HomeMy WebLinkAbout2062 ORDINANCE NO. 2062 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTIONS 6220,19, 6325,7 AND 6437.1.2 OF THE BUSINESS LICENSE SECTION OF THE ARCADIA MUNICIPAL CODE RELATING TO BOUTIQUES AND CRAFT SHOWS (TEXT AMENDMENT 96-003) WHEREAS, Text Amendment 96-003 was initiated by the City proposing changes to the Business License Section of the Arcadia Municipal Code relating to boutique and craft shows, Text Amendment 96-003. WHEREAS, a public hearing was held before the City Council on November 19, 1996, at \ which time all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, the City Council hereby finds that the proposed text amendment will allow more flexibility for persons wishing to have boutiques and craft shows in non-residential areas such as churches, schools and places of assembly; and WHEREAS, the City Council determines that based upon the evidence presented, the public necessity, convenience and general welfare justifies the proposed text changes. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAiN AS FOLLOWS: Section 1. That Section 6220.19 of the Arcadia Municipal Code be amended to read as follows: "6220,19, BOUTIQUES AND CRAFT SHOWS. For every boutique sale and craft show held from a residential location in accordance with the regulations in 6437,1.2 and 6437.2, the fee shall be $8.50 per day with a limit of $51.00 per -J- 2062 year. Sales from a church, school, place of assembly or commercial location shall charge a fee of $8.50 per day with a limit of $76.50 per year." Section 2, That Section "6325.7 BOUTIQUES AND CRAFT SHOWS" be added to "Miscellaneous Permits", Section 3. That Section 6437.1.2 be added to read as follows: "6437.1.2, BOUTIQUES AND CRAFT SHOWS. Boutiques and craft shows held on residential property shall have a central cashier. Hand crafted items, crafts and merchandise of a new nature shall be the property of the participants of the event. (a) An application specifYing relevant information as to the dates, time, place and a general description of the items to be sold shall be on file at the office of the Business License Officer and a written permit issued for the sale. There shall be no more than two (2) sales per calendar year at a given location. Each sale shall be for not more than three (3) consecutive days. Exception: Boutiques and craft shows in churches, schools and places of assembly located in residential zones shall be conducted no more than four (4) times per calendar year at a given location and shall be for not more than three (3) consecutive days. (b) Boutiques and craft shows meeting the requirements of this section but held from a commercial location shall be limited to three (3) consecutive days, four (4) times per year," (c) Regulations 6437,2 subsections (c) through (g) shall apply to boutiques and craft shows with proper permits and in complete compliance with all other conditions of the Division, Section 4.
