HomeMy WebLinkAbout1772 ~, '-, ' \I A o EFFECTIVE & ~ { 7- r 3 ORDINANCE NU. 1772 AN URDINANCE OF THE CITY OF ARCADIA ADDING SECTION 8230.9 TO ARTICLE VIII OF THE ARCADIA MUNICIPAL CODE ESTABLISHING REGULATIONS PER- TAINING TO RECREATION VEHICLE DUMPING STATIONS WHEREAS, the City of Arcadia has adopted the Uniform Plumbing Code and WHEREAS, from time to time it is necessary to add provi- sions to said Code. NOW, THEREFORE, THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: SECTION 1. The Arcadia Municipal Code is hereby amended by adding Section 8230.9 to Article VIII to read as follows: "8230.9. ADDITION. Said Uniform Plumbing Code is amended by adding the following Section 616. Section 616: Recreation Vehicle (R.V.) Sewage Disposal Station (a) Recreational Vehicle (R.V.) sewage disposal stations installed on commercially zoned properties shall conform to the requirements of the Los Angeles County Health Department and the City of Arcadia. (b) R.V. sewage disposal stations installed on residen- tially zoned property shall conform to the following: 1. Receptor shall be located not less than 20 feet from any side or rear property line and will not be per- mitted in any required front yard nor street side, side yard of a corner lot. Said receptor may be less than 20 feet from a property line if it is inside a garage (open carport type structure not acceptable) . 2. Waste line and trap shall be minimum 3 inch size and of approved material. 3. Vent shall be installed per Section 506 and Section 702 of Uniform Plumbing Code. 4. Receptor shall be of smooth finished concrete 3 feet by 3 feet. It shall have a 3 inch rolled curb. It shall slope toward the center not less than 1/4" per foot. The concrete shall be 4 inches thick to prevent breakage if driven over. The drain cover shall be of -1- l772 bronze and have a hinged, lockable cover with a ground face and seat." SECTION 2. Findings. It is hereby determined that the mainten- ance of outside R.V. dumping facilities adjacent to neighboring properties can create nuisance-like conditions inconsistent with the welfare and quiet enjoyment of the neighborhood. The increased use of recreational vehicles, their placement on residential properties, the relative inconvenience of alternate dumping facilities and the related propensity to legally park R.V.s on residential properties through an outside hookup-requires consideration as to the standards, stations on commercial property, and placement (location) require- ments on residential property. -2- 1772 SECTION 3 No person shall violate any provision, or fail to comply with any of the requirements of this ordinance. Any person violating any of the provisions or failin~ to comply with any of the mandatory requirements of this ordinance shall be guilt:/ A a misdemeanor. Any person convicted of a misdemeanor under any provision of thi3 ordinance shall be punishable by a fine of not more than Five Hundred Dollars, or by imp=isonment in the City Jail or County Jail for a period not exceeding six months, or by both such fine and imprisonment. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any pro- vision of the ordinance is committed, continued, or permitted by such person and shall be punishable accordingly. 4 SECTION 5 If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Arcadia hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional, SECTION 6 Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. SECTION 7; The Clerk of the Council shall certify to the passage and adoption of this ordinance and shall cause the same to be published in the official newspaper of the City of Arcadia within fifteen (IS) days after its adoption.
