HomeMy WebLinkAbout1686 lO/l8/79 ORDINANCE NO. l686 AN ORDINANCE OF THE CITY OF ARCADIA AMENDING SECTIONS 4ll3.9 AND 4l24.2 THEREOF, AND ADDING SECTIONS 4l37.7 AND 4137.7.1 THERETO TO ADOPT VARIOUS FEES AS REQUIRED BY THE LOS ANGELES COUNTY DEPARTMENT OF ANIMAL CONTROL AND ADDITIONAL REQUESTED ANIMAL CONTROL REGULATIONS. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOL- LOWS: SECTION 1. The Arcadia Municipal Code is hereby amended by amend- ing Section 4113.9 to read as follows: "4l13.9. DISPOSAL OF DOGS AND CATS. Any approved research institu- tion may, at any time, request the Poundmaster to deliver to it any dog or cat impounded by him. Not less than five (5) or more than thirty (30) days after the taking and impounding of any dog or cat, unless such dog or cat has been redeemed by the owner, the poundmaster shall deliver to the approved research institution at the place of impounding the dogs or cats, or both, designated by it, upon payment of a fee, as below listed, except that the poundmaster s~all.not deliver any dog or cat to any approved research institution if the owner of such dog or cat has instructed the Poundmaster not to do so. Not less than five (5) days after the taking up and impounding of any dog or cat, or three (3) days after the taking up and impounding of any puppy or kitten impounded in a litter of two or more, unless it be sooner redeemed or delivered to an approved research institution, the Poundmaster shall destroy such dog or cat or shall dispose of such dog , . or cat to any other person who will pay the reasonable value of such dog or cat, but in no case less than the below-listed fees. In the case of the sale of a dog (other than delivery to an approved research institution), the purchaser also shall procure and pay for the required license for such dog for the current year unless such a license already is issued and in full force and ~!fect. The Arcadia Municipal Code is hereby amended by amending Section 4124.2 to read as follows: "4l24.2. ANNUAL. The license fees provided for herein shall be paid annually in advance to the Poundmaster. The full amount of each such license fee is payable for any fraction of a year. An administrative charge of Five Dollars ($5) shall be assessed when the license fees provided for herein are not paid within sixty (60) days after the expiration date. SECTION 3. The Arcadia Municipal Code is hereby amended by adding thereto Sections 4l37.7 and 4137.7.l to read as follows: "4137.7. ANIMAL DEFINITION. For purposes of Subsection 4137.7.1 the term "animal" or "animals" shall mean "household pets", "rabbits, poultry and domestic fowl" as defined in Division 1 of this Part 3, reptile fish or any other dumb creature. 4l37.7.l. CARE AND CONTROL. Every person who owns or possesses any animal or who owns, conducts, manages, or operates any animal establishment for which a license is required by the Arcadia Municipal Code, shall comply with each of the following requirements: (a) All animals shall be supplied with sufficient good and whole- some food and water as often as the feeding habits of the respective animals require. (b) No animals shall be without attention more than twelve consecu- tive hours. Whenever an animal is left unattended at a commercial animal facility, the telephone number ~f the Los Angeles County Department of Animal Control or the name, address and telephone number , . of the responsible person shall be posted in a conspicuous place at the front of the property. (c) Take any animal to a veterinarian for examination or treatment if the poundmaster or the Los Angeles County Department of Animal Control finds this is necessary' in order to maintain the health of the animal and orders the owner or oustodian to do so. -)- 1686 (d) Not allow any animal to constitute or cause a hazard or be a menace to the health, peace or safety of the community. SECTION 4. The fees and charges specified in this ordiqance are based in part on the cost which the Los Angeles County Department of Animal Control will incur in enforcing Chapter 1 of Article IV of the Arcadia Municipal Code for the 1979-l980 fiscal year. SECTION 5. No person shall violate any provision, or fail to comply with any of the requirements of this ordinance. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this ordinance shall be guilty of a misdemeanor. Any person convicted of a misdemeanor under any provision of this ordinance shall be punishable by a fine of not more than Five Hundred Dollars, or by imprisonment in the City Jailor County Jail for a period not exceeding six months, or by both such fine and imprisonment. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinance is committed, continued, or permitted by such person and shall be punishable accordingly. SECTION 6. In addition to the penalties provided in the preceding Section, any condition caused or permitted to exist in violation of any of the provisions of this ordinance shall be deemed a public nuisance and may be,> b~ the City, summarily abated as such, and each day such condition continues shall be regarded as a new and separate offense. SECTION 7. If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of com- petent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Arcadia hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the: fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 8. Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal pro- visions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. -4- 1686 SECTION 9. The Clerk of the Council shall certify to the passage and adoption of this ordinance and shall cause the same to be' published in the official newspaper of the City of Arcadia within fifteen (l5) days after its adoption.
