HomeMy WebLinkAbout2037 ORDINANCE NO. 2037 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTION 9273.1.10.1 OF THE ARCADIA MUNICIPAL CODE CHANGING THE HOURS FOR SATELLITE WAGERING (TEXT AMENDMENT 95-001) WHEREAS, Text Amendment 95-001 was filed by the Los Angeles Turf Club, Inc. requesting a text change to amend Section 9273.1.10.1 of the Arcadia Municipal Code to allow horse racing via satellite feed at night until no later than 1:30 a.m. with or without pari-mutuel wagering. WHEREAS, a public hearing was held on February 28, 1995, before the Planning Commission at which time all interested persons were given full oppor- tunity to be heard and to present evidence, and WHEREAS, the Planning Commission of the City of Arcadia recommended approval of the text amendment to the City Council with specific conditions of approval relating to the time and number of days they could operate during the year until 1:30 a.m. and prohibiting the consumption and sale of alcoholic beverages after a certain time. WHEREAS, notices of the public hearings before both the Planning Commission and the City Council were sent to approximately 930 property owners within a 1,000 foot radius of the proposed race track; and WHEREAS, a public hearing was held before the City Council on March 21, 1995, at which time all interested persons were given full opportunity to be heard and to present evidence; and -1- 2037 WHEREAS, the City Council based upon the information submitted by the Development Services Department and the Police Department and the testimony presented at the public hearing, noted the following: (1) that nighttime satellite wagering is conducted inside the building and in the Seabiscuit court area; (2) that the races are not announced over the loud speaker; (3) that the infield area is closed for satellite wagering; (4) that based upon information from the Police Department traffic resulting from nighttime satellite wagering has been insignificant and has not resulted in an impact on adjoining neighborhoods; (5) that the requested amendment to extend the hours for satellite wagering will not create an impact on or a need for additional public services; and (6) recognizes that the extended hours will allow Santa Anita Park the flexibility to respond to industry movement in importing evening racing from outside California. WHEREAS, the Santa Anita Race Track currently is allowed satellite wagering with or without pari-mutuel wagering one night a week until 11:30 p.m. WHEREAS, the City Council determines that based upon the evidence presented, the public necessity, convenience, general welfare and good zoning practice justifies the proposed text amendment. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That Section 9273.1.10.1 of the Arcadia Municipal Code be amended to read as follows: -2- 2037 "9273.1.10.1. SAME. SAME. Horse racing via satellite feed on Friday and Saturday Nights only until no later than 1:30 a.m., with or without pari-mutuel wagering on the results thereof." Section 2. The City Council also recommends that a status report regarding the nighttime racing activities be submitted to the Planning Commission and the City Council for review six (6) months after commencement of the extended hours. Section 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the official newspaper of said City within fifteen (15) days after its adoption.
