AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA ADDING AN H6 (HIGH RISE OVERLAY)
TO THE C-2 ZONED PROPERTY LOCATED AT 55 WEST
HUNTINGTON DRIVE
WHEREAS, this zone change was initiated by the City in May of 1998 to add an
H8 overlay (high rise allowing up to 8 stories, 85'-0" hEtJht limit) on the property located
at 55 West Huntington Drive, commonly known as the Foulger Ford site. On July 21,
1998, the City Council held a public hearong on this zone change to consider adding
the H8 overlay and at that time expressed concern regarding the impact on adjoining
residential properties and the appropriateness of an eight-story overlay on this site.
The City Council felt an H8 overlay was too intense and directed staff to refer this zone
change back to the Planning Commission for consideration of an H4 overlay and to
expand the public hearing notification to include all property owners within a 600-foot
radius.
WHEREAS, a public hearing was held on August 25, 1998, before the Planning
Commission at which time all interested persons were given full opportunity to be heard
and to present evidence, and
WHEREAS, the Planning Commission of the City of Arcadia considered an H4
overlay (high rise allowing four stories, 45'-0") onthe property and based upon evidence
presented recommended approval of an H6 overlay (high rise allowing six stories, 65'-
0) on the front 200 of the property extending back from Huntington Drive; and
WHEREAS, the City Council conducted a public hearing concerning the zone
change on November 17,1998, and approved an H6 overlay on the entire site.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. FINDINGS. The City Council finds and determines that the proposed
H6 overlay (high rise allowing 6 stories, 65'-0") on te entire property is consistent with
the goals set forth in ARA Resolution 172 and provides more flexibility for potential
development of the site. TheCouncil further noted that any high rise development on

the site would be subject to the Conditional Use Permit process and Agency design
approval. It was the consensus of the City Council that adding the high rise overlay at
this time is proactive and provides a definitive statement to potential buyers of the
maximum development that may be acceptable on the site. The CUP process and
design approval allows the City the opportunity to address any potential environmental
impacts as well as impacts on residential properties to the west that may be related to
any high rise development of the site. The H6 designation is consistent with the
General Plan designation of commercial, and the public health, safety, general welfare
and good zoning practice justify the proposed zone change.
Section 2. Based on the above findings, the H6 overlay (high rise allowing 6
stories, 65 feet) is applicable to subject property. The zoning Map referred to by
Section 9233.7 of the Arcadia Municipal Code is hereby amended to reclassify and
designate the described property as C-2 H6. All other applicable maps and
designations for such property shall reflect the C-2H6 designation for subject property.
Section 3. The City Clerk shall certify to the adoption of this Ordinance and shall
cause a copy of the same to be published in the official newspaper of said City within
fifteen (15) days after its adoption.
