ORDINANCE NO. 1774
AN ORDINANCE OF THE CITY OF ARCADIA APPROVING
TEXT AMENDMENT 83-2 A.1'1ENDING SECTION 9276.2.11
OF THE ARCADIA MUNICIPAL CODE TO INCREASE THE
NU~rnER OF OFF-STREET PARKING SPACES FOR CERTAIN
USES IN THE "H"(HIGH-RISE) OVERLAY ZONE
WHEREAS, a Text Amendment was initiated by the City for
the consideration of amending Section 9276.2.11 of the Arcadia
Municipal Code to increase the number of off-street parking spaces
for certain uses in the "H" (High Rise) overlay zone, and
WHEREAS, a public hearing was held on March 22, 1983 before
the Planning commission at which time all interested persons
were given full opportunity to be heard, and to present evidence,
WHEREAS, the Planning Commission of the City of ARcadia
recommended subject amendment to the City Council, and
WHEREAS, the City Council conducted a public hearing
concerning this proposal on May 3, 1983 and approved the amendment.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. That Section 9276.2.11 be amended to read as ,
follows:
"9276.2.11. REQUIRED PARKING
A. Off-street parking spaces for residential uses shall
be provided and maintained in the amount and at the location as
required in the underlying residential zone.
B. Off-street parking spaces for commercial uses shall
be provided and maintained as set forth in Article IX, Chapter 2,
Part 6, Division 9, except that the following table shall be used
to determine the number of required parking spaces for the portions
of buildings which exceed three stories in height.

C. When a fractional figure is found as a remainder in
computations made to determine the amount of required off-street
parking, such fraction shall be construed to be the next largest
whole number."
SECTION 2.1 The City Council finds that the public
necessity, convenience and general welfare justify the above ordinance.

SECTION 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is, for any reason, held to be
invalid or unconstitutional by the decision of any court of compe-
tent jurisdiction, such decision shall not affect the validity of
the remaining portions of this ordinance. The City Council of the
City of Arcadia hereby declares that it would have adopted this
ordinance and each section, subsection, sentence, clause, phrase or
portion thereof irrespective of the fact that anyone or more
sections, subsections, sentences, clauses, phrases or portions be
declared invalid or unconstitutional.
SECTION 4 ~ Neither the adoption of this ordinance nor
the repeal hereby of any ordinance shall in any manner affect the
prosecution for violation of ordinances, which violations were
committed prior to the effective date hereof, nor be construed as
affecting any of the provisions of such ordinance relating to the
collection of any such license or penalty or the penal provisions
applicable to any violation thereof, nor to affect the validity of
any bond or cash deposit in lieu thereof, required to be posted,
filed or deposited pursuant to any ordinance and all rights and
obligations thereunder appertaining shall continue in full force
and effect.
SECTION 5. The Clerk of the Council shall certify to the
passage and adoption of this ordinance and shall cause the same to
be published in the official newspaper of the City of Arcadia with-
in fifteen (15) days after its adoption.
PASSED AND ADOPTED BY THE CITY COUNCIL of the City of Arcadia
at its regular meeting held on the 7th day of June, 1983.
