HomeMy WebLinkAbout1599 ORDINANCE NO. 1599 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA AMENDING WATER RATES BY AMENDING SECTIONS 7531.1.1 AND 7531.2 OF THE ARCADIA MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS FOLLOWS: SECTION 1. Section 7531.1.1 of the Arcadia Municipal Code is hereby amended to read as follows: "7531.1.1. SAME. SAME. RATES. The following rates are established for the provision, delivery and consumption of water during any bimonthly period. Minimum Bimonthly Cubic Feet Entitlement Size of Meter Service Charge Under the Minimum Charge 5/8" $ 3.00 600 3/4" 4.00 600 1" 5.50 600 1-1/2" 10.00 600 2" 16.00 600 3" 32.00 600 4" 50.00 600 6" 100.00 600 8" 160.00 600 All water consumption over the minimum entitlement is charged at the rate of thirty cents (30~) per full one hundred (100) cubic feet re- gistered on the consumer's meter." SECTION 2. Section 7531.2 of the Arcadia Municipal Code is hereby amended to read as follows: "7531.2. OUTSIDE CITY. BIMONTHLY. The bimonthly rates for metered services and for all other purposes for which no other rate is specified for water put to or made available for beneficial use outside the City and served or to be served through a meter, shall be as follows: -1- 1599 size of Meter Minimum Bimonthly Serv~ce Charge Cubic Feet Entitlement Under the Minimum Charge 5/8" 3/4" $ 4.50 6.00 8.25 15.00 24.00 48.00 75.00 l50.00 240.00 600 600 600 600 600 600 600 600 600 1" 1-1/2" 2" 3" 4" 6" 8" All water consumption over the minimum entitlement is to be charged at the rate of forty-five cents (45i) per full one hundred (lOO) cubic feet registered on the consumer's meter." SECTION 3. The City Council of the City of Arcadia hereby finds and determines that this ordinance is required for the purpose of fixing the rate of taxation for water usage and for the purpose of providing a tax levy for the usual current expenses of the City of Arcadia. SECTION 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the re- maining portions of this ordinance. The City Council of the City of Arcadia hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 5. Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were com- mitted prior to the effective date hereof, nor be construed as -2- 1599 affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. the passage and adoption of same to be published in the Arcadia within fifteen (15) this of the Council shall certify to ordinance and shall cause the SECTION 6.
