HomeMy WebLinkAbout1727 N URGENCY ORDINANCE OF THE CITY OF ARCADIA AMENDING SECTIONS 4113.9, 4113.11, 4124.2.2, AND 4l25.2.5 OF THE ARCADIA MUNICIPAL CODE TO INCREASE DOG LICENSE, SPAYING, NEUTERING, AND DISTEMPER VACCINATION FEES AS REQUESTED BY THE COUNTY OF LOS ANGELES DIRECTOR OF ANIMAL CARE AND CONTROL. THE CITY COUNCIL OF THE CITY OF ARCADIA HEREBY FINDS, DETERMINES AND ORDAINS AS FOLLOWS: SECTION 1. This ordinance is an ordinance necessary as an emergency measure for the immediate preservation of the pUblic peace, health and safety of the people of the City of Arcadia and shall take effect immediately upon its adoption in accordance with Arcadia City Charter Section 415. Said emergency is based upon the fOllowing facts which we hereby find to be true and correct: 1. That the Board of Supervisors of the County of Los Angeles, California, did approve on June 23, 1981, Ordinance No. 12384 which amended County Ordinance No. 4729 by increasing various fees and charges relating to dog license and distemper vaccination fees. 2. That Section 7 of the Agreement entitled "Agreement Animal Control Sel'vices" between the County of Los Angeles and the City of Arcadia, dated July 1, 1981, requires that the said Agreement shall be terminated by the County at any time that the City fails to enact and maintain in full force an ordinance identical with the provisions of the County Animal Control Ordinance, Los Angeles County Ordinance No. 4729, as amended. 3. That the County of Los Angeles' Director of the Department of Animal Care and Control has requested the City to adopt various fee increases by urgency ordinance so that licensing of animals can begin in the City of Arcadia. SECTION 2. That Section 4113.1l of the Arcadia Municipal Code is hereby amended to read as follows: ' "4113.11. PUBLIC SPAY AND NEUTER CLINIC. (a) The Poundmaster may establish a clinic, at which members of the public may have dogs and cats spayed or neutered in a humane manner upon payment of the following fees: -1- 1727 ~ {(f For spaying a female cat 15.00 For spaying a female dog up to 25 pounds 20.00 For spaying a female dog up to 50 pounds 26.00 For spaying a female dog over 50 pounds. 32.00 For neutering a male dog up to 50 pounds 20.00 For neutering a male dog over 50 pounds. 30.00 A fee of one-half the amount above-stated shall be charged to persons presenting a valid Medi-Cal card. In addition to the above fee, a fee of $4.00 shall be charged for the giving of a distBmper vaccination. (b) A person submitting a dog or cat for the above service shall sign a consent form certifying thereon under penalty of perjury that he is the owner of said animals or setting forth facts showing that he is otherwise authorized to present the animals for the above operation and such person may be required to furnish proof of such ownership or authority. Such consent shall contain a waiver of any and all liability of the City of Arcadia, its employees, Los Angeles County, the Department of Animal Care and Control, and any County employees for any injury or death to an animal arising out of the aforementioned operation or any services provided incidental thereto. (c) A deposit to cover the costs of spaying or neutering shall be required when the above operation has been scheduled. Upon failure to bring a dog or cat in for the scheduled operation, the deposit shall be forfeited. (d) The Poundmaster shall establish a return date by which a per- son submitting an animal for the above operation shall pick up said animal or be subject to a reasonable board and care fee to commence the day after such return date. Failure to pick up an animal within 15 days of said return date shall be deemed abandonment of such animal, and the Poundmaster may dispose of it by sale or destruction. " SECTION 3. That Section 4113.9 of the Arcadia Municipal Code is hereby amended to read as follows: -2- 1727 _ ______. ~~ ~~~~v~~ ~~ ~ny Qog or cat impounded by him. Not less than five (5) or more than thirty (30) days after the taking and impounding of any dog or cat, unless such dog or cat has been redeemed by the owner, the Poundmaster shall deliver to the approved research institution at the place of impounding the dogs or cats, or both, designated by it, upon payment of a fee as below listed, except that the Poundmaster shall not deliver any dog or cat to , any approved research institution if the owner of such dog or cat, or the person surrendering such stray dog or cat, has instructed the Poundmaster not to do so. Not less than five (5) days after the taking up and impounding of any dog or cat herein provided, unless it be sooner redeemed or delivered to an approved research institution, the Poundmaster shall destroy such dog or cat or shall dispose of such dog or cat to any other person who will pay the reasonable value of such dog or cat, but in no case less than the below-listed fees. In the case of a dog (other than delivery to an approved research institution) the purchaser also shall procure and pay for the required license for such dog for the current year unless such a license is issued and in full force and effect. That Section 4124.2.2 of the Arcadia Municipal Code is hereby amended to read as follows: "4124.2.2. DOG LICENSES. FEES. Every person owning or having custody or control of any dog over the age of four (4) months in the City not covered by th~'provisions of Section 4f24.2.3, shall first obtain an annual license from the Poundmaster for each of such dogs and at the same time obtain a dog license tag, and for such license or licenses, in addition to the One Dollar ($1.00) fee for the dog license tag, shall pay Fifteen Dollars ($15.00), a total of Sixteen Dollars ($16.00) in all." SECTION 5. That Section 4124.2.5 of the Arcadia Municipal Code is hereby amended to read as follows: . . . 14.00 6.50 "4124.2.5. SPAYED OR NEUTERED DOGS. REDUCTION IN LICENSE TAG FEE. If a certificate from a licensed veterinarian is presented that the dog has been spayed or neutered, pursuant to Section 30804.5 of the Food and Agricultural Code, a person owning such dog shall obtain a dog license tag and pay a fee of One Dollar ($1.00) therefor, and in addi- tion thereto obtain an annual license and pay a fee of Seven Dollars ($7.00) therefor, a total of Eight Dollars ($8.00) in all." -4- 1727 SECTION 7,_ No person shall violate any prov1s10n, or fail to comply with any of the requirements of this ordinance. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this ordinance shall be guilty of a misdemeanor, Any person convicted of a misdemeanor under any provision of this ordinance shall be punishable by a fine of not more than Five Hundred Dollars, or by imprisonment in the City Jailor County Jail for a period not exceeding six months, or by both such fine and imprisonment. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any pro- vision of the ordinance is committed, continued, or permitted by such person and shall be punishable accordingly. SECTION 8. In addition to the penalties provided in the preceding section, any condition caused or permitted to exist in violation of any of the provisions of this ordinance shall be deemed a public nuisance and may be, by the City, summarily abated as such, and each day such condition continues shall be regarded as a new and separate offense. . SECTION 9. If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Arcadia hereby declares that it would have adopted this ordinance and each section, subsection, sentence, c~ause, phrase or portion thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 10. Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. SECTION 11, The Clerk of the Council shall certify to the passage and adoption of this ordinance and shall cause the same to be published in the official newspaper of the City of Arcadia within fifteen (l5) days after its adoption.
