AN ORDINANCE OF THE CITY OF ARCADIA AMENDING
SECTION 9233.9 OF THE ARCADIA MUNICIPAL CODE TO
REZONE l035-1045 WEST HUNTINGTON DRIVE FROM
R-3 (MULTIPLE FAMILY) TO C-O (PROFESSIONAL OFFICE).
WHEREAS, an application was filed by George T. Kirkpatrick on
behalf of Maier Brewing Company and the City of Arcadia, requesting
,Zone Change 81-3 from R-3 (Multiple-family) to c-o (Professional
Office) for the property at 1035-1045 West Huntington Drive;
WHEREAS, the City Council of the City of Arcadia held a public
hearing on August 18, 1981 for the purpose of considering the
rezoning;
" WHEREAS, all interested persons were given full opportunity to
be heard and to present evidence.
NOW, THEREFORE, the City Council of the City of Arcadia does
ordain as follows:
SECTION 1. That Section 9233.9 of the Arcadia Municipal Code
is hereby amended, by amending the zoning map contained therein so
that the following legally described property presently classified
as R-3 shall hereafter be classified as C-O:
The southerly 195.16 feet of Lot 1, Tract No. 14846, as
per Map recorded in Book 314, Pages 8 and 9 of Maps in
the Office of the Recorder of Los Angeles County.
SECTION 2. We find and determine that all written documenta-
tion presented by the Planning Department to the City Council for
the hearing on this zone change is true and correct; that this zone
change is consistent with the general plan; that this zone change
would allow for a more harmonious, flexible and desirable development
of the area; that the public convenience, necessity, general welfare
and good zoning practice justify the proposed zone change; that the
new zoning is the highest and best use of property consistent with
present zoning classifications; and that said zone changes will not
have a significant effect on the environment.

decision of any court of competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this ordinance. The City Council of the City
of Arcadia hereby declares that it would have adopted this ordinance and each section,
subsection, sentence, clause, phrase or portion thereof irrespective of the fact that
anyone or more sections, subsections, sentences, clauses, phrases or portions be
declared invalid or unconstitutional.
SECTtON 4,. Neither the adoption of this ordinance nor the repeal hereby of any
ordinance shall in any manner affect the prosecution for violation of ordinances,
which violations were committed prior to the effective date hereof, nor be construed
as affecting any of the provisions of such ordinance relating to the collection of any
such license or penalty or the penal provisions applicable to any violation thereof,
nor to affect the validity of any bond or cash deposit in lieu thereof, required to be
posted, filed or deposited pursuant to any ordinance and all rights and obligations
thereunder appertaining shall con~inue in full force and effect.
SECTtON ~. The Clerk of the Council shall certify to the passage and adoption
of this ordinance and shall cause the same to be published in the official newspaper
of the City of Arcadia within fifteen (15) days after its adoption.
PASSED AND ADOPTED BY THE CITY COUNCIL of the City of Arcadia at its regular meet-
ing held em the 15th day of September, 1981.
