ORDINANCE NO. 2030
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, AMENDING SECTION 6439 SUB-
SECTION (7) (B) OF THE ARCADIA MUNICIPAL CODE BY
AMENDING (B) AND ADDING SUB-SECTIONS (1) THROUGH
(3) REGARDING REMOVAL OF NEWS RACKS EFFECTED BY
PUBLIC PROPERTY PROJECTS
WHEREAS, news racks currently exist on public property of the
city of Arcadia pursuant to requirements of the Arcadia Municipal
Code including the attainment of a permit; and
WHEREAS, news racks have been and are subject to the primary
use of public property for various purposes as determined through
the exercise of discretion by the city; and
WHEREAS, news rack permittees have always used public property
in a manner that is subject to and subservient to the needs of the
public, and the use of public property as deemed appropriate by the
applicable public agencies; and
WHEREAS, to the extent feasible, the city seeks to perpetuate
the proper use and placement of newsracks consistent with city
goals and legal requirements; and
WHEREAS, this Ordinance is to supplement existing Code
provisions and is consistent with current practice.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY FIND, DETERMINE AND ORDAIN AS FOLLOWS:
SECTION 1. That Section 6439 (7) (b) of the Arcadia Municipal
Code is hereby amended by amending (7) (b) and adding sub-sections
(1) through (3) to read as follows:

(b) Interfere with any governmental use of the sidewalk. This
includes but is not limited to City and/or Arcadia Redevelopment
Agency projects, public works construction and improvement,
reconstruction, rehabilitation, reconfiguration and any other
related proj ects or actions by the City/Arcadia Redevelopment
Agency, their contractors, employees, or authorized agents.
(1) The above section (b) shall apply to all existing
newsracks and news rack locations. No newsrack shall be maintained
in violation of this requirement.
(2) To the extent feasible, all news rack permittees
subject to the above shall be given at least thirty (30) days
written notice to remove their newsracks.
(3) To the extent feasible, and pursuant to regulations
of the City, news racks removed pursuant to the above, shall be
permitted to return to the effected location, if possible, and
consistent with all requirements of the Arcadia Municipal Code.
SECTION 2. That all other sub-sections of section 6439 shall
remain in full force and effect.
SECTION 3. The City Clerk shall certify to the adoption of
this Ordinance and shall cause a copy of same to be published in
the official newspaper of said City within fifteen (15) days after
its adoption.
