HomeMy WebLinkAbout1653 ORDINANCE NO. 1653 AN ORDINANCE OF THE CITY OF ARCADIA AMENDING CHAPTER 3 OF ARTICLE VII OF THE ARCADIA MUNICIPAL CODE BY MODIFYING VARIOUS STREET EXCAVATION FEES CONTAINED THEREIN THE CITY COUNCIL OF THE CITY OF ARCADIA HEREBY ORDAINS AS FOLLOWS: Section 1. That Chapter 3 of Article VII of the Arcadia Municipal Code is hereby amended by amending Sections 7300.1, 7301.1, 7301.2, 7301.3, and 7301.4 to read as follows: 7300.1. PERMIT FEE. Before any permit is issued:pur- suant to this Chapter, the applicant shall pay to the ,City , a permit fee of Ten Dollars ($10.00) which is in addition , to all other fees and deposits required by this Chapter. 7301.1. EXCAVATION FEES. Any person intending t~ make an excavation for any purpose in any street, alley, parkway, public easement or other public place shall deposit with the City an inspection fee of Twenty Dollars ($20.00). 7301.2. SURFACE REPLACEMENT DEPOSIT. Any person'intend- ing to make an excavation in any street or alley shall de- posit with the City a sum equal to Four Dollars ($4.00) per square foot of surface of each such excavation to be made in any street, alley or other public place which is paved with concrete, or a sum equal to Three Dollars ($3.00). per square foot of surface of each such excavation to be made I in any street, alley or other public place which has been , macadamized or paved with asphalt; provided, however, that public utilities operating under the jurisdiction of the Public Utilities Commission of the State of California, city departments, and other governmental agencies, may be relieved of making such a deposit by the Director of Public Works. -1- 1653 7301.3. PUBLIC UTILITIES. Public utility companies may obtain an annual blanket permit at a cost of Two Hundred Dollars ($200.00) or they shall be required to obtain an excavation permit for each street cut in accor- dance with the above provisions. Inspection fees shall be billed to the utility companies on actual cost basis at the discretion of the Superintendent of Streets. 7301.4. SOIL TESTS. Any person making an excavation for which a permit is required by this Chapter shall pay to the City the sum of Thirty Dollars ($30.00) for each soil density test deemed necessary by the Director of Public Works and to be taken by City personnel. Section 2. If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Arcadia hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that anyone or more sections, subsections', sentences, clauses, phrases or portions be declared invalid or unconstitutional. Section 3. Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the pro- secution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. -2- 1653 Section 4. The Clerk of the Council shall certify to the passage and adoption of this ordinance and shall cause the same to be published in the official newspaper of the City of Arcadia within fifteen (15) days after its adoption.
