HomeMy WebLinkAbout2005 ORDINANCE NO. 2005 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING SECTIONS 9250.3.15., 9251.2.10.,9252.2.13., AND 9292.1.4., OF THE ARCADIA MUNICIPAL CODE TO PERMIT THE MODIFICATION COMMITIEE TO CONSIDER MODIFICATION REQUESTS FOR CONVERTING EXISTING ATTIC SPACE INTO SECOND-STORY LIVING SPACE WITHIN SINGLE- FAMILY RESIDENCES IN THE R-M, R-Q AND R-1 ZONES. WHEREAS, text amendment T.A. 94-001 was initiated by the City of Arcadia for the consideration of allowing the Modification Committee to consider rnodification requests for converting existing attic space into second-story living space within a rnain dwelling, provided that such requests do not involve any exterior alterations within the required setback area. WHEREAS, a public hearing was held on March 22,1994, before the Planning Cornmission, at which time all interested persons were given full opportunity to be heard, and to present evidence, and WHEREAS, the Planning Cornrnission of the City of Arcadia recommended approval of the text amendrnent as set forth in the Planning Division report to the City Council, and WHEREAS, the City Council conducted a public hearing concerning the text amendrnent on May 3,1994 and approved the text arnendment. WHEREAS, the City Council determines that having the Modification Cornrnittee consider rnodification requests for proposed attic conversions would be a rnore cost effective hearing process for the applicants. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That Sections 9250.3.15.,9251.2.10., and 9252.2.13., be amended to read as follows: 9250.3.15., 9251.2.10., and 9252.2.13. MODIFICATION FOR SIDE YARD SETBACKS. Any first or second story side yard setback modification request for a new dwelling or any second story side yard setback rnodification request to an existing dwelling shall be subject to the approval of the Planning Cornrnission or the City Council (upon appeal) pursuant to the modification regulations. Exception: Modification requests for converting existing attic space into -1- 2005 second-story living space within the main dwelling may be considered by the Modification Committee, provided that such requests do not involve any exterior alterations within the required setback area. Section 2. That the following shall be added to Section 9292.1.4., to read as follows: 21. Conversions of existing attic areas within main dwellings in the R-M, R-O and R-1 zones, provided that such requests do not involve any exterior alterations within the required setback area. Section 3. The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the official newspaper of the City of Arcadia within fifteen (15) days after its adoption.
