ORDINANCE NO. 1693
AN ORDINANCE OF THE CITY OF ARCADIA AMENDING
SECTION 9233.8 OF THE ARCADIA MUNICIPAL CODE
TO REZONE PROPERTY AT 610-618 NORTH SANTA ANITA
AVENUE FROM R-3 TO C-l.
WHEREAS, the City Council of the City of Arcadia held a public
hearing on January 15, 1980 for the purpose of considering the re-
zoning of property at 610-618 North Santa Anita Avenue from R-3 to
C-2 ;
WHEREAS, C-l usage is a more restrictive usage than C-2, and
is an allowed use in C-2;
WHEREAS, the City of Arcadia has modified its request from C-2
to C-l zoning of aforesaid property;
WHEREAS, all interested persons were given full opportunity to
be heard and to present evidence;
NOW, THEREFORE, the City Council of the City of Arcadia does
ordain as follows:
SECTION 1. That Section 9233.8 of the Arcadia Municipal Code
is hereby amended, by amending the zoning map contained therein so
that the following legally described property presently classified
as R-3 shall hereafter be classified as C-l:
All that real property located in the City of Arcadia,
County of Los Angeles, State of California described
as follows:
Lots 16 and 17 and those portions of Lots 11 through 15
inclusive of the Haven Tract, in the City of Arcadia, as
shown on map recorded in Book 13, Pages 22 and 23, in the
office of the County Recorder of said County, bounded
Northwesterly and Northeasterly by the following described
1 ine:
Beginning at a point in the Westerly line of said Lot 15,
distant along said Westerly line South 10 04' 13" east
20.00 feet from the Northwesterly corner of said Lot 15;

thence North 64 57' 12" East 49.25 feet to the Northerly
line of said Lot 15; thence in a direct line Southeasterly
to a point in the Southerly line of said Lot 11, distant
thereon North 880 54' 49" East 17.47 feet from the South-
westerly corner of said Lot 11.

SECTION 2. We find and determine that based on the Staff
Report and testimony in favor of said zone change, that this
zone change is consistent with the General Plan; that this
zone change would allow for a more harmonious, flexible and
desirable development of the area; that the public convenience,
necessity, general welfare and good zoning practice justify the
proposed zone change; that the new zoning is the highest and best
use of property consistent with present zoning classifications;
and that said zone changes will not have a significant effect on
the environment.
SECTION 3. If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is, for any reason, held to be invalid or unconstitutional
by the decision of any court of competent jurisdiction, such decision shall not
affect the validity of the remaining portions of this ordinance. The City Council
of the City of Arcadia hereby declares that it would have adopted this ordinance
and each section, subsection, sentence, clause, phrase or portion thereof irres-
pective of the fact that anyone or more sections, subsections, sentences, clauses,
phrases or portions be declared invalid or unconstitutional.
SECTION 4. Neither the adoption of this ordinance nor the repeal hereby
of any ordinance shall in any manner affect the prosecution for violation of
ordinances, which violations were comitted prior to the effective date hereof,
nor be construed as affecting any of the provisions of such ordinance relating
to the collection of any such license or penalty or the penal provisions applic-
able to any violation thereof, nor to affect the validity of any bond or cash
deposit in lieu thereof, required to be posted, filed or deposited pursuant to
any ordinance and all rights and obligations thereunder appertaining shall
continue in full force and effect.
SECTION 5. The Clerk of the Council shall certify to the passage and
adoption of this ordinance and shall cause the same to be published in the
official newspaper of the City of Arcadia within fifteen (15) days after its
adoption.
PASSED AND ADOPTED BY THE CITY COUNCIL of the City of Arcadia
at its regular meeting held on the 19th day of February, 1980.
