ORDINANCE NO. l661
AN ORDINANCE OF THE CITY OF ARCADIA AMENDING THE
ARCADIA MUNICIPAL CODE BY REPEALING SECTION 4l25.6
AND ADDING SECTIONS 4ll3.9, 4ll3.l0, 4ll3.ll, 4ll3.l2,
4113.13 AND 4ll3.14 TO ADOPT VARIOUS FEES AS REQUIRED
BY THE LOS ANGELES COUNTY DEPARTMENT OF ANIMAL CONTROL
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES.HEREBY ORDAIN
AS FOLLOWS:
Section l. That Section 4l25.6 of the Arcadia Municipal Code
is hereby repealed.
Section 2. That the Arcadia Municipal Code is hereby amended
by adding thereto Sections 4113.9, 4113.l0, 4l13.1l, 4ll3.l2,
41l3.13 and 4113.14 to read as follows:
"4113.9. DISPOSAL OF DOGS AND CATS. Any approved research
institution may, at any time, request the Poundmaster to deliver
to it any dog or cat impounded by him. Not less than five (5) or
more than thirty (30) days after the taking and impounding of any
dog or cat, unless such dog or cat has been redeemed by the owner,
the Poundmaster shall deliver to the approved research institution
at the place of impounding the dogs or cats, or both, designated by
it, upon payment of a fee, as below listed, except that the Pound-
ma$ter shall not deliver any dog or cat to any approved research
in$titution if the owner of such dog or cat has instructed the
Poundmaster not to do so.
Not less than five (5) days after the taking up and impounding
of any dog or cat herein provided unless it be sooner redeemed or
delivered to an approved research institution, the Poundmaster shall
de$troy such dog or cat or shall dispose of such dog or cat to any
other person who will pay the reasonable value of such dog or cat,
but in no case less than the below-listed fees. In the case of the
sale of a dog (other than delivery to an approved research institu-
tion), the purchaser also shall procure and pay for the required
license for such dog for the current year unless such a license
already is issued and in full force and effect.

"4113 .lO. KENNEL, ETC. FEE. In addition to any other fees
required by this Chapter, before receiving an application for the
granting of any license required by this Chapter, the Poundmaster
shall require the payment of an annual license in amounts as follows:
Dog Kennel $50.00
Cat Kennel 30.00
Pet Shop 30.00
Grooming Parlor 30.00
Animal Menagerie 80.00
Animal Exhibition 80.00
Except the Poundmaster may issue an Animal license on a daily
basis for $lO.OO per day."
"4113.11. PUBLIC SPAY AND NEUTER CLINIC.
(a) The Poundmaster may establish a clinic, at which members
of the public may have dogs and cats spayed or neutered in a humane
manner upon payment of the following fees:
For neutering a male cat
For spaying a female cat
For spaying a female dog
For spaying a female dog
For spaying a female dog
For neutering a male dog
For neutering a male dog
up to 25 pounds
up to 50 pounds
over 50 pounds
up to 50 pounds
over 50 pounds

A fee of one-half the amount above stated shall be charged
to persons presenting a valid Medi-Cal card. In addition to the
above fee, a fee of $3.00 shall be charged for the giving of a
distemper vaccination.
(b) A person submitting a dog or cat for the above service
shall sign a consent form certifying thereon under penalty of
perjury that he is the owner of said animals or setting forth facts
showing that he is otherwise authorized to present the animals for
the above operation and such person may be required to furnish
proof of such ownership or authority. Such consent shall contain
a waiver of any and all liability of the City of Arcadia, its
employees, Los Angeles County, the Department of Animal Care and
Control and any County employees for any injury or death to an
animal arising out of the aforementioned operation or any services
provided incidental thereto.
(c) A deposit to cover the costs of spaying or neutering shall
be required when the above operation has been scheduled. Upon
failure to bring a dog or cat in for the scheduled operation, the
deposit shall be forfeited.
(d) The Poundmaster shall establish a return date by which
a person submitting an animal for the above operation shall pick
up said animal or be subject to a reasonable board and care fee
to commence the day after such return date. Failure to pick up an
animal within l5 days of said return date shall be deemed abandon-
ment of such animal and the Poundmaster may dispose of it by sale
or destruction."
"4ll3.l2. DEAD ANIMALS. The Poundmaster shall pick up and
dispose of all dead animals on public highways and on public and
private property within the City of Arcadia, where the owner is
unknown. The Poundmaster shall also pick up dead animals, other
than livestock, at a fee of $2.00 when at the request of the
animal's owner or other person having custody or control over the
animal, except that he shall not pick up any dead animal:
(a) In Garbage Disposal districts where contractors are
required to perform such service pursuant to contract;
(b) In beach areas which are maintained by the Los Angeles
County Department of Parks and Recreation."

"4113 .l3. UNWANTED ANIMAL FEES. The Poundmaster shall
charge the fOllowing fees for the taking up or relinquishing of
an unwanted animal when requested to do so by the animal's owner
or other person having custody or control over said animal.
For the relinquishing of a single live dog or cat at
a shelter of the Poundmaster . . . .. ....
For the relinquishing of a live dog or cat litter
at a shelter of the Poundmaster.
For the taking up of one or more live animals

"4113.l4. LIABILITY. The owner or other person having custody
or control over bovine animals shall be liable to the City of
Arcadia and Los Angeles County for the salary, costs and other ex-
penses incurred by the Poundmaster's personnel when used for the
restraining, capturing or rescuing of said animals. The salary,
costs and expenses shall be determined by the Los Angeles County
Auditor-Controller with an allowance given for the impoundment fee
as designated in Section 4133 of this Chapter."
Section 3. The fees and charges specified in this ordinance
are based in part on the cost which the Poundmaster will incur in
enforcing Chapter 1 of Article IV of this Code for the 1978-l979
fiscal year.
Section 4. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is, for any reason, held to be
invalid or unconstitutional by the decision of any court of competent
jurisdication, such decision shall not affect the validity of the
remaining portions of this ordinance. The City Council of the City
of Arcadia hereby declares that it would have adopted this ordinance
and each section, subsection, sentence, clause, phrase or portion
thereof irrespective of the fact that anyone or more sections,
subsections, sentences, clauses, phrases or portion be declared
invalid or unconstitutional.

Section 5. Neither the adoption of this ordinance nor the
repeal hereby of any ordinance shall in any manner affect the
prosecution for violation of ordinances, which violations were
committed prior to the effective date hereof, nor be construed
as affecting any of the provisions of such ordinance relating to
the collection of any such license or penalty or the penal provi-
sions applicable to any violation thereof, nor to affect the validity
of any bond or cash deposit in lieu thereof, required to be posted,
filed or deposited pursuant to any ordinance and all rights and
obligations thereunder appertaining shall continue in full force
and effect.
Section 6. The Clerk of the Council shall certify to the
passage and adoption of this ordinance and shall cause the same to
be published in the official newspaper of the City of Arcadia
within fifteen (15) days after its adoption.
PASSED AND ADOPTED by the City Council of the City of Arcadia
at its regular meeting held on the 7th day of November ,l978.
