AN ORDINANCE OF THE BOARD OF TRUSTEES OF THECITY OF AR-
CADIA PROVIDING SPECIFICATIONS FOR STREET WORK: REGULATING THE
WIDTH OF STREETS, ALLEYS AND PARKWAYS AND ALSO REGULATING THE IN-
STALLATION OF WATER AND GAS MAINS IN NEW SUBDIVISIONS IN SAID CITY
OF ARCADIA: REPE.~LING ORDINANCE NO. 158 OF SAID CITY OF ARCADIA
AND ALL OTHER ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THERE- I

SECTION 1: That the public interest and convenienoe re- I
quire and necessity demands that all new Subdivisions hereafter I
I

laid out in sa.id City of Arcadia shall conform to the following:
(a) All Streets must be not less than sixty (60) feet in i
width and not less than thirty (30) feet between curbs, except
I
when in the judgment of said Board of Trustees, the topography of I
I
the land embraced in the new Subdivision makes 'such width of Street
, ,
impracticable, in which event the width of such Street and the
distance between curbs thereon may be determined in each instance
by said Board of Trustees.

(b) All Streets must be graded to the Official Grade
wherever such Official, Grade has been established, otherwise to
undsr the direction of said Board of Trustees. All such Streets
shall be improved with concrete curbs and with an oil macadam pave~
ment or other pavement similar in quality, as may be determined by:

said Board of Trustees and such pavement shall be not less than I

four inches in thickness and shall extend from curb to curb. All
I
such pavement shall be constructed in accordance with specificatioiB
therefor, duly adopted and approved by said Board of Trustees and I

on file in the office of the Street Superintendent of said City
of Arcadia.
(c) No Street or Alley in said new Subdivision shall be
improved with a concrete curb or with said oil macadam pavement
or other pavement similar in quality, unless same shall be con-
structed under the direction and to the satisfaction of the streetl

1 Superintendent of said City of Arcadia. No water main shall be

installed or laid in any Street or 'Alley in any such new Subdivi-

aion unlese same shall be installed or laid under the direction and
I
I
Arcadia. The cost of employing necessary Inspectors or otherwise f
providing for the proper inspection of any of the foregoing improve
ments shall be Wholly paid by the proprietors, owners or sellers
to the satisfaction of the Water Superintendent of eaid'City of

of such Subdivision.
(t) All parkways on any Street sixty feet or more in
width shall not exceed fifteen (15) feet in width nor be less than
ten (1') feet in width on either side of any such street and may be
proportionately reduced for a Street of any less width.
(e) The proprietors, owners or sellars of any such Sub-
division shall install all water mains of such size, as in the
opinion of said Board of Trustees, will be required to properly
service the lands embraced in said Subdivision. The work of in-

stalling said water mains shall be done under the direction and
to the satisfaction of said Water Superintendent, provided that all
water mains so installed shall be of cast iron pipe, Grade B, or

equivalent in quality thereto, for all sizes ten inches or under
and ten gauge, riveted steel wrapped pipe or pipe equivalent in
quality for all sizes in excess of ten inches. The entire ,cost of
installing such water mains shall be borne by the proprietors, own-
ers or sellers of such Subdivision.
(f) The proprietors, owners or sellers of any such Sub-
division shall inetall all gas mains and service connections from
said @Qs mains to the outside of the curb line of each and every
Lot shown in said Subdivision, same to be of such size and char-
acter as shall in the opinion of the operating Gas Company, be
necessary to serve said Lots.
(g) Before any Street situate within any new Subdivision
is paved from curb to curb, all water and gas connections must be

1 installed to the outside of the curb lines of such Street so as to
2 connect each separate Lot or parcel of land shown upon the Map of
3 said Subdivision, except where such gas and water connections are
4 installed in and from an Alley. The cqst of installing said water
5 and gas connections shall be paid by the propr~etors, owners or
6 sellers of such Subdivision.
7 (h) \Vhenever any water mains and service connections are
a required to be installed in any new Subdivision as provided in thiS!
9 Ordinance, the proprietors, owners or sellers of any such Subdi-
10 vision shall file a written application with the Water Superinten-
11 dent of said City of Arcadia for the installation of such water

mains and service connections, whereupon said Water Superintendent
shall submit to such proprietor, owner or seller a written estimatel
of the cost of same; said proprietor, owner or seller of such Sub-
division shall thereupon deposit with the City Clerk of said City
of Arcadia the amount shown by such estimate and upon such deposit
being so made, said Water Superintendent shall proceed with the
work of installing said water mains and service connections or'
cause same to be installed, and upon the completion of the install-

at ion of same, said City shall refund to said proprietor, owner orf I
seller of such Subdivision any such portion of said deposit as shal
ezoeed the actual cost of installing said water mains and service I
connections, or in the event the cost thereof shall exceed the
amount of such deposit, said proprietor, owner or seller of such
Subdivision shall, upon demand, repay to

liability of said City of Arcadia to so charge and collect for any
such water service, shall wholly cease from and after a period of
ten years, and said City shall not be responsible or liable to any
of
such proprietor, owner or sel1er~ uuch Subdivision in the event of

6 the failure or neglect of any person, firm or corporation to pay
6 said usual and established charge on applying for water service
7 from said City of Arcadia.
8 (i) Whenever a water connection is requested on any
9 Street Which is paved from curb to curb and same requires the tear
10 ing up and replacing of any portion of such pavement, the person,
11 firm or corporation requiring such connection shall pay to said
12 City of Arcadia the sum of $5.00 per square yard for same in addi-
13 tion to the established charge for such water connection.

SECTION 2: If the proprietor~,owners or sellers of said
Subdivision shall request said Board of Trustees to accept and ap-
prove the Map or Plat thereof prior to the actual completion of
any of the work hereinabove specified, then said Board of Trustees
may accept and approve said Map or Plat if such proprietors, own-
ers or sellers shall execute a good and sufficient Surety Company'
bond to said City of Arcadia for the benefit and security of the
,
purchaser or purchasers of Lots in such subdivision, in an amount
which shall equal the estimated cost, of the work hereinabove de-
scribed and conditioned that all of the work required hereunder
in said Subdivision shall be completed within such time as shall
be designated by a Resolution duly adopted by said Board of Trus-
tees at any regular meeting thereof and conditioned further that
such work shall be done in accordance with the provisions of this
Ordinance' and any Specifications of the City of Arcadia relating
thereto and on file in the office of said Street Superintendent.
If said owners, proprietors or sellers shall neglect or fail for
any reason to perform SUCh work,1maid Subdivision wi thin the time
designated by said Board, as hereinabove' specified, said bond

shall be declared forfeited and the amount received or collected
thereon shall be used by said City for the improvement of said
Subdivision as herein required, and the surplue, if any, shall be
returned to the owners, proprietors or sellers who executed and
filed said bond, provided however, that if said Map or plat shall
be accepted and approved by said Board of Trustees prior to the
actual performance of such work, said proprietors, owners or sel-
lers shall include in each and every deed to the purchaser or pur-
chasers of any Lot or parcel of land within said Subdivision, a
stipulation or clause to the effect that all of the work required
tobe done hereunder shall be performed in accordance with the pro-
: visio~sof this Ordinance and any Ordinance amendatory thereof.
SEOTION 4: That 9rdinance No. 158 of said City of Ar-

15 of Arcadia providing specifications for street work; regulating
16 the width of streets, alleys and parkways and also regulating the
17 installation of water mains in new subdivisions in said City",
18 I adopted August 5, 1925, be and the same is hereby repealed.
SECTION 5: The City Clerk shall certify to the adoption

of this Ordinance and shall cause the same to be published once in
The Arcadia News, a weekly newspaper published and circulated in
said City of Arcadia and thirty days from and after the final
passage thereof, the same shall take effect and be in force.
The fore~ Ordinance was adopted at a regular meeting
of the Boaxd,.~uststees of the Oity of Arcadia, held on the 2nd.
day of March, 1927, by the affirmative vote of at least three Trus
tees, to-wit:
