HomeMy WebLinkAbout1681 ORDINANCE NO. 1681 AN ORDINANCE OF THE CITY OF ARCADIA AMENDING THE ARCADIA MUNICIPAL CODE BY REPEALING DIVISION 3 OF PART 3, CHAPTER 5 OF ARTICLE II ENTITLED WATER DEPARTMENT DEPRECIATION AND RESERVE FUND AND ADDING A NEW DIVISION 3 THERETO ENTITLED WATER FACILITIES REPLACEMENT FUND. IT IS HEREBY AS FOLLOWS: SECTION 1. ORDAINED BY THE CITY COUNCIL OF THE CITY OF ARCADIA That the Arcadia Municipal of Part 3, Chapter 5, Code is hereby amended by Article II thereof. repealing Division 3 SECTION 2. adding thereto a read as follows: "ARTICLE II. CHAPTER 5. PART 3. DIVISION 3. That the Arcadia Municipal Code is hereby amended by new Division 3 to Part 3, Chapter 5, Article II to ADMINISTRATION SPECIAL FUNDS SPECIAL FUNDS - ORDINANCE WATER FACILITIES REPLACEMENT FUND 2533. CREATION. There is hereby created a special fund to be known as the Water Facilities Replacement Fund. 2533.1 PURPOSE. This fund shall be used solely for the purpose of replacing the facilities of the Water Department. Said replacement, including any increases in size or capacity of the facilities being replaced, shall be required to provide improved reliability of water service, reduced operating or maintenance costs, increased fire protection or improvements in water pressure or water quality. Allowable expenditures shall include all costs for engineer- ing, inspection, materials, land, right of way, and construction necessary for the replacement of facilities including, but not limited to, reservoirs, wells, pumps, pipelines, valves, meters, services, fire hydrants, motors, engines, electrical equipment, -1- 1681 telemetry systems, ch~lorination equipment and related appurte- nances. This fund shall not be used for the day-to-day opera- tion or maintenance of the water system. 2533.2 SOURCE. The source of funding shall be general water revenues. Each fiscal'year, beginning with the close of the 1978-79 fiscal year, an amount shall be transferred from the Water Fund to the Water Facilities Replacement Fund in accordance with Council directive. All interest accrued shall remain in the fund." SECTION 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Arcadia hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion ther~of irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 4. Neither the adoption of this ordinance nor the repeal, hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the pro- visions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. SECTION 5. The Clerk of the Council shall certify to the passage and adoption of this ordinance and shall cause the same to be -2- 1681 published in the official newspaper of the City of Arcadia within fifteen (15) days after its adoption.
