HomeMy WebLinkAbout1692 ORDINANCE NO. 1692 AN ORDINANCE OF THE CITY OF ARCADIA AMENDING SECTION 9233.12 OF THE ARCADIA MUNICIPAL CODE TO REZONE PROPERTY FRONTING ON LOVELL AVENUE BETWEEN DUARTE ROAD AND NAOMI AVENUE FROM PR-l TO C-O. WHEREAS, the City Council of the City of Arcadia held a public hearing on January 2, 1980 for the purpose of considering the rezoning of property fronting on the west side of Lovell Avenue between Duarte Road and Naomi Avenue from PR-l (Parking Overlay) to C-O (Professional Office); WHEREAS, all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, the City Council of the City of Arcadia does ordain as follows: SECTION 1. That Section 9233.12 of the Arcadia Municipal Code is hereby amended, by amending the zoning map contained therein so that the following legally described property presently classified as PR-l shall hereafter be classified as C-O: The property located between Duarte Road on the north, Naomi Avenue on the south, Lovell Avenue on the east, and Baldwin Avenue on the west, more particularly described as follows: Commencing at a point 44.17 feet south of the inter- section of the southerly line of Lot 1, Parcel Map 6387, P.M.B. 69, 45 and 46 and the westerly right of way of Lovell Avenue, thence west in a straight line 283.56 feet, thence north along the prolongation of the westerly line of Lot 1, P.M. 6387, 44.17 feet, thence east 283.56 feet to the intersection of said line with the westerly right of way of Lovell Avenue, thence south along the westerly right of way of Lovell Avenue 44.17 feet to the point of beginning. - 1 - 1692 SECTION 2. We find and determine that all written documentation pre- sented by the Planning Department to the City Council for the hearing on this zone change is true and correct; that this zone change is consistent with the General Plan; that this zone change would allow for a more harmonious, flexible and desirable development of the area; that the public convenience, necessity, general welfare and good zoning practice justify the proposed zone change; that the new zoning is the highest and best use of property consistent with present zoning classifications; and that said zone changes will not have a significant effect on the environment. SECTION 3. If any section, subsection, sentence, clause, phrase or por- tion of this ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Arcadia hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irres- pective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 4. Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were comitted prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applic- able to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. SECTION 5.
