HomeMy WebLinkAbout1793 ORDINANCE NO. 1793 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, REPEAL:NG SECTION 6220.33 OF THE ARCADIA MUNICIPAL CODE RE MOTION PICTURE FEE AND ADDING DIVISION 6, ARTICLE VI TO THE ARCADIA MUNICIPAL CODE REGARDING REVISED FEE AND REGULATION OF MOTION PICTURE FILMING IN THE CITY OF ARCADIA THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. That the Arcadia Municipal Code is hereby amended by repealing Section 6220.33. SECTION 2. That the Arcadia Municipal Code is hereby amended by adding Division 6 to Part 1, Chapter 6 of Article VI to read as follows: 6616. BUSINESS LICENSE. A business license permit shall be required for all types of filming except those generally recognized as being exclusively for private or family use. 6616.1. APPLICATION, All applicants will be required to complete a City of Arcadia "Film Production Application Description" form prior to the issuance of a buiness license permit. The standardized form requires the detailing of the filming and description of equipment to be used. 6616.2. SCOPE OF LICENSE. Each business license issued will be temporary covering only the filming location and the filming dates listed on an applicant's "Filming Production Application Description" , form. A business license will be required prior to the start of any filming activity. 6616.3. SEPARATE LICENSE. A separate temporary business license permit and business license fee will be required for each filming location and each set of filming dates listed on an applicants "Filming Production Application Description" form. 6616.4. INSURANCE. A certificate of insurance namlng the City as an additional insured and approved by the City Attorney will be required prior to the issuance of a business license. If approved by the City Attorney, insurance will not be required if the entire filiming activity will take place on private or non-City property, 6616.5. LICENSE PERMIT APPROVED. Permits will only be issued after they have been reviewed and approved by the City Administrative offices, the City Fire Department and the City Police Department. 6616.6. SPECIAL SERVICES. The City will have the right to require, and applicant shall have the right to request, special police, fire, or administrative services as part of the business license process. 6616.7, COST OF SPECIAL SERVICES. The applicant will be billed directly for all special services provided by the City. The fee for special services will be the exact cost incurred by the City for providing the special services. City may require a deposit applicable to these costs. 6616.8. POSTING. Each applicant will be required to post all of the properties which are immediately adjacent to the filming location prior to the start of filming, The posting shall include a general description of the filming activity that will take place and the dates -2- and times when the filming activity is scheduled. 6616.9. FEE AMOUNT. The business license fee will be ninety dollars ($90.00) for each temporary business license. The number of filming days would not affect business license fees. The fee will be adjusted annually by resolution of the City Council to reflect increased administrative costs to complete the application review process. 6616.10. WAIVER OF FEE. The City Council may waive a business license fee if the applicant is a student or a local charitable organization. SECTION 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy hereof to be published once in the official newspaper within fifteen (15) days of the adoption hereof.
