HomeMy WebLinkAbout1575 ORDINANCE NO. 1575 AN ORDINANCE OF THE CITY OF ARCADIA AMENDING THE ARCADIA MUNICIPAL CODE BY REPEALING SECTION 9275.4.14, ADDING THERETO SECTION 9275.1.39.2 AND ADDING SUBPARAGRAPH 3 TO SECTION 9275.4.7, AND PERMITTING AUTOMOBILE SELF-SERVICE STATIONS IN A C-O OR ANY LESS RESTRICTIVE COMMERCIAL OR INDUSTRIAL ZONE ONLY WITH AN APPROVED CONDITIONAL USE PERMIT THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Section 9275.4.14 of the Arcadia Municipal Code is hereby repealed. SECTION 2. The Arcadia Municipal Code is hereby amended by adding thereto Section 9275.1.39.2 to read as follows: "9275.1.39.2. AUTOMOBILE SELF-SERVICE STATIONS. C-O or any less restrictive commercial or industrial zone." SECTION 3. That Section 9275.4.7 of the Arcadia Municipal Code is hereby amended to read as follows: "9275.4.7. ACTIVITIES PERMITTED AND PROHIBITED. The following shall regulate activities on any drive-in business site: 1. Vehicles. No vehicles shall be parked on the premises other than those of persons attending to business on the site, vehicles being serviced for customers, vehicles of employees and tow trucks and other service vehicles. No vehicles shall be parked on streets, alleys, sidewalks or required landscaped strips. 2. Automobile Service Stations. At an automobile service station no activities other than the following shall be conducted: dispensing gasoline, oil, grease, tires, batteries and automobile -1- 1575 accessories directly to users of motor vehicles; tuning motors; wheel and brake adjustment and other minor repairs and servicing of motor vehicles only to the extent of installation of tires, batteries and automobile accessories directly to users of motor vehicles; conducting a commercial towing service by the operator of such service station, provided that wrecked or damaged vehicles shall not be towed to, nor stored upon, such service station property. All other activities are prohibited including, but not limited to, upholstering work, auto glass work, painting, welding, tire recapping and auto dismantling. 3. Automobile Self-Service Stations. Self-service gasoline dispensing shall be permitted provided that approved dispensing such as, but not limited to, remote control, token-operated and card-operated types are used. Said use shall comply with require- ments of the Fire Department. There shall beat least one qualified attendant on duty at all times while the station is open to the public, for each 16 single dispensing units or combination thereof. It shall be the responsibility of the attendant to supervise, observe and control the dispensing of gasoline, to prevent the dispensing of gasoline into portable containers that are not approved as per Section l5.703(dl of the Fire Code, control sources of ignition, to immediately handle accidental spills and fire extin- guishers if needed and to lend assistance to handicapped persons in the dispensing of gasoline. At an automobile self-service station no activities other than the following shall be conducted: dispensing gasoline, oil, grease, tires, batteries and automobile accessories directly to -2- 1575 users of motor vehicles; tuning motors; wheel and brake adjustment and other minor repairs and servicing of motor vehicles only to the extent of installation of tires, batteries and automobile accessories directly to users of motor vehicles; conducting a commercial towing service by the operator of such self-service station, provided that wrecked or damaged vehicles shall not be towed to, nor stored upon, such service station property. All other activities are prohibited including, but not limited to, upholstering work, auto glass work, painting, welding, tire re- capping, and auto dismantling. There shall be no distribution or sale on the subject site of food, carbonated drinks and cigarettes except from dispensers within a building, or other items not inci- dental to the operation of motor vehicles. There shall be no storage, sale, display or advertisement for sale or lease of motor vehicles, trucks or trailers on the subject site." SECTION 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Arcadia hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. -3- 1575 SECTION 5. Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or case deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. SECTION 6. The Clerk of the Council shall certify to the passage and adoption of this ordinance and shall cause the same to be published in the official newspaper of the City of Arcadia within fifteen (15) days after its adoption. PASSED AND ADOPTED by the City Council of the City of Arcadia at its regular meeting held on the 16thday of November, 1976.
