HomeMy WebLinkAbout07/05/2011 53:0126 CITY COUNCIL/REDEVELOPMENT AGENCY REGULAR MEETING MINUTES TUESDAY, JULY 5, 2011 CALL TO ORDER- Mayor Kovacic called the Closed Session to order at 6:00 p.m. ROLL CALL OF CITY COUNCIL/REDEVELOPMENT AGENCY MEMBERS: PRESENT: Council/Agency Member Amundson, Chandler, Harbicht, Segal and Kovacic ABSENT: None CLOSED SESSION/STUDY SESSION PUBLIC COMMENTS — No one appeared. CLOSED SESSION a. Pursuant to Government Code Section 54957.6 to confer with labor negotiators. City Negotiators: Administrative Services Director Hue Quach, Human Resources Administrator Michael Casalou and Attorney William Floyd of Best Best & Krieger, LLP. Employee Organizations: Arcadia Public Works Employees Association, Arcadia City Employees Association, Arcadia Police Civilian Employees Association, Arcadia Police Officers' Association, Arcadia Firefighters' Association and unrepresented employees: Department Heads, Division Managers, Supervisors, and Part-time employees. b. (Los Angeles County Superior Court Case No. BC462270). 07-05-11 1 53:0127 THE CITY COUNCIL/REDEVELOPMENT AGENCY ADJOURNED TO OPEN SESSION Mayor/Agency Chair Kovacic called the regular meeting to order at 7:00 p.m. INVOCATION — Reverend Jolene Cadenbach, Arcadia Congregational Church PLEDGE OF ALLEGIANCE — Mr. Joseph Feghali ROLL CALL OF CITY COUNCIL/REDEVELOPMENT AGENCY MEMBERS: PRESENT: Council/Agency Member Amundson, Chandler, Harbicht, Segal and Kovacic ABSENT: None REPORT FROM CITY ATTORNEY/AGENCY COUNSEL ON CLOSED SESSION/STUDY SESSION ITEMS City Attorney Stephen Deitsch announced that prior to the regular meeting, the City Council and Redevelopment Agency Board met in Closed Session to discuss and consider the four (4) Items listed on the posted agenda, no reportable action was taken. SUPPLEMENTAL INFORMATION FROM CITY MANAGER/EXECUTIVE DIRECTOR REGARDING AGENDA ITEMS — Mr. Penman noted there were no supplemental agenda items. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council/Agency Member Chandler, seconded by Council/Agency Member Segal to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Presentations made to outgoing Board and Commission Members. b. The City Clerk administered the Oath of Office to the newly appointed Board and Commission Members. PUBLIC COMMENTS Scott Hettrick appeared and thanked the City Council and the entire community on behalf of Arcadia's Best Foundation for their support in attending the street festival on Saturday; he thanked the City Administration, Public Works, Fire and Police Department, and all the volunteers and noted that he heard great comments and again expressed his sincere appreciation. REPORTS FROM THE CITY COUNCIL AND CITY CLERK Council Member Amundson thanked Scott Hettrick, Sho Tay and Bruce McCallum and everyone involved in the parade and street festival; he encouraged everyone to visit the City's website and provide comments and concerns regarding the downtown area including the parking issue; he commented on the expansion of the 210 freeway and noted the intermittent 07-05-11 2 53:0128 traffic diversions until next July; he announced the Marine Band will be playing on Thursday at the City Hall concert; he commented on the recent coyote issues and encouraged residents to take precaution; and reminded residents to take precautions when going on vacation and "not to become a victim" and reminded residents to call the Police Department and request a vacation home safety checks. Mayor Pro Tern Harbicht echoed Council Member Amundson's remarks regarding the Patriotic Parade and Festival; and noted on how well run and organized it was; he congratulated Scott Hettrick, Sho Tay, Bruce McCallum and Carol Libby and all the volunteers on a very successful event and noted that he was very pleased. Council Member Segal congratulated Mary Ann Gibson on her retirement and thanked her for all her years of service to the community; and congratulated everyone who put the parade together. Council Member Chandler echoed all the comments made and congratulated Mary Ann Gibson on her retirement. City Clerk Barrows also congratulated Mary Ann Gibson on her retirement; and congratulated Arcadia's Best Foundation on a successful event; he wished everyone a belated 4th of July and noted there were no major fires or incidents; he also reminded residents going out of town or on an extended vacation to take precaution and confirmed that the VIPS will conduct vacation home safety checks. Mayor Kovacic congratulated Arcadia's Best Foundation on a successful event and commented on how well run and organized it was run; he announced and advised Scott Hettrick that their volunteerism will be recognized at the next City Council meeting and looks forward to next year's parade and festival; and announced the Marine Band will be playing on Thursday at the City Hall concert. 1. CONSENT CALENDAR CITY COUNCIL ITEMS: a. Resolutions regarding the Arcadia Citywide Lighting District No. 1. Adopt Resolution No. 6779 initiating proceedings for the Annual Levy and Collection of Assessments for the Arcadia Citywide Lighting District No. 1 pursuant to the provisions of Part 2 of Division 15 of the California Streets and Highway Code and ordering the preparation of the Engineer's Report. Recommended Action: Adopt Adopt Resolution No. 6780 approving the Preliminary Engineer's Report of Willdan Financial Services for the Arcadia Citywide Lighting District No. 1. Recommended Action: Adopt Adopt Resolution No. 6781 declaring the Council's intention to levy and collect assessments within the Arcadia Citywide Lighting District No. 1 for Fiscal Year 2011/12 and appointing a time and place for a Public Hearing. Recommended Action: Adopt 07-05-11 3 53:0129 b. Authorize the City Manager to execute a contract with J A Salazar Construction & Supply Corp. for the Installation of the Pressure Reducing Station from Zone 2 to Zone 2A project in the amount of$135,220 and approve a 10% contingency. Recommended Action: Approve c. Authorize the City Manager to execute a one (1) year contract extension with Great Cleaning Service, Inc. (GCS) for janitorial and porter services at various City facilities in the amount of$239,817. Recommended Action: Approve d. Authorize the City Manager to execute a purchase agreement with Sungard Pentamation for Fiscal Year 2011-12 to provide financial system software maintenance in an amount not to exceed $32,100. Recommended Action: Approve It was moved by Council Member Segal seconded by Council Member Amundson and carried on roll call vote to approve Consent Calendar items 1.a through 1.d. AYES: Council Member Segal, Amundson, Chandler, Harbicht, and Kovacic NOES: None ABSENT: None 2. CITY MANAGER/AGENCY DIRECTOR ITEMS: a. Authorize the Police Department to assign a police officer to the Internal Revenue Service Los Angeles SAR & MSB Task Force and the utilization of Asset Forfeiture funds to lease office space for two years for the task force in the City of Arcadia in an amount not to exceed $350,000. Recommended Action: Approve Robert Guthrie, Interim Police Chief requested the assignment of one (1) full-time police officer to the Department of Treasury Internal Revenue Service (IRS) Los Angeles Suspicious Activity Reports (SAR) and Money Services Businesses (MSB) Task Force (LA-SMTF) in the battle against money laundering and other financial crimes; he indicated that these types of reports generate leads that law enforcement agencies use to initiate money laundering investigations; he indicated that the City will receive a minimum of 10% of all annual seizures by providing a Task Force Officer and office space; that as a an agency participant, the City will receive 5% of all annual seizures and an extra 5% of the seizures by LA-SMTF to substitute as payment for rental of office space. He reported that a location at the Vons headquarters meets the requirements and recommended the use of Asset Forfeiture funds to pay for the two year lease of the office space in the amount of $331,200 and that an additional $18,800 be set aside for contingencies; and stated that funds received from the task force will reimburse the Asset Forfeiture fund and any remaining money will then go into the City's General fund. A motion was made by Council Member Chandler seconded by Council Member Segal and carried on roll call vote to authorize the Police Department to assign a police officer to the Internal Revenue Service Los Angeles SAR & MSB Task Force and the utilization of Asset Forfeiture funds to lease office space for two years for the task force in the City of Arcadia and appropriate an amount not to exceed $350,000. 07-05-11 4 53:0130 AYES: Council Member Chandler, Segal, Amundson, Harbicht, and Kovacic NOES: None ABSENT: None a. Report, discussion and direction regarding Boundary Adjustments of County Supervisory Districts. Recommended Action: Provide direction City Manager Don Penman reported that every ten years based on the Decennial Census, the County Board of Supervisors are required to adjust boundaries of any or all of the supervisorial districts to ensure fair representation; that changes to the boundaries are made to ensure that districts are made to be "as nearly equal in population as may be"; he noted that the Board of Supervisors must adopt a redistricting plan by October 31, 2011; he noted that that at least twenty public plans have been submitted to the Boundary Review Committee and not all of the plans have Arcadia remaining in the Fifth Supervisory District and staff feels that it would be appropriate for Arcadia to provide input in this process; and that Arcadia has been served well by supervisors elected to the Fifth District and recommends sending a letter to the County recommending that Arcadia remain in the Fifth District as part of any adjustments made in response to the 2010 Decennial Census. Mayor Pro Tern Harbicht requested City Council support to bring back to the next City Council meeting a report regarding boundaries relating to the Assembly, State Senate and Congressional Districts. Mayor Kovacic and Council Member Amundson concurred. A motion was made by Council Member Chandler seconded by Council Member Segal and carried on roll call vote to direct staff to submit a letter to the County Boundary Review Committee recommending that Arcadia remain in the Fifth Supervisory District as part of any boundary adjustments; and to bring back to the next meeting a report regarding the boundaries relating to the Assembly, State Senate and Congressional Districts.
