HomeMy WebLinkAbout1722 -- . _ __~. W6 6L~~~U~ft ftnc~uL~b ORDINANCE NO. l490 AND APPROVING AND ADOPTING THE FIRST AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE CENTRAL REDEVELOPMENT PROJECT. WHEREAS, the City Council of the City of Arcadia adopted Ordinance No. l490 on December 26, 1973, approving and adopting the Redevelopment Plan for the Central Redevelopment Project; and WHEREAS, the Arcadia Redevelopment Agency (hereinafter referred to as the "Agency") has prepared and submitted to the City Council for approval and adoption a proposed First Amendment to the Redevelopment Plan for the Central Redevelopment Project, accompanied by the Agency's Report to City Council on the proposed First Amendment; and WHEREAS, the Planning Commission of the City of Arcadia has submitted its report and recommendation, finding that the proposed First Amendment is in conformance with the City of Arcadia General Plan as amended and approved by the City Council on May 5, 1981; and WHEREAS, the City Council as the lead agency, has, in accord with the require- ments of the California Environmental Quality Act of 1970, as amended (Public Resources Code, Sections 2l000, et seq.), and State and local regulations and guidelines adopted pursuant thereto, prepared the Final Environmental Impact Report for the East Huntington Drive Redevelopment Area (hereinafter referred to as "EIR") on the environ- mental effects of the proposed First Amendment; and WHEREAS, in further accord with said Act, regulations and guidelines, the Final EIR was approved and certified by the City Council following a public hearing thereon; and WHEREAS, pursuant to ARA Resolution No. 63, Agency as the responsible agency has certified it has reviewed and considered the EIR, made findings of apecific social economic and other overriding considerations making specific mitigation measures and alternatives infeasible and recommending the City Council adopt aforesaid First Amendment; and WHEREAS, a joint public hearing was held by the City Council and the Agency on the proposed First Amendment. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: Section l. The purposes and intent of the City Council with respect to the Project Area are as set forth in Ordinance No. 1490. Section 2. It is hereby determined that the First Amendment submitted by the Agency is necessary and desirable. -1- l722 /1 --- & __ _. .~_~y O~~ VUL at length herein. The Redevelopment Plan, as amended by the First Amend- ment to the Redevelopment Plan for the Central Redevelopment Project, shall be referred to as the Amended Redevelopment Plan. Section 4. Ordinance No. 1490 and the Redevelopment Plan adopted pursuant thereto as the officinl Redevelopment Plan for the Central Redevelopment Project is hereby amended fiS set forth in the First Amendment, so that the Redevelopment Plan adopted by Ordinance No. 1490 is replaced by the Amended Redevelopment Plan. Section 5. All written and oral objections to the First Amendment to the Redevelopment Plan are hereby overruled. Section 6. The Amended Redevelopment Plan is hereby approved, adopted and designated the official redevelopment plan for the Central Redevelopment Project. Section 7. The City Council hereby finds and determines that: (ll The Amended Redevelopment Plan for the Central Redevelopment Project will redevelop the Project area in conformity with the Community Redevelopment Law of the State of California and in the interests of the public peace, health, safety and welfare; (2) The adoption and carrying out of the A mended Redevelopment Plan for the Central Redevelopment Project is economically sound and feasible; (3) The Amended Redevelopment Plan for the Central Redevelopment Project conforms to the General Plan of the City of Arcadia; (4) The carrying out of the Amended Redevelopment Plan for the Central Redevelopment Project will promote the public peace, health, safety and welfare of' the City of Arcadia and will effectuate the purposes and policies of the Community Redevelopment Law of the State of California; (5) The City Council is convinced that the effect of tax increment financing, as permitted and contemplated by the Amended Redevelopment Plan, will not cause a severe financial burden or detriment on any taxing agency deriving revenues from the Project area; Section 8. Ordinance No. 1490 shall remain in full force and effect except to the extent it is changed by this amending ordinance. Section 9. The City Clerk is hereby directed to send a certified copy of this ordinance to the Agency and the Agency is hereby vested with the responsibility for carrying out the Amended Redevelopment Plan, subject to the provisions of the Amended Redevelopment Plan. -2- 1722 a rl une , a sem y newspaper of general circulation, printed, pub- lished, and circulated in the City of Arcadia, within fifteen (15) days after its adoption. Section 11. If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent j~risdiction, such decision shall qot affect the validity of the remaining portions of this ordinance. The City Council of the City of Arcadia hereby declares "that it would have adopted, this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be . declared invalid or unconstitutional. Section l2. ! Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of" ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordiP_ance and all rights and obligations thereunder appertaining shall continue in full force and effect.
