HomeMy WebLinkAbout1590 ORDINANCE NO. 1590 AN ORDINANCE OP THE CITY OP ARCADIA, CALIFORNIA AMENDING SECTION 9233.3 OF THE ARCADIA MUNICIPAL CODE TO REZONE PROPERTY KNOWN AS THE ANOAKIA AREA FROM R-1 7,500 TO R-O 30,000 THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. That Section 9233.3 of the Arcadia Municipal Code is hereby amended, by amending the zoning map contained in said Section 9233.3 so that the property commonly known as the "Anoakia area", here- inafter referred to as such, presently classified as R-I 7,500, Second one-Family zone, shall hereafter be classified as R-O 30,000 First one- Family zone. Said property is more particularly described as follows: Beginning at the northeasterly corner of Tract No. 13429 as filed in Book 273, Page 25 of Maps in the Office of the Recorder of Los Angeles County; Thence westerly along the northerly boundary of said Tract 1085.88 feet more or less to the intersection of Tract No. 13429 and Hampton Road; Thence southwesterly through its various courses and distances along the southeasterly right-of-way line of Hampton Road and Fallen Leaf Road to the most northerly corner of Lot 35, Tract No. 11204, Book 197, Pages 18 through 20 in the office of said Recorder; Thence South- easterly 122.37 feet along to the northeasterly boundary of said Lot 35; Thence southerly 510 feet along the easterly boundaries of Lots 35 and 36 of said Tract 11204 to the northerly right-of-way line of Foothill Blvd. 90 feet wide; Thence Easterly along the northerly right-of-way line of Foothill Blvd. to the westerly right-of-way line of Baldwin Avenue 80 feet wide; Thence northerly along the westerly right-of-way line of Ba1dwln Avenue to the point of beginning. SECTION 2. This ordinance is based upon the following findings: a. The Anoakia area consists of approximately 30.60 acres, and is contiguous to, is part of, and constitutes the lower southeast ~ 1 - 1590 corner of that approximately 626 acre exclusively residential portion of the City of Arcadia known as the upper Rancho, which is bounded by Michi11inda Avenue, a secondary arterial street on the east, Orange Grove Avenue, a collector street on the north, Baldwin Avenue, a secondary arterial street on the east, and Foothill Boulevard, a major arterial street on the south. b. The 626 acre Upper Rancho area is unique in that it is used exclusively for single family dwe11lngs, has a general plan designation of Single Family Residential 0 - 2 dwelling units per acre, and consis- tent with said general plan designation contains single family dwell- ings on lots zoned R-O & D 30,000, averaging 33,925 square feet in area, containing substantial amounts of vegetation and style of development and homes with a value up to $298,000. c. The 30.60 acre Anoakia area, as a part of the Upper Rancho, immediately abuts secondary arterial Baldwin Avenue on the east and major arterial Foothill Boulevard on the south, which carry 8,245 and 11,361 vehicles per day respectively. d. In March of 1972 the City COQnci1 designated the 30.60 acre Anoakia area in the Arcadia General Plan as Single Family Residential, o - 2 dwelling units per acre, and in 1975 it was annexed to the City of Arcadia, and was automatically zoned to its present zone of R-1 7,500 pursQant to Arcadia Municipal Code Section 9232.6. e. The present R-1 7,500 zoning of the Anoakia area is present- ly inconsistent with the general plan designation for the area in that it allows for residential uses which are up to three times the maximum - 2 - 1590 density permitted by the Anoakia area's 0 - 2 dwelling units per acre general plan designation. R-O 30,000 zoninq designation is, however, consistent with said general plan desiqnation. f. Approximately 20 acres of the Anoakia area are presently undeveloped, containing much vegetation and many trees, except for the Anoakia Mansion, accessory buildings, a school, and recreational facili- ties. The remaining 10 acres of the Anoakia area consist of ten de- veloped single family residences immediately contiguous to the north and northwest of the undeveloped 20 acres/ on lots averaging 30,000 square feet and greater, and six single family dwellings in its south- west corner, ranging from 14,000 to 36,000 square feet in area as shown on the Lot Map, attached hereto as Exhibit "A" and by this reference incorporated herein. q. The Anoakia area is totally surrounded by developed single family residences, separated by Baldwin Avenue from those on the east known as the Santa Anita Oaks and zoned R-O 15,000 averaging 21,000 square feet and those on the south by Foothill Boulevard zoned R-1 10,000 and ranging from 10,000 to 15,000 square feet. h. In February 1976 the City Council received a petition from 314 homeowners generally surrounding the Anoakia area requesting R-O 30,000 zoning for the Anoakia area, which request was consistent with its general plan designation. i. Twenty-tour lots and homes could be developed on the unde- veloped portion of subject area if R-O 30,000 zoning is adopted. J. Streets existing in the undeveloped portion of subject area - 3 - 1590 are substandard. k. There is a need and a market for homes built on R-O 30,000 square foot lots in the City of Arcadia. R-O 30/000 zonin~ of subject area will be consistent with, and preserve the values of other R-O 30,000 zoned existing homes in the Upper Rancho area of which the Anoakia area is a part. 1. That R-O 30,000 zoning is the highest and best use of the Anoakia area consistent with present zoning classifications. rn. That R-O 30,000 zoning will provide uniform zoning within the Anoakia area and Upper Rancho area; it will bring the zoning into conformance with the General Plan for the Anoakia area; the public convenience, necessity and qeneral welfare Justify the above zone change; and it will provide economic and social advantages resulting from an orderly planned use of land resources. SECTION 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Arcadia hereby de- clares that it would have adopted this ordinance and each section, sub- sectlon, sentence, clause, phrase or portion thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 4. Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the - 4 - 1590 prosecution for violation of ordinances, which viblations were com- mitted prior to the effective date hereof, nor be construed as affec- ting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pur- suant to any ordinance and all rights and obligations thereunder apper- taining shall continue in full force and effect. SECTION 5.
