ItS 26 27 28 29 30 31 32 ORDINANCE NO. 154. ;to /.5'-1- AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE CITY OF AR_ CADIA RELATING TO FIRE PROTECTION AND PREVENTICN. THE BOARD OF TRUSTEES OF THE CITY OF ARCADIA DO ORDAIN AS FOLLO\7S: ISECTION 1: That it shall be unlawful for any person, fir or corporation to cause or permit any combustible rubbish belonging to or under the control of such person, firm or corporation, to accumulate or remain within thirty (30) feet of any building within the City of Arcadia for a period longer than forty_eight (48) hours> , SECTIon 2: That it shall be unlawful for any person, firm or corporation to cause or permit to be kept within said City of Arcadia, any oily waste or oily rags belonging to or under the control of such person, firm or corporation, unless at all times when not actually in use, such waste or rags shall be kept in a metal container with a self closing cover and riveted joints and supported by metal legs high enough to remove the bottom of such container at least five (5) inches from the floor or suffaoe upon which it stands. SECTION 3: That it shall be unlawful for any person, fir or corporation to set fire to, ignite or burn any material in the open air within twenty_five (25) feet from any building or and within said City of Arcadia or without continuousAcompetent super_ vision. SECTION 4: That it shall be unlawful for any person, fir or corporation to operate, conduct or maintain any public garage or paint shop where paint or oils are mixed or handled in bulk un_ less a permit therefor shall have been issued by the Chief of the Fire Department of s&id City. That it shall be the duty of the Chief of said Fire Department to receive applications hereunder an to make an investigation and after such investigation to determine whether or not the desired business may be conducted upon the pre_ mises for which application is made, ili thout endangering the publi safety or creating a fire hazard. In the even that after the issuance of any such permitconditions shall change so far that the further exercise thereof is a source of public dan_ ,/ ger or fire hazard, or if the holder of such permit shall violate any of the provisions of this or any other Ordinance of said City of Arcadia, designed to prevent fires, the permit thereof may be revoked by said Chief of the Fire Department. SECTION 5: That it shall be unlawful for any person, othe than members of the Fire Department or Police Department of said City of Arcadia, to drive or park any vehicle within 500 feet of the location of any fire to which the Fire Department has been sum_ moned, provided however, that all persons shall have reasonable op_ portunity to drive out of the area affected thereby, and uhile so driving out shall not be deemed to be in violation hereof. There is also excepted from the operation hereof any ambulance or person entering the area affected hereby for the purpose of saving life or property or preventing or relieving injury to persons. SECTION 6: That it shall be unlawful for any person, firm or corporation to store or handle quantities of oils, paints or other inflammable substances, without a valid ,permit therefor is_ sued by the Chief of said Fire Department. It shall be the duty of said Chief to receive and act upon applications hereunder. In the event that the premises described in such application shall be foun and determined to be such that the desired business may be conducte thereon rrithout danger to the public or creating a fire hazard, the permit applied for shall be issued, otherwise same shall be refused' SECTION 7: A private garage is one in which there shall be housed or kept not ~mre than three self_propelled vehicles or automobiles. (A) Gasoline in excess of five (5) gallons, exclusive of that in the tanks of such vehicles, shall not be kept uithin any priv~te garage. That quantity or less shall be kept only in five (5) gallon can approved by said Chief and any quantity in excess of five (5) gallone shall be kept only in a tank placed not less than three (3) feet beneath the ourface of the Bround and approved by said Chief. (B) No private garage shall be erected or used 'as such nea.rer than fifteen (15) feet to any church or public buildine in eaid City of Arcadia unless such carage be constructed of brick, concrete or other non_combustible material, and if constructed of 7 such brick, stone or other non_combustible material, same may be erected or used if not nearer than ten (10) feet to any such chu"vh or public building. SECTION 8: That it shall be the duty of the Chief of said Fire Department to enforce this Ordinance and such Chief or any employee of his department is hereby authorized to enter and in_ spect all buildings in said City of Arcadia and it shall be unlau_ ful for any person, firm or corporation to refuse to any authorized member of such Fire Department access to any building, room or place uhen such access is demanded at a reasonable time for the purpose of enforcing this Ordinance or any Ordinances of said City of Arcadia relating to fire protection or prevention, or for the purp~se of determin'ng uhether or not the requirements of any such Ordinances are being violated. SECTION 9: Th~t any person, firm or corporation violat_ in~ any of the provisions of this Ordina,nce shall be deemed Cuilty of a m:sdeme~nor and u~on conviction thereof, shall be punishable by a fine not exceeding 0300.00 or by imprisonment in the City Jeil of sc,id Oi ty of Arcadia for c, period not exceeding three Ulontho or by both such fine and imprisonment.
