ORDINANCE NO. 1527
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ARCADIA AMENDING THE BUSINESS
LICENSE ORDINANCE TO PERMIT PARKING LOT
SALES AND PROMOTIONAL ENTERTAINMENT
EVENTS AND PROVIDING CONDITIONS THEREFOR.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN
AS FOLLOWS:
SECTION 1. Sections 6323.26.5 and 6324.12.8 are hereby
added to Article VI, Chapter 3, Part 2 of the Arcadia Municipal
Code to read as follows:
"6323.26.5. PROMOTIONAL ENTERTAINMENT EVENTS -- PARKING
LOTS. "
"6324.12.8. PARKING LOT SALES."
SECTION 2. Division 5 is hereby added to Article VI,
Chapter 4, Part 1 of the Arcadia Municipal Code to read as follows:
"ARTICLE VI.
CHAPTER 4.
PART 1.
DIVISION 5.
BUSINESSES, PROFESSIONS, TRADES AND
OCCUPATIONS
SPECIAL REGULATIONS
ENTERTAINMENT ENTERPRISES
PROMOTIONAL ENTERTAINMENT EVENTS
PARKING LOTS
6415. PERMIT REQUIRED. No person shall conduct or
participate in any promotional entertainment event in a parking lot
area unless a permit has been obtained pursuant to Chapter 3 of
this Article and is in effect for such promotional entertainment
event.
6415.1. PERMIT FACTORS. Before granting a permit to
conduct a promotional entertainment event in a parking lot area,
the Business Permit and License Review Board shall evaluate the

prevailing parking situation of the business involved and of the
general area and satisfy itself that the conduct of the event will
not be detrimental to public safety and welfare. The Board may
establish any conditions to the issuance of a permit, in addition
to the conditions set forth below, which are deemed reasonably
necessary to protect the public health, safety and welfare.
6415.2. ZONING. Promotional entertainment events in
parking lot areas may only be permitted in any C-l zone or less
restrictive zone.
6415.3. HOURS AND NUMBER OF EVENTS. No event shall
run for more than nine (9) days and shall be held between the
hours of 9:00 a.m. and ll:OO p.m. only. No business shall sponsor
more than four (4) such promotional entertainment events per
year. By way of limitation and without expanding the foregoing,
where parking is ,shared by two (2) or more businesses there shall
be no more than a combined total of eight (8) parking lot events,
including promotional entertainment and/or sales, per year.
6415.4. DISTANCE TO RESIDENTIAL PROPERTY. No such event
nor any equipment or apparatus related thereto shall be placed
or maintained within one hundred feet (100') of any residentially
zoned property.
6415.5. AREA LIMITATION. Twenty-five percent (25%)
of the required parking ar~a or twenty-five percent (25%) of the
existing parking area if less than the prescribed number of spaces
are provided may be utilized for the promotion in addition to the
driveway area adjacent thereto, provided that ingress and egress
to and from all other parking spaces is maintained. If parking

provided exceeds Code requirements, those additional spaces may
be utilized.
6415.6. SIGNS. Temporary window signs shall comply
with Code requirements. Any additional signs shall be permitted
only during the conduct of the event and shall be approved as to
size and placement by the Business Permit and License Review Board
at the time of application approvaL"
SECTION 3. Division 9 is hereby added to Article VI,
Chapter 4, Part 3 of the Arcadia Municipal Code to read as follows:

PART 3. COMMERCIAL ENTERPRISES
DIVISION 9. PARKING LOT SALES
6439.1. PERMIT REQUIRED. No person shall conduct or
participate in any parking lot sale unless a permit has 'been
obtained pursuant to Chapter 3 of this Article and is in effect
for such parking lot sale.
6439.2. PERMIT FACTORS. Before granting a permit to
conduct a parking lot sale, the Business Permit and License Review
Board shall evaluate the prevailing parking situation of the busi-
ness involved and of the general area and satisfy itself that the
conduct of the event will not be detrimental to public safety and
welfare. The Board may establish any conditions to the issuance
of a permit, in addition to the conditions set forth below, which
are deemed reasonably necessary to protest the public health,
safety and welfare.
6439.3. ZONING. Parking lot sales may only be permitted
in any C-l zone or less restrictive zone. Participating businesses

must be a use permitted in the zone in which such business is
located.
6439.4. NUMBER OF PARKING LOT SALES. No business shall
participate in more than two (2) parking lot sales per year. By
way of limitation and without expanding the foregoing, where park-
ing is shared by two (2l or more businesses, there shall be no
more than a combined total of eight (8) parking lot events, includ-
ing promotional entertainment and/or sales, per year.
6439.5. HOURS. No sale may run for more than two (2)
days and shall be held between the hours of 9:00 a.m. and 9:00 p.m.
only.
6439.6. LIMITATION OF MERCHANDISE OFFERED FOR SALE.
Only goodS, wares or merchandise of the type normally sold on the
premises may be offered for sale.
6439.7. DISTANCE TO RESIDENTIAL PROPERTY. No merchandise
or signs shall be placed or maintained within fifty feet (50') of
any residentially zoned property.
6439.8. AREA LIMITATION. A maximum of twenty-five
percent (25%) of the parking spaces may be utilized for the sale
in addition to the driveway area adjacent thereto, provided that
ingress and egress to and from all other parking spaces is main-
tained. If a business has parking in excess of the required
number, twenty-five percent (25%) of the required parking spaces
plus any additional spaces may be utilized. In no event shall
any parking lot sale held in a parking area, whether by a single
business or combination of businesses, exceed 5,400 square feet.
6439.9. SIGNS. Temporary window signs shall comply

with Code requirements. Any additional signs shall be permitted
only during the conduct of the event and shall be approved as to
size and placement by the Business Permit and License Review Board
at the time of application approval."
SECTION 4. The city Clerk shall certify to the adoption
of this ordinance.

adopted at a regular meeting of the City Council of the City of
Arcadia held on the
