HomeMy WebLinkAbout1785 ORDINANCE NO. 1785 AN ORDINANCE OF THE CITY OF ARCADIA ESTABLISHING AN OLYMPIC GAMES TEMPORARY PERMIT WHEREAS, the City of Arcadia is the site for the Equestrian Events which are part of the 1984 Summer Olympic Games; and, WHEREAS, said event is of major national and international significance; and, WHEREAS, the conducting of such an event in any particular locale is generally a once in a lifetime occurrence; and, WHEREAS, the unique and unusual nature of said event has prompted a number of inquiries as to various olympic promotional events; and, WHEREAS, it is anticipated that a number of promotional type activities will occur prior to and during the olympic events ln Arcadia; and, f WHEREAS, the allowance of such events within the framework of appropriate regulations will help promote the Olympic Events and the City of Arcadia; NOW, THEREFORE, the City Council of the City of Arcadia does hereby ordain as follows: SECTION 1. Purpose: The purpose of this Ordinance is to provide special regulations governing the conducting of Olympic-related promotional events and the sale of Olympic-related merchandise, which otherwise may not be permitted under existing zoning ordinance provisions. SECTION 2. Authority: A Speci,al Temporary Permit (STP) may be granted upon the approval of the Business License Review Board (BLRB) as established per Arcadia Municipal Code Section 6150 et. seq. In issuing a permit, the BLRB shall have the authority to impose such conditions as are deemed necessary to 1785 protect the health, safety, welfare, peace, quiet and enjoyment of the surrounding property or neighborhood and to carry out the purpose and intent of the STP. SECTION 3. Administrative Act: All acts performed by City Officers under the provisions of this Ordinance shall be construed as administrative acts performed for the purpose of assuring conformance with the intent and purpose of these regulations. SECTION 4. Application Forms: Application for a STP shall be made in writing to the Business License Office on the prescribed application forms. Incomplete application forms shall not be accepted. SECTION 5. Fee: Before accepting for filing any application for an STP, the City shall charge and collect a fee of $20.00 which is intended to cover the City's cost in processing the application. SECTION 6. Decision: Within seven (7) working days of the receipt in proper form of an application for an STP, the BLRB shall render their decision of approval, conditional approval, or denial of the application. SECTION 7. STP Not Transferable: No STP issued under these regulations shall be transferred or assigned nor shall the permit authorize any person other than named therein to commence or carryon the permited activity for which the permit was issued. SECTION 8. Revocation, Penalties and Remedies: The City Manager or his designated deputy upon determining that the permittee has committed a violation of any law or any ,of the conditions of permit approval, may summarily revoke any STP. Because of the special nature of the STP and the short time periOd covered by such permit, the aforementioned revocation procedure is required. An acknowledgement of the City's right to summarily revoke an STP must be executed by all applicants as a part of their initial application. Any use or activity conducted per an STP is not per se a matter of right. -2- Other Remedies: As to any use or activity covered by this Ordinance which is conducted without the STP, subsequent to its revocation or In a manner not consistent with applicable conditions and regulations, the City Manager or his designee may order the abatement and removal of any items which are an integral part of such use, and designate the Police Department to take the required action. Any property obtained by the City through such action shall be retained for a reasonable period of time to allow recovery by the appropriate parties who shall bear the cost, if any, of required storage. Penalties: Violation of this Ordinance which includes violation of any of the conditions of an STP shall constitute a misdemeanor. SECTION 9. Prerequisite Conditions: An STP shall be subordinate to the principal use of the property and shall be subject to the following primary requirements. A. Zones: An STP may be approved for properties which are zoned CPD-l, C-O, C-l, C-2, C-M or M-l. B. Duration: An STP may be approved for promotional events and/or the sale of merchandise to be held commencing no sooner than June 25, 1984 and terminating no later than August 14, 1984. C. Conditions: An STP may be conditioned consistent with all provisions of this Ordinance. SECTION 10. Application of STP: The BLRB may approve an STP for exemptions to the following zoning regulations: 1. Sign regulations, but not including window slgns. 2. Inside and/or outside storage regulations. 3. Parking regulations. 4. Use Limitations in the CPD-l, C-O, C-M and M-l zones. Exemptions to the above regulations which may be approved by the BLRB shall only be deemed approved to the extent as specifically provided for in the Board's approval. The Holder of an STP shall comply with all other requirements of law. -3- SECTION 11. Criteria: The following criteria shall be considered in the evaluation of each STP application: 1. The relationship of the event/activity or merchandise to the 1984 Summer Olympics. An application may be denied if a clear and substantial relationship is not demonstrated ,to the satisfaction of the BLRB. 2. The proposed timing of the event (i.e. days, hours and duration) with respect to potential conflicts with other uses in the immediate vicinity of the proposed activity which may be adversely impacted. 3. Noise which may result if the STP is granted. 4. Adequacy of parking both on-site and within the immediate vicinity which may be impacted. 5. pedestrian safety both on-site and within the immediate vicinity which may be impacted and other safety considerations. 6. Proposed lighting. 7. Proposed equipment and machinery. An application for an STP shall be denied if in the determination of the BLRB based upon the above criteria, the proposed event/activity will adversely impact the proposed site or other properties or land uses within the immediate vicinity of the proposed event/activity or is otherwise inconsistent with the health, safety and welfare of the community. -4- PASSED AND ADOPTED BY THE CITY COUNCIL of the City of Arcadia at its regular meeting held on the 17th day of January 1984.
