HomeMy WebLinkAbout1671 ORDINANCE NO. 1671 AN ORDINANCE OF THE CITY OF ARCADIA AMENDING SECTIONS 9233.7 AND 9233.11 OF THE ARCADIA MUNICIPAL CODE TO REZONE VARIOUS PROPERTIES LOCATED IN THE DOWNTOWN AREA WHEREAS, the City Council of the City of Arcadia held a public hearing on February 20, 1979, for the purpose of considering chang- ing the zone from C-1D, C-1DH, C-2D to C-2 and C-2H for various properties located in the downtown area~ WHEREAS, all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, the City Council of the City of Arcadia does ordain as follows: Section 1. Exhibit B which is attached hereto is by this refer- ence incorporated herein. Section 2. That Section 9233.7 of the Arcadia Municipal Code is hereby amended, by amending the zoning map contained therein so that: A. The property legally described as Area 1 on Exhibit "B" hereof, presently classified as C-ID, shall hereafter be classified as C-2; and B. The property legally described as Area 2 on Exhibit "B" hereof, presently classified as C-2D, shall hereafter be classified as C- 2 . Section 3. That Section 9233.11 of the Arcadia Municipal Code is hereby amended, by amending the zoning map contained therein so that: A. The property legally described as Area 3 on Exhibit "B" hereof, presently classified as C-1DH, shall hereafter be classified as C-2H; and B. The property legally described as Area 4 on Exhibit "B" hereof, presently classified as C-ID, shall hereafter be classified as C-2. -1- 1671 Section 4. We find and determine that all written documenta- tion presented by the Planning Department to the City Council for the hearing on this zone change is true and correct1 that this zone change is consistent with the general plan1 that this zone change would allow for a more harmonious,flexible and desirable development of the area; that the public convenience, necessity, general welfare and good zoning practice justify the proposed zone change; that the new zoning is the highest and best use of Property consistent with present zoning classifications1 and that said zone changes will not have a significant effect on the environment. Section 5. If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent juris- diction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Arcadia hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof ir- respective of the fact that anyone or more sections, subsections, sen- tences, clauses, phrases or portions be declared invalid or unconsti- tutional. Section 6. Neither the adoption of this ordinance nor the re- peal hereby of any ordinance shall in any manner affect the prosecu- tion for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the prov~s~ons of such ordinance relating to the collection of anv such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. Section 7. The Clerk of the Council shall certity to the pass- age and adoption of this ordinance and shall cause the same to be pUblished in the official newspaper of the City of Arcadia within fifteen (15) days after its adoption. -2- 1671 at PASSED AND ADOPTED BY THE CITY its regular meeting held on the COUNCIL of the City of Arcadia 20th day of March , 1979.
