HomeMy WebLinkAbout1667 ORDINANCE NO. 1667 AN ORDINANCE OF THE CITY OF ARCADIA, CALIFORNIA, AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF ARCADIA AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM THE CI~Y COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: Section 1. That an amendment to the Contract between the City Council of the City of Arcadia and the Board of Administration, California Public Employees' Retirement System is hereby authorized, a copy of said amendment being attached hereto, marked "Exhibit A", and by such reference made a part hereof as though herein set out in full. Section 2. The Mayor of the City Council is hereby authorized, empowered, and directed to execute said amendment for and on behalf of said Agency. Section 3. This Ordinance shall take effect thirty-one (31) days after the date of its adoption, and prior to the expiration of fifteen (15) days from the passage thereof shall be published at least once in the Arcadia Tribune, a newspaper of general circulation, published and circulated in the City of Arcadia and thenceforth and thereafter the same shall be in full force and effect. Public Employees' Retirement System. .herein- after referred to as "Board". and the governing body of above public agency. herewfter referred to as "Public Agency". having entered into a contract under date of Scptember 24, 1945, effective October 1, 1945, and as amended effective July 1. 1953, January 1, 1957. January 1, 1958. January 1. 1959. January 19, 1964, February 28, 1965, October 1, 1972, June 24, 1973. January 4, 1976, April 10. 1977. which provides for parcidpation of Public Alency in said System. Board and Public Agency hereby agree as follows: A. Paragraphs 1 through 9 are hereby stricken from said contract as executed effective April 10, 1977. and hereby replaced by the foUov1ng paragraphs number 1 through 10 inclusil'e: 1. All words and terms used herein vhich are defined in the Public Employees' Retirement Law shall have the meaning as defined therein unless otherwise specifically provided. "Normal retirement age" shall meaQ age 60 for miscellaneous members and age 55 for local safety ml!lllbers. 2. Public Agency shall participate in the Public EMployees' Retirement System from and after October 1.1945, making-its employees as hereinafter provided. me~ers of said System s~ject to all provisions of the Public Employees' Retirem~t Law except such as apply only on alection of a contracting agency and are not provided for herein and to all amendments to said Lav hereafter enacted except such as by express provisions thereof apply only on tas election of contractins agencies. 3. Employees of Public Agency in the following classes shall become _bers of said Retirement System except such in each such class as are excluded by lav or this agreesr.ent: a. Local Firemen (herein referred to as local safety members); b. Local Pol1celllen (herein referred to as local safety melllbers); c. Employees other than local safety members (herein referred to as lliscellaneous members). In addition to the elasses of employees excluded from membership by said Retirement Law. the following classes of ~ployees shall not became members of said Retiremcnt System: NO ADDITIO~AL EXCLUSIONS EXHIBIT "A" CON-702-1 in Section 21251.13 of said Retire!lleftt Law with all service ~rior to Social Security termination (~rch 31. 1977) subject to the reduction provided by said section. 5. The fraction of final compensation to be provided for each year of credited prior and current service as a safety member shall be determined in accordance with Section 21252.6 of said Retireaent Law (2% at 55). 6. The following additioaal provisions of the Public EI:Iployees' Retir_eat Law Which apply only upon election of a contracting agency shall .~ply to the Public Agency and its employees: .. Section 20952.5 (providing for age 50 as the m1n1111\llll voluntary retirement age for local safety members. with benefit payments commencing prior to age 55 subject to actuarial disconnt). b. Sections 21380-21388 (providing for allowances for. survivors of members covered under the 1959 Survivor's Program upon the member's death before retirement). c. Section 20862.8 (providing service credit at retirement for aanaed sick leave). d. Section 20024.2 (defining "final compensation" en the b~1s of average co~ensation earnable during the year ~ediately preceding retirement or any other one year period elected by the member). e. Sections 21263 and 21263.1 (providing upon the death of a member who retired for servi~e or. disability for continuance of . post-retirement survivor allowance to certain survivors). 7. Public Agency. in accordance with Section 20740. Government Code. ceased to be an lIemployer" for purposes of Chapter 6 of the Public Employees' Retirement Law effective on April 10, 1977. Accumul3ted contributions of Public Agency 8S of the aforementioned date shall be fixed and determined as provided in Section 20759. Government Code. and accu=ulated contributions as of the afore- mentioned date snd contributions thereafter made shall be held.by the Board as provided in Section 20759. Gove~ent Code. 8. Public Agency shall contribute to said. Retirecent System as follows: a. With respect to miscellaneous lll~ers. the' agency shall contribute the follOwing percentages of Qontnly salaries earned as miscellaneous members of said ~tire~ent System: (1) 0.115 percent until June 30. 2000 on account of the liability for prior service benefits. . (2) 17.437 percent on account of the liability for current service benefits. (3) 0.282 percent on account of the liability for the 1959 Survivor Program. CON-702-2 (1) 0.053 percent until June 30. 2000 on account of the liability for prior service benefits. (2) 22.086 percent on account of the liability for current service benefits. (3) 0.097 percent on account of the liability for the 1959 Survivor Program. c. A reasonable amount per annum. as fixed by the Board to cover the costs of administering said System as it affects the employees of Public Agency. not including the costs of special valuations or of the periodical investigation and valuations required by law. d. A reasonable amount as fixed by the Board, payable in one installment as the occasions arise. to cover the costs of special valuations on account of employees of Public Agency. and costs of the periodical investigation and valuations required by law. 9. Contributions required of Public Agency and its employees shall be subject to adjustment by Board on account of aoendment6 to the Public Employees' Retirement Law. and on account of the experience under the Retirement System as determined by the periodical iuvestigation and valuation required by said Retirement Law. 10. Contributions required of Public Agency and its employees shall be paid by Public Agency to the Retirement System within thirty clays after the end of the period to which said contributions refer or as may be prescribed by Board regulation. If more or less than the correct ~ount of contributions is paid for any period. proper adjustment shall be made in connection with subsequent remittances. or adjustments on account of errors in contributions required of any employee may be made by direct cash'payments between the employee and the Board. Payments by Public Agency to Board may be made in the form of warrants. bank checks. bank drafts. certified checks. money orders. or cash. B. This amendment shall be attached to said contract and shall be effective on the day of . 19 . Witness our hands this day of . 19 .
