ORDINANCE NO. 1749
AN ORDINANCE OF THE CITY OF ARCADIA AMENDING THE
ARCADIA MUNICIPAL CODE BY AMENDING AND ADDING TO
THE PROVISIONS OF DIVISION 9, PART 6, CHAPTER 2,
ARTICLE IX THEREOF AND RENUMBERING AND RETIT~ING
SECTIONS OF DIVISION 9 TO REGULATE SMALL CAR
PARKING SPACES
The City Council of the City of Arcadia hereby ordains as
follows:
SECTION 1. The Arcadia Municipal Code is hereby amended by
adding to Division 9, Part 6, Chapter 2, Article IX, Section
9269.5.1 to read as follows:
"9269.5.1. SMALL CAR PARKING REQUIREMENTS. Small car parking
spaces shall be permitted in commercial and industrial parking areas
which contain six or more parking spaces. A maximum of 20% of the
required parking spaces may be small car parking spaces. When a
fractional figure is found as a remainder in computations made to
determine the amount of small car parking spaces, such fraction shall
be rounded to the lowest whole number."
SECTION 2. That Subsections A and B of Section 9269.7 are
hereby renumbered and retitled to read respectively as follows:
"9269.7.1. SAME. COMMERCIAL ZONES."
"9269.7.2. SAME. INDUSTRIAL ZONES."
SECTION 3. That the Arcadia Municipal Code is hereby amended by
adding to Division 9, Part 6, Chapter 2, Article IX, Section 9269.7.3
to read as follows:
"9269.7.3. SAME. SMALL CAR PARKING. Small car parking in
commercial and industrial zones, if provided, shall be developed in
accordance with the following table:

* A Parking stall shall be no less than 10'-6" in width when said parking stall is
adjacent to columns on both sides which are within 4' of the open and of the stall or
when said parking stall is adjacent to a wall, a fence or a property line.
SECTION 4. That the "DIAGRAM FOR PARKING TABLES" set forth in
Section 9269.7 shall hereby be designated as Section 9269.7.4.
SECTION 5. That Subsections A and B of Section 9269.8 are
hereby renumbered and retitled to read, as follows:
"9269.8.1. SAME. COMMERCIAL ZONES."
"9269.8.2. SAME. INDUSTRIAL ZONES."
SECTION 6. That the Arcadia Municipal Code is hereby amended by
adding to Division 9, Part 6, Chapter 2, Article IX, Section
9269.8.3 to read as follows:
"9269.8.3. SAME. SMALL CAR PARKING SPACES. Each parking space
shall be clearly delineated with paint or other easily distinguish-
able material so as to provide a parking area six (6) feet in width
in between two (2) marked islands two (2) feet in width. Each small
car parking space shall be clearly marked with the words "SMALL CAR"
on the pavement as per the standards on file in the Planning Department."

SECTION 7. THAT Section 9269.9 of the Arcadia Municipal Code is
he~eby amended to read as follows:
"9269.9. WHEEL STOPS."
SECTION 8. That the Arcadia Municipal Code is hereby amended
by adding to Division 9, Part 6, Chapter 2, Article IX, Sections
9269.9.1 and 9269.9.2 to read respectively as follows:
"9269.9.l. SAME. COMMERCIAL ZONES. Wheel stops ora planter
curb shall be provided for each parking space and shall be set a
minimum of one meter (1m) = (39") from the forward end of the
parking stall for a standard size stall and sixty-six centimeters (66
cm) = (26") from the forward end of the parking stall for a small
car stall. Said wheel stops or planter curbs shall be fifteen centi-
meters (15 cm) = (6") high and shall be made of concrete or other
durable material subject to the approval of the Director of Planning.
If a planter curb is used as a wheel stop, the planted area con-
tained in the required parking space shall not be considered as part
of any required dimensions of landscape buffers and shall not be
included in the percentage of the parking area required to be land-
scapted. "
"9269.9.2. SAME. INDUSTRIAL ZONES. Wheel stops or a planter
curb shall be required where a parking space abuts a wall, building or
adjacent property line. Said wheel stops or planter curbs shall be
fifteen centimeters (15 cm.) = (6") high, shall be made of concrete or
other durable material subject to the approval of the Planning
Department, and shall be set a minimum of one meter (1 m) = (39")
for a standard size parking stall and sixty~six centime ters = (26")
for a small car parking stall from such wall, building, or property
line."

SECTION ~. ".'No person shall viollfl':'lr any provlslon, or Ial.l. ~o compl.y wun any
of the requirements 'of this ordinance. Any person violating any of the provisions or
failing to comply with any of the mandatory requirements of this ordinance shall be
guilty of a misdemeanor. Any,person convicted of a misdemeanor under any provision of
this or-dinance shall' be punishable by a fine of not more than Five Hundred Dollars, or
by imprisonment in the City Jail or County Jail for a period not exceeding six months,
or by both such fine and imprisonment. Each such person shall be guilty of a separate
offense for each and every day during any portion of which any violation of any pro-
vision of the ordinance is committed, continued, or permitted by such person and shall
be punishable accordingly.
SECTION 10. In addition to the penalties provided in the preceding section, any
condition caused or permitted to exist in violation of any of the provisions of this
ordinance shall be deemed a public nuisance and may be, by the City, summarily,abated
as such, and each day such condition continues shall be regarded as a new and separate
offense.
SECTION 11. If any section, subsection, sentence, clause, phrase or portion of
this ordinance is, for any reason, held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision shall not affect the
validity of the remaining portions of this ordinance. The City Council of the City
of Arcadia hereby declares that it would have adopted this ordinance and each section,
subsection, sentence, clause, phrase or portion thereof irrespective of the fact that
anyone or more sections, subsections, sentences, clauses, phrases or portions be
declared invalid or unconstitutional.
SECTION l~ Neither the adoption of this ordinance nor the repeal hereby of any
ordinance shall in any manner affect the prosecution for violation of ordinances,
which violations were committed prior to the effective date hereof, nor be construed
as affecting any of the provisions of such ordinance relating to the collection of any
such license or penalty or the penal provisions applicable to any violation thereof,
nor to affect the validity of any bond or cash deposit 'in lieu thereof, required to
be posted, filed or deposited pursuant to any ordinance and all rights and obligations
thereunder appertaining shall continue in full force and effect.
SECTION 13. The Clerk of the Council shall certify to the passage and adoption
of this ordinance and shall csuse the same to be published in the official newspaper
of the City of Arcadia within fifteen (15) days after its adoption.

ing held on the 6th day of July, 1982.
