HomeMy WebLinkAbout1743 N C u. )./ .,j AN ORDINANCE OF THE CITY OF ARCADIA REPEALING SECTIONS 2831.3 AND 2831.13 AND AMENDING SECTION 2844.1 OF THE ARCADIA MUNICIPAL CODE INCREASING AMOUNT OF PURCHASES OR SALES OF PERSONAL PROPERTY EXEMPT FROM THE BIDDING PROCESS FROM $100.00 TO $500.00. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. That Sections 2831.3 and 2831.13 of the Arcadia Municipal Code are hereby repealed. SECTION 2. That the Arcadia Municipal Code is hereby amended by Amending Section 2844.1 to read as follows: "Section 2844.1. EXCEPTIONS FROM BID PROCESS. Supplies, mate~ia1s, equipment and services may be purchased and personal property sold without complying with any of the bidding proce- dures specified in Divisions 2 and 3 of this Part in any of the following situations: (1) Upon the approval of the Manager when an emergency requires that an order be placed with the nearest available source of supply; (2) When the amount of purchase or sale involved is less than Five Hundred Dollars ($500.00); (3) When the commodity can be obtained from only one vendor and the amount involved is less than Six Thousand Dollars ($6,000.00). SECTION 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of compe- tent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Arcadia hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. -1- 1743 SECTION 4. Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which'vio~atlons were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. SECTION 5. The Clerk of the Council shall certify to the passage and adoption of this ordinance and shall cause the same to be published in the official newspaper of the City of Arcadia with- in fifteen (15) days after its adoption.
