ORDINANCE NO. 2061
AN ORDINANCE OF THE CITY COUNCIL OF THE CiTY OF
ARCADIA, CALIFORNIA, AMENDING SECTIONS 8540.4 AND
8540.6(c) OF THE BUILDING AND SAFETY CODE RELATING TO
THE DEFINITION OF SWIMMING POOL AND SWIMMING POOL
BARRIERS (TEXT AMENDMENT 96-004)
WHEREAS, Text Amendment 96-004 was initiated by the City proposing revisions to the
definition of swimming pool and including barrier requirements for indoor swimming pools, Text
Amendment 96-004.
WHEREAS, a public hearing was held before the City Council on November 19, 1996, at
which time all interested persons were given full opportunity to be heard and to present evidence;
and
WHEREAS, the City Council hereby finds that the proposed text changes appropriately
address safety issues relating to the interpretation of the definition of swimming pools and barrier
requirements for indoor swimming pools.
WHEREAS, the City Council determines that based upon the evidence presented, the
public necessity, convenience and general welfare justifies the proposed text changes.
NOW, THEREFORE, THE CITY COUNCIL OF THE CiTY OF ARCADIA DOES
HEREBY ORDAIN AS FOLLOWS:
Section I. That Section 8540.4 of the Arcadia Municipal Code be amended to read as
follows:
8540.4, AMENDMENT.
The definition of "Swimming Pool" in Section 102 of Chapter I of said Uniform
S\vimming Pool Code is hereby amended to read as follows:

Swimming pool is any structure that is capable of, or permits the containment of water
eighteen (18) inches or more in depth. This includes in-ground, above-ground, on-ground
swimming pools, hot tubs, spas or any open container or artificial body of water permanently or
temporarily constructed or maintained upon any property, whether designed, intended or used
exclusively or principally for swimming or not.
Exception: Bathroom fixtures with overflows.
Section 2. That Section 8540,6(c) of the Arcadia Municipal Code be amended to read as
follows:
(c) Indoor Swimming Pool. Indoor swimming pools shall be provided with barrier(s)
which shall comply with the following:
1. Exterior doors providing direct access to an indoor swimming pool shall comply with
(b)8 of this Section.
2, Interior doors, windows or other accessible openings which provide direct access to an
indoor swimming pool shall comply with anyone of the sub-items (I), (2), (3) or (4) of (b) 10 of
this Section.
Section 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause a
copy of the same to be published in the official newspaper of said City within fifteen (15) days
after its adoption.
