HomeMy WebLinkAbout2093 ORDINANCE NO. 2093 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ADDING SECTION 9275.1.52.4 TO THE CONDITIONAL USE PERMIT SECTION OF THE ARCADIA MUNICIPAL CODE RELATING TO ALLOWING OFFICE USES IN THE M-1 ZONE WHEN ADJACENT TO RESIDENTIALLY ZONED PROPERTY (TA 98-003). WHEREAS, on July 28, 1998, McMahon Development Group, LLC filed an application to amend Secti(;ln 9266.1.4 of the M-1 (Planned Industrial District) zone to allow governmental offices in the M-1, Community Development Division Case No. T.A. 98-003. WHEREAS, a public hearing was held on September 8, 1998 before the Planning Commission at which time all interested persons were given full opportunity to be heard and to present evidence, and WHEREAS, the Planning Commission of the City of Arcadia recommended approval of this text amendment with the suggested change that office uses be allowed in the M-1 or any less restrictive industrial zone when said lot is adjacent to residentially zoned property and only subject to the conditional use permit process. WHEREAS, a public hearing was held before the City Council on October 20, 1998, at which time all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, the City Council hereby finds that under certain conditions, office uses may provide an appropriate buffer between residential property and industrial property because generally office uses are less intrusive than industrial uses and most office uses do not operate during the late evening hours. In addition office traffic is usually less intense than traffic associated with industrial uses. Because of the limited amount of property zoned industrial within the City, office uses in the industrial zones should be restricted to areas where they provide a transition from residential to industrial and allowed only with an approved conditional use permit. T A1ord2093 Page 1 2093 WHEREAS, the City Council determines that based upon the evidence presented, the public necessity, convenience and general welfare justifies the proposed text change. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That Section 9275.1.52.4 is added to the Conditional Use Permit Division of the Arcadia Municipal Code to read as follows: 9275.1.52.4. OFFICE USES. Office uses shall be allowed in the M-1 or any less restrictive industrial zone when said lot(s) is adjacent to residentially zoned property. Parking requirements shall comply with the parking standards set forth in Division 9 of this Chapter. Section 2. The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the official newspaper of said City within fifteen (15) days after its adoption.
