AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE CITY OF ARCADIA, CALLI~ A SPEOIAIl MUNICIPAL ELECTION TO BE HELD IN SAID CITY OF ARCADU ON TUESDAY, DECEMBER 7, 192&, AND SUBMITTING TO THE Q.UALI- FIED VOTERS OF SAID CITY A CERTAIN PROPOSITION OOR THE ISSUANCE Am> S!LE OF BONDS OF SAID CITY OF ARCADIA IN THE AMOUNTS AND OOR THE Pl1RPOSES IN SAID ORDINANCE STATED, AND APPOINTING THE OFFICERS OF SAID ELECTION AND FIXING THEIR COMPENSATION AND DESIGNATING THE PRECINCTS FOR .AND THE POLLING PLACES FOR HOLDING SAID ELECTION. WHEREAS the Board of Trustees of the City of Aroadia, at a regular meeting of said Board, held on the 3rd day of November, 1920, by a vote of two-thirds of all its members, duly passed and adopted a Resolution deolaring that the publio interest and neoessity demand the aoquisition, oonstruotion, extension and oom- ~ / pletion by said City of Aroadia, of a oertain revenue produoing munioipal improvement, to-wit: Water works for developing, supplying ani distributing water for domestio, irrigation and other purposes to said City of Aroadia, and to,the inhabitants thereof, inoluding the aoquisition, oonstruo- tion, extension and oompletion of the munioipal water system now owned and operated by said Oi ty of Aroadia, by aoquiring land by pur<<hase and otherwise, for developing water, by laying new pipe lines, putting down wells, oonstruoting pumps, reservoirs, pump houses, booster pumps, tanks, water mains, oonduits, laterals and other maohinery and apparatus neoessary for said work and improve- ment, inoluding the aoquisition of water rights, easements and rights of way in oonneotion with said water system and that the estimated oost thereof is $183,750.00. WHEREAS said Resolution was approved by the President of the Board of Trustees of said City of Aroadia on said 3rd day of November 192&, and WHEREAS the estimated oost of said revenue produo;ing munioi- pal improvement is $183,750.00, and suoh oost is and will be too great to be paid out of the ordinary annual inoome and revenue of said City, NOW THEREFORE the Board of Trustees of said City of Aroadia do ordain as follows: (1) {J.A.d!t-na'-n<!..e...I. ~. I?,-:> SECTION 1: That a speoial munioipal eleotion be and the same is hereby oalled to be held in said City of Aroadia on Tuesday, Deoember 7, 1926, for the purpose of submitting thereat to the qualified voters of said City the proposition of inourring on the part of said City of Aroadia, of a bonded indebtedness for the several purposes set forth in said Resolution and hereinafter stated. SECTION 2: That said proposition to be voted on at said eleotion so to be held as aforesaid, is as follows, to-wit: The issuing of bonds of the City of Aroadia, in the sum of $183,760.00, in aooordanca with the provisions of an aot of the Legislature of the State of California, entitled "An Aot authorizing the inourring of indebtedness by oities, towns and munioipal oorporations for munioipal improvements and regulating the aoquisition, oonstruction or oompletion thereof", beooming a Law February 26, 1901, and 811 Aots amendatory thereof and supple- mentary thereto, and with the General Inoorporation Aots of the State of California for Cities of the S1xth'Clas~, for the purpose of the aoquisition, oonstruotion and oompletion and extension by said City of Aroadia of a oertain revenue produoing munioipal improvement, to-wit: The aoquisition, oonstruction, extension and oompletion of the munioipal water system now owned and operated by said City of Aroadia, by aoquiring land by purohase and otherwise, for developing water, bylaying new pipe lines, putting down wells, oonstructing pumps, reservoirs, pump houses, booster pumps, tanks, water mains, oonduits, laterals and other maohinery and apparatus neoessary for said work and improvement, inoluding the aoquisition of water rights, easements and rights of way in oonneotion with said water system, and that the estimated oost thereof is $183,760.00. That if the propOSition of inourring the indebted- ness for said purposes so submitted at suoh eleotion reoeives the requisite number of votes, to-wit: two-thirds of the votes of the qualified voters of said City voting at said eleotion, bonds of said City of Aroadia in said sum of $183,760.00 shall be issued and sold for the purpose of aoquiring, oonstruoting, extending and oompleting said revenue-produoing munioipal improvement. ~ (2)" I, I cJAd~fflc.&/1-O~ iN Said bonds shall bear interest at a rate not exoeeding five (5) per oent per annum. p~able semi-annually. and the prinoipal and interest thereof shall be p~able in lawful money of the United States of Amerioa. SECTION 3: That for the purpose of p~ing the prinoipal and interest of suoh bonds. the Board of Trustees of the City of Aroadia shall at the time of fixing the general tax levy and in the manner for suoh general tax levy provided. levy and oolleot annually eaoh year until there shall be a sum in the Treasury of said City set apart for that purpose to meet all sums ooming due for prinoipal and interest on suoh bonds. a tax suffioient to p~ the annual interest on suoh bonds and also suoh part of the prinoipal thereof as shall beoome due before the t1me for fixing the next general tax levy; provided however. that if the maturity of the indebtedness oreated by the aforesaid issue of bonds be made to begin more than one year after the date of the issuanoe of suoh bonds. then the tax for the purpose of p~ing the prinoipal and interest of the bonds. the maturity of whioh is so deferred, shall be levied and oolleoted at the t 1me and in the manner afore- said, annually eaoh year suffioient to pay the interest of suoh indebtedness as it falls due. and also to oonstitute a sinking fund for the payment of the prinoipal thereof on or before maturity. Said tax shall be in addition to all other taxes levied for munioi- pal purposes and shall be oolleoted at the same time and in the same manner as other munioipal taxes are oolleoted. and be used for no other purpose than the payment of said bonds and aooru.tng interest. SECTION 4: That the ballots to be used at said eleotion shall oontain the follOWing proposition to be voted for by the qualified voters of said, City of Aroadia at suoh eleotion so oalled and to be held on Tuesday. the 7th d~ of Deoember 1926, to-wit: "Shall bonds of the City of Aroadia in the sum of $183.750.00, be issued for the aoquisition. oonstruotion, extension and oompletion of the munioipal water system now owned and operated by said Ci~y of Aroadia. by aoquiring land py purohase and otherwise. for developing , water, by laying new pipe lines. putting down wells. oonstruoting pumps, reservoirs, pump houses, booster pumps. tanks. water mains. Opposite said proposition and to the right thereof on said ballot the words nyes" and ~o" shall be printed on separate lines, with voting squares, and said ballot shall be so printed , as to give eaoh voter a olear opportunity to designate by stamping a oross (X) in the blank enolosed spaoe on the right of and after eaoh of said words "Yes" and "No" his Wish or ohoioe upon said proposition, and said ballot shall be printed substantially in the following form: No. . . . . . . . . . . . . . INSTRUCTION TO VOTERS. To vote for the proposition stamp a oross (X) in the voting square to the right of and apposite the word nyes". To vote against the proposition stamp a oross (X) in the voting square to the right of and opposite the word "No". "ALL MARKS EXCEPT THE CROSS (X) ARE FORBIDDEN." "ALL DISTINGUISHING MARKS OR ERASURES ARE FORBIDDEN AND MAKE THE BALLOT VO ID" . If you "WRONGFULLY STAMP, TEAR OR DEFACE THIS BALLOT" return it to the Inspeotor of Eleotion and obtain another. SEcnlilN 5: That for the purpose of said special munioipal eleotimn, the whole of said City of Aro~dia, whioh was last established and divided into six eleotion preoinots, designated by the Board of Supervisors of the County of Los Angeles, State of California, for holding General Eleotions, as Aroadia Preoinots Nos. 1,2,3,4,5 and 6 respeotively, shall be oonsolidated into two (2) election preo1Dots, desoribed as follows, to-wit: Aroadia Preoinot No. 1 shall oomprise and inolude all that terri- tory in said City whioh lies north and east of a line drawn as follows, to-wit: beginning at a point in the oenter of Huntington Drive at its interseotion with the westerly boundary line of said Ci ty of Arcadia, thenoe running eaater:l.y along the oenter of said Huntington Drive to the oenter of Santa Anita Avenue; thenoe south along the oenter of said Santa Anita Avenue to the oenter of Duarte Road: thenoe easterly along the center of said Duarte Road to the oenter of First Avenue: thence south along the oenter of said First Avenue to the center of Valnett Avenue: thence easterly along the oenter of said Valnett Avenue to the oenter of Seoond Avenue: thenoe south along the oenter of said Seoond Avenue to the southern boundary line of said City of Aroadia, on Azusa Road. PRECINCT NO. 2 shall oomprise all of that territory on said City of Aroadia whioh lies south and west of said line Just hereinbeforedesoribed. Said Preoinot No.1 shall be known and is hereby designated as Consolidated Preoinot No. 1 of the City of Aroadia, and said Preoinot No. 2 shall be known and is her.by designated as Consolidated Preoinot No. 2 of the City of Aroadia, for the purpose of said speoial munioipal eleotion. The polling plaoe of said Consolidated Preoinot No.1, shall be at the City Hall situate on the northwest oorner of First Avenue and Huntington Drive in said City of Aroadia, and the follow- ing qualified voters of said City of Aroadia, are hereby appointed ,(5) ) '. , OAot-'Y/..~..t", N~. J. f"v) the offioers at said special eleotion, for said Consolidated ~ecinot No., 1, to-wit: Graoe Newhall, Inspector: Samuel J. Wilson, Judge: Burch A. Baldwin" Clerk and Graoe D., Strauser, Clerk. The polling place of said Consolidated Preoinot No.2 ,shall be at 120D South Baldwin Avenue, in said City of Arcadia, and the following qualified voters of said City of Arcadia, are hereby appointe~ the offioers at said Special Election for said Consolidated Preoinot NO.2, to-wit: G~EVeri~t_Canda~, Inspeotor; Cornelius M. Roberts, Judge; Samuel ~. Alden, Clerk: and Graoe D. Ransburg, Clerk. That the oompensation to be paid to eaoh of said offioers of eleotion for all servioes by eaoh of said offioers to be rendered at said Speoial Munioipal Eleotion shall be and the same is hereby fixed at the sum of($6.00) Six Dollars. SECTION 6: That the polls for said eleotion shall be opened at the hour of six 0 'olook in the morning of the day of said eleotion and shall be kept open until seven o'olook in the evening of the same day, when the polls shall be olosed, exoept as provided in Section 1164 of the Poli.ioal Code of the State of California. SECTION 7: That said special munioipal eleotion shall be held in every manner, other than herein speoifioally set forth, wholly in acoordanoe with the eleotion laws of the State of California, insofaras said eleotion laws are applioable to munioipal eleotions in Cities of the Sixth Class. SECTION 8: This Ord inanoe is urge ntly required for the immediate prewervation of the public health, peaoe and safety, as the fUture welfare, oonvenienoe and necessity of the inhabitants of said City of Aroadia require an extension, addition to and enlargement of the present water system now owned and operated by said City of Aroadia, in order to supply said inhabitants with an adequate supply of water for domestio, irrigation and other purposes, and suoh supply of water ,is immediately required and oan only be aoquired by the issuanoe and sale of said bonds. (6 ) l ~-f/"b~4'>"''''' #~, J.f?'/J J SECTION 9: The City Clerk shall oertify to the adoption of this Ordinanoe and shall o~use the same to be published onoe a week for two suooessive weeks in the Aroadia News, a weekly newspaper, published, printed and oircrulated in said 'City of Aroadia, and hereby designated for that purpose, and thereupon and thereafter the same shall take effeot and be in foroe. No other notioe of said eleotion need be given than that above provided for. The foregoing Ordinanoe was adopted at a Regular Meeting of the Board of Trustees of the City of Aroadia, held on the 24th d,*" of November, 1926, by the .affi rmative vote of at least four Trustees, to-wit: AYES: Trustees: Hawk, Multer, SOhermerhorn, E.
