HomeMy WebLinkAbout1654 ORDINANCE NO. 1654 AN ORDINANCE OF THE CITY OF ARCADIA AMENDING CHAPTER 2 OF ARTICLE IX OF THE ARCADIA MUNI- CIPAL CODE, ZONING ORDINANCE, TO PROVIDE THAT THE CITY COUNCIL MAY ESTABLISH BY RESOLUTION VARIOUS FILING FEES THEREIN. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The Arcadia Municipal Code is hereby amended by amending Sections 9275.2.2,9275.2.9,9291.2.2,9291.2.8,9292.1.10., 9292.2.8., and 9293.2.1. to read as follows: "9275.2.2. FEE. Before accepting for filing any app1ic'ation for a conditional use permit or an extension of a previously approved conditional use permit, the City shall charge and collect a fee which shall be paid and which shall be in an amount established by resolution of the City Council. 9275.2.9. APPEAL. Not later than five (5) working days after final action by the Planning Commission and up to the time that a regular Council meeting is held on such day, any- one may appeal from such action to the City Council by filing a written appeal with the City Clerk and paying a fee in accordance with the applicable fee schedule adopted by reso- lution of the City Council. If the appeal is to include a verbatim transcript, the appellant shall so specify in his written appeal and in addition to the fee shall deposit with the City Treasurer the estimated cost of preparing two (2) copies of a verbatim transcript. One copy thereof shall be delivered to appellant upon payment of the balance due, if any, upon the cost of its preparation and the other copy delivered to the City Clerk for use by the City on such appeal; any excess of the deposit over the cost shall be re- funded. At the first regular Council meeting following such final action, the City Council, by the vote of a majority of -1- 1654 Commission. If by such action the Council requests a verbatim transcript for use at the hearing on such appeal, a copy thereof shall be made available for inspection by any interested party. No fees shall be required in the case of an appeal by the Council. 9291.2.2. FEE. Before accepting for filing any applica- tion for a variance or an extension of a previously approved variance, the City shall charge and collect a fee which shall be paid and which shall be in an amount established by reso- lution of the City Council. 9291.2.8. APPEAL. Within five (5) working days after such decision by the Planning Commission, the applicant or any other person aggrieved by such decision may appeal therefrom in writing to the City Council by filing such with the City Clerk. A fee in accordance with the applicable fee schedule adopted by resolution of the City Council shall be paid to the Treasurer prior to the filing of any appeal concerning a variance. 9292.1.10. FEE. Before accepting for filing any applica- tion for a modification under this Title, the City shall charge and collect a fee which shall be paid in an amount established by resolution of the City Council. 9292.2.8. FEE. Before accepting for filing any applica- tion for an administrative modification under this Title, the City shall charge and collect a fee which shall be paid in an amount established by resolution of the City Council. 9293.2.1. SAME. FEE. Before accepting for filing any application under this division, the City shall charge and collect a fee which shall be paid in an amount established by resolution of the City Council." Section 2. If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity -2- 1654 of the remaining portions of this ordinance. The City Council of the City of Arcadia hereby delcares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. Section 3. Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal pro- visions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. Section 4. The Clerk of the Council shall certify to the passage and adoption of this ordinance and shall cause the same to be published in the official newspaper of the City of Arcadia within fifteen (15) days after its adoption.
