of
any bond or cash deposit in lieu thereof, required to be posted,
filed or deposited pursuant to any ordinance and all rights and
obligations thereunder appertaining shall continue tn full force
and effect.
SECTION 5 The Clerk of the Council shall certify to the
passage and adoption of this ordinance and shall cause the same to
be published in the official newspaper of the City of Arcadia with-
in fifteen (15) days after its adoption.
PASSED AND ADOPTED BY THE CITY COUNCIL of the City of Arcadia
at its regular meeting held on the 17th day of May, 1983.
