AN ORDINANCE OF THE CITY OF ARCADIA AMENDING
SECTIONS 9292.1.4 AND 9292.1.9 OF THE ARCADIA
MUNICIPAL CODE TO ALLOW UNLIMITED EXPANSION
OF 'fIlE Mi\IN DlvELLING ON R-l AND R-Q LOTS WITH
TI'iO OR MORE DlvELLINGS, AND DELETING THE REAL
ESTATE INSPECTION REPORT REQUIREMENT.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS
FOLLOlvS :
SECTION 1.
That Section 9292.1.4 of the Arcadia Municipal Code
is hereby amended to read as follows:
II 9292.1. 4. AUTllOlUTY. In order to secure an appropriate improve-
ment, prevent unreasonable hardship or to promote uniformity of development,
the tJoctificalion Committee shall have the authority to approve, conditionally
approve or deny modifications of the following:
1. Driveway and parking stall size requirements.
2. Apartment unit size.
3. Building length.
4. Distance between buildings.
5. Usable open space regulations.
6. Flmcc, wall and hedge regulations.
7. Si~n rcgul:1.tions.
8. Utility and storage space requirements.
9. ~'v.'imming pool regulations.
10. R-3 building height regul:1tions, provided that such regulations, as
modifi~d, shall not permit a. building to exceed thirty-five feel (3S') in height
nor two (2) stories Or two (2) storics oC living quarters over one (I) story
of parkin~.
11. Height of noncommercial structures.
12. Number of required parking spaces.
13. Whcn the m:\."{imum number of units permitted in the R-2 and R-3
zones has a fractional remainder greater than one halI, the Modification Com-
mittee may allow the maximum number of units to be rounded off to the next
hi~hcSl whole number.
14. Front, side or rear yard setbacks, provided that a setback from a
street sholl be modified only with the unanimous approval of the Committee
and :l written declaration of the Director of Public Works that the modifica-
tion, if hranted, will not adversely affect any foreseeable need for widening
the st reel.
15. In the R-Q First Onc-Family zone and the R-l Second
One-Filmily zone for any property with two or morc one-family dwcll-
in~s which arc noncon[ormi~g uses, structures or buildings under
J\rc.:ldL\ ;.\unicipal Code Sections 9251.1 and 9252.1.1:
(a) For additional floor <lrc3., including covered p<ltios to be

'~here may be required QS a condition of approval of the modification
permit, that plans be submitted for the removal or remodeling of any
other nonconforming uses, structures, and buildings to conform to the
provisions of the ArCQdia Municipal Code. In such case, the condition
may require the removal) or remodeling of any such nonconforming use,
structure and building prior to or concurrent with the alteration or
improvement specified in (a), (b), (c), or (d) above."
SECTION 2. That Section 9292.1.9 of the Arcadia Municipal Code
is hereby amended to read as follows:
"9292.1.9. INFORNATION REQUIRED. A modification application
shall be accompanied by the following:
1. Completed application forms.
2. Reference to the provisions of the Code section from which
said property is sought to be excepted.
3. A scaled plot plan and description of the subject property,
description of the proposed use of the property with plot plans, floor
plans, and elevations for all proposed buildings drawn to scale.
4. In those residential areas of the City having architectural
review boards, the report of said boards indicating their actions rela-
tive to the proposed modification request."
SECTION 3. If any section, subsection, sentence, clause,
phrQse or portion of this ordinance is, for any reason, held to be
invalid or unconstitutional by the decision of any court of compe-
tent jurisdiction, such decision shQ11 not affect the validity of
the remaining portions of this ordinance. The City Council of the
City of ArcadiQ hereby declares that it would have adopted this,
ordinance and each section, subsection, sentence, clause, phrase or
portion thereof irrespective of the fact that anyone or more
sections, subsections, sentences, clauses, phrases or portions be
declared invalid or unconstitutionQl.

SECTIO~ 4. Neither the adoption of this ordinance nor
the repeal hereby of any ordinance shall in any manner affect the
prosecution for violation of ordinances, which violations were
committed Drior to the effective date hereof, nor be construed as
affecting any of th~ provisions of such ordinance relating to the
collection of any such license or penalty or the penal provisions
applicable to any violation thereof, nor to affect the validity of
any bond or cash deposit in lieu thereof, required to be posted,
filed or deposited pursuant to any ordinance and all rights and
obligations thereunder appertaining shall continue in full force
and effect.
SECTION 5. The Clerk of the Council shall certify to the
passage and adootion of this ordinance and shall cause the same to
be published in'the official newspaper of the City of Arcadia with-
in fifteen (15) days after its adoption.
PASSED AND ADOPTED BY THE CITY COUNCIL of the City of Arcadia
at its regular meeting held on the 18th day of May, 1982.
