ORDINANCE NO. 1672
AN ORDINANCE OF THE CITY OF ARCADIA AMENDING
SECTION 9233.12 OF THE ARCADIA MUNICIPAL CODE
TO REZONE 9834-9836 WEST NAOMI AVENUE FROM C-l
TO R-3
WHEREAS, the City Council of the City of Arcadia held a public
hearing on March 6, 1979, for the purpose of considering the rezoning
of 9834-9836 West Naomi Avenue from C-l to R-3;
WHEREAS, all interested persons were given full opportunity to
be heard and to present evidence.
NOW, THEREFORE, the City Council of the City of Arcadia does
ordain as follows:
Section 1. That Section 9233.12 of the Arcadia Municipal Code
is hereby amended, by amending the zoning map contained therein so that
the following legally described property presently classified as C-l
shall hereafter be classified as R-3:
The east 66 feet of the west 381 feet of Lot 6, Block "A"
of the Santa Anita Land Company's Tract, as per map recorded
in Book 6, page 137 of Maps, in the office of the Recorder
of Los Angeles County.
Section 2. We find and determine that all written documentation
presented by the Planning Department to the City Council for the hear-
ing on this zone change is true and correct; that this zone change is
consistent with the general plan; that this zone change would allow
for a more harmonious, flexible and desirable development of the area;
that the public convenience, necessity, general welfare and good zon-
ing practice justify the proposed zone change; that the new zoning is
the highest and best use of Property consistent with present zoning
classifications; and that said zone changes will not have a significant
effect on the environment.
Section 3. If any section, subsection, sentence, clause, phrase
or portion of this ordinance is, for any reason, held to be invalid
or unconstitutional by the decision of any court of competent juris-
diction, such decision shall not affect the validity of the remaining
portions of this ordinance. The City Council of the City of Arcadia
hereby de~lares that it would have adopted this ordinance and each sec-

tion, subsection, sentence, clause, phrase or portion thereof ir-
respective of the fact that anyone or more sections, subsections,
sentences, clauses, phrases or portions be declared invalid or un-
constitutional.
Section 4. Neither the adoption of this ordinance nor the re-
peal hereby of any ordinance shall in any manner affect the prosecution
for violation of ordinances, which violations were committed prior to
the effective date hereof, nor be construed as affecting any of the
provisions of such ordinance relating to the collection of any such
license or penalty or the penal provisions applicable to any violation
thereof, nor to affect the validity of any bond or cash deposit in lieu
thereof, required to be posted, filed or deposited pursuant to any
ordinance and all rights and obligations thereunder appertaining shall
continue in full force and effect.
Section 5. The Clerk of the Council shall certify to the pass-
age and adoption of this ordinance and shall cause the same to be
published in the official newspaper of the City of Arcadia within
fifteen (15) days after its adoption.
