HomeMy WebLinkAbout1733 ORDINANCE NO. 1733 AN ORDINANCE OF THE CITY OF ARCADIA AMENDING SECTION 9233.8 OF THE ARCADIA MUNICIPAL CODE TO REZONE 219, 223 AND 233 NORTH FIRST AVENUE AND 48, 52 AND 58 EAST ST. JOSEPH STREET FROM M-l (PLANNED INDUSTRIAL DISTRICT) TO C-M (COMMERCIAL-MANUFACTURING) . WHEREAS, the City Council of the City of Arcadia held a public hearing on October 21, 1981 on the rezoning of 2l9, 223 and 233 North First Avenue and 48, 52 and 58 East St. Joseph Street from M-l to C-M. WHEREAS, all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: SECTION 1. That Section 9233.8 of the Arcadia Municipal Code is hereby amended, by amending the zoning map contained therein so that the following legally described property presently classified as M-l (Planned Industrial District) shall hereafter be classified as C-M (Commercial-Manufacturing): Lots 12 through 19 of Block 78 of Santa Anita Tract in the City of Arcadia, County of Los Angeles, State of California, as per Map recorded in Book 15, Pages 89 and 90 of Maps, in the Office of said COunty Recorder. SECTION 2. We find and determine that all written documentation presented by the Planning Department to the City Council for the hearing on this zone change is true and correct; that this zone change is con- sistent with the General Plan; that this zone change would allow for a more harmonious, flexible and desirable development of the area; that the public convenience, necessity, general welfare, and good zoning prac- tice justify the proposed zone change; that the new zoning is the highest and best use of property consistent with present zoning classifications; and that said zone changes will not have a significant effect on the environment. -1- 1733 n are ec~s~on 0 any cour 0 compe- tent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Arcadia hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 4. Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. SECTION 5. The Clerk of the Council shall certify to the passage and adoption of this ordinance and shall cause the same to be published in the official newspaper of the City of Arcadia with- in fifteen (lS) days after its adoption.
