ORDINANCE NO. 1485
AN ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF ARCADIA AMENDING THE S-l
SPECIAL USE ZONE REGULATIONS TO PERMIT
HORSE RACING DURING DAYTIME HOURS
MONDAYS THROUGH SATURDAYS ONLY.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES ORDAIN AS
FOLLOWS:
SECTION 1. Section 9273.1, subdivision 10 of Title 1,
Division 3, Part 7, Chapter 2, Article IX of the Arcadia Municipal
Code is hereby amended to read as follows:
"ARTICLE IX.
CHAPTER 2
PART 7.
DIVISION 3.
TITLE 1.
DIVISION AND USE OF LAND
ZONING REGULATIONS
OVERLAY AND SPECIAL ZONES
S-l SPECIAL USE ZONE
USES PERMITTED
9273.1. USES PERMITTED. No building or land shall be
used and no building shall be hereafter erected, constructed or
established, except for the uses specified in the following
subsections.

9273.1.10. SAME. Daytime horse racing Mondays through
Saturdays with or without parimutuel wage~ing on the results
thereof."
SECTION 2. This ordinance is justified by the public
necessity, convenience, general welfare and good zoning practice.
SECTION 3. This is an emergency ordinance necessary for
the preservation of the public peace, health and safety and shall
go into effect upon its adoption. The facts constituting such
necessity are:
While the City of Arcadia is a charter city under the
Constitution of the State of California and the City Council has
power under its charter to enact zoning regulations, a bill is
pending in the State Assembly which purports generally to restrict

the power of cities to enact zoning regulations which affect
horse racing. To avoid confusion and unnecessary litigation, it
is necessary that this ordinance take effect immediately to
expressly provide that horse racing shall take place in the City
of Arcadia' on Mondays through Saturdays, only, and not on Sundays.
Arcadia is a residential city and is known as a Community of Homes.
These homes and residential streets surround the track and are
adversely affected by traffic and parking congestion and fumes
from the vehicles of Santa Anita Race Track patrons during the
racing season. This situation is most serious on Saturday when
crowds are very large. Extension of this situation to Sunday,
the one day of the weekend when community and home life can be
enjoyed by residents of Arcadia during the racing season, would
adversely affect the health, welfare and safety of the residents
and produce an adverse environmental impact on the community.
SECTION 4. The City Clerk shall certify to the adoption
of this ordinance.
I HEREBY CERTIFY that the foregoing ordinance was
adopted at a regular meeting of the City Council of the City of
Arcadia held on the 5th day of June~ 1973, by the affirmative vote
of at least three Councilmen, to wit:
