HomeMy WebLinkAbout1794 o ORDINANCE NO. 1794 AN ORDINANCE OF THE CITY OF ARCADIA AMENDING SECTION 9233.12 OF THE ARCADIA MUNICIPAL CODE TO REZONE THE PROPERTY LOCATED AT 646 and 650 WEST HUNTINGTON DRIVE FROM C-O & D (PROFESSIONAL OFFICE ZONE WITH A DESIGN OVERLAY) TO R-3 (MULTIPLE-FAMILY RESIDENTIAL ZONE) WHEREAS, the City Council of the City of Arcadia held a public hearing on July 3, 1984, on the rezoning of 646 and 650 West Huntington Drive from C-O & D to R-3, WHEREAS, all interested persons were given full opportunity to be heard and to present evidence, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA does ordain as follows: Section 1. That Section 9233.12 of the Arcadia Municipal Code is hereby amended by amending the zoning map contained therein so that the following legally described property presently classified as C-O & D (Professional Office Zone) shall hereafter be classified as R-3 (Multiple-Family Residential Zone): 646 and 650 West Huntington Drive, City of Arcadia. Lots 4 and 5 of Tract No. 2828 in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 33, Page 53 of Maps in the Office of said County Recorder. Section 2. We find and determine that all written documentation presented by the Planning Department to the City Council for the hearing on this zone change is true and correct; that this zone change is consistent with the General Plan; that this zone change would allow for a more harmonious, flexible and desirable development of the area; that the public convenience, necessity, general welfare and good zoning practice justify the proposed zone change; that the new zoning is the highest and best use of property consistent with present zoning classifications; and that said zone change will not have a significant effect on the environment. Section 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Arcadia hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. Section 4. The Clerk of the Council shall certify to the passage and adoption of this ordinance and shall cause a copy of the same to be published in the official newspaper of the City of Arcadia within fifteen (15) days after its adoption.
