HomeMy WebLinkAbout2015 ORDINANCE NO. 2015 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING, DELETING AND ADDING VARIOUS SECTIONS TO THE UNIFORM FIRE CODE AND THE UNIFORM BUILDING CODE AS ADOPTED BY THE ARCADIA MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND ORDAIN AS FOLLOWS: SECTION 1. That the following Arcadia Municipal Code sections are hereby amended to read as follows: 3115.1. AMENDMENT. section 14.104(b) of Article 14, is hereby amended to read as follows: Group B Occupancies: All per U.B.C. requirements. 3115.2.A. ADDITION. section 10.204(a) of Chapter 10 of said Uniform Fire Code is added to read as follows: Dimensions. Fire apparatus access roads shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. 1. When hydrants are required, fire apparatus access roads shall have an unobstructed width of not less than 26 feet within a linear distance of 25 feet each side of the hydrant. 3115.2.1.1. AMENDMENT. Subsection (b) of said section 10.507 of said Fire Code is hereby amended to read as follows: (b) An automatic sprinkler system shall be installed in all occupancies as set forth herein. 1 1. In every story or basement of all buildings when the floor area exceeds 1,500 square feet and there is not provided at least 20 square feet of opening entirely above the adjoining ground level in each 50 lineal feet or fraction thereof of exterior wall in the story or basement on at least one side of the building. Openings shall have a minimum dimension of not less than 30 inches. Such openings shall be accessible to the fire department from the exterior and shall not be obstructed in a manner that fire fighting or rescue cannot be accomplished from the exterior. When openings in a story are provided on only one side and the opposite wall of such story is more than 75 feet from such openings, the story shall be provided with an approved automatic sprinkler system, or openings as specified above shall be provided on at least two sides of an exterior wall of the story. If any portion of a basement is located more than 75 feet from openings required in this section, the basement shall be provided with an approved automatic sprinkler system; 2. At the top of rubbish and linen chutes and in their terminal rooms. Chutes extending though three or more floors shall have additional sprinkler heads installed within such chutes at al ternative floors. Sprinkler heads shall be accessible for servicing. 3. In rooms where nitrate film is stored or handled; 4. In protected combustible fiber storage vaults as defined in this code; 2 2015 5. In all buildings that exceed 5,000 square feet in total area, regardless of type of construction. Note: Total area of building is determined by measurement of the buildings exterior walls. 6. In all convalescent and board and care facilities, regardless of type of construction. said fire sprinkler system shall comply with 1991 NFPA 13 Standard local amendments, as determined by the Fire Department. 7. In all buildings more than two (2) stories in height, regardless of occupancy or type of construction. Determination of number of stories shall be made from the grade at the Fire Department access. 8. In all buildings in the M-I and M-2 zones, regardless of occupancy or type of construction. 3115.2.1.3. AMENDMENT. section 10.507(h) of Article 10 of said Fire Code is hereby amended to read as follows: section 10.507. FIRE SPRINKLERS WHERE REQUIRED; (h) Group R, Division I Occupancies. 1. An automatic fire sprinkler system shall be installed in all mUltiple family dwellings, regardless of type of construction. said fire sprinklers systems shall comply with 1991 NFPA 13, 13D, or 13R Standards and local amendments, as determined by the Fire Chief. 3 2015 (a) Any multiple family complex, greater than two (2) units, not separated by twenty (20) feet of clear space between structures, shall be protected by NFPA 13 or 13R system, as determined by the Fire Department. (b) Installations requiring NFPA 13R systems shall conform to the NFPA 13R Standard with the following exceptions: A minimum of 2 1/2 inch approved double detector check backflow prevention device with 0 S & Y valves (not ball operated valves) is required. Water supply may be less than 2 1/2 inch. (c) NFPA 13R, section 2-4.2 is amended to read: At least one 2 1/2 inch National Standard Thread, Fire Department Connection shall be installed facinq the street. (d) NFPA 13R, section 2-6, Exception 4 is amended to read: Attics containing forced air units shall have installed one or more 212 degree sprinkler heads adjacent to the forced air unit. Sprinklers may be omitted from penthouse equipment rooms, crawl spaces, floor/ceiling spaces, elevator shafts, and other concealed spaces that are not used or intended for living purposes or are not accessible for storage. (e) Fire Department Connections shall be located within ten (10) feet of the curb and shall be mounted no lower than 24 inches or no higher than 36 inches from finished grade. (f) Garages shall have installed quick response, 200 or 212 degree heads (not residential quick response heads). An eight (8) inch lintel/soffit shall be installed in any garage ceiling with greater than four (4) heads. There shall be no more than four 4 2015 (4) heads in the soffit area. 3115.2.1.4. AMENDMENT. That the following is hereby added to section 10.507(i) of said Fire Code to read as follows: REQUIREMENTS FOR INSTALLATION 1. All fire sprinkler systems shall be installed by California State Licensed C-16 contractors. 2. A complete set of working drawings and hydraulic calculations shall be submitted to the Arcadia Building and Safety Division. Working drawings and calculations shall conform to NFPA 13, section 6-1. 3. Plans must be submitted AND approved prior to the installation of the fire sprinkler system. 4. An approved set of plans shall be maintained on the job site at all times. 5. The flow switch shall be connected to horn and strobe device, located directly outside of sleeping area. 6. Flow switch and smoke detectors shall be interconnected to a visual and audible alarm. MAINTENANCE The owner is responsible for the maintenance and repair of the sprinkler system at all times. The sprinkler contractor shall provide the owner with a copy of NFPA 13 or appropriate NFPA Standard at the time of final inspection. All NFPA l3D Systems shall be certified by a state licensed fire protection company every five (5) years from the date of installation. 5 2015 3115.2.1.5. AMENDMENT. That section 10.507(j) of said Code is hereby amended to read as follows: (j) Retrofit 1. For additions to any existing building 5,000 square feet or larger in total area, such buildings shall meet the requirement for a new building. 2. Any building 5,000 square feet or larger in total area that meets anyone of the following, will be required to install an automatic fire sprinkler system within twelve (12) months from the date permits are filed: a. Any building that has a change in occupancy classification that is more hazardous. b. Any building vacant for more than 180 days. 3. For additions to existing Group R, Division 1 occupancies that result in additional guest rooms or dwelling units, such building shall meet the automatic fire sprinkler system requirements for new construction throughout the building. 4. Existing single family dwellings shall meet the fire sprinkler requirements for a new building when any of the following occurs: a. The building is enlarged by fifty (50%) percent or more due to addition or add-on. b. Fifty (50%) percent or more of the existing roof structure is removed to add an additional story. c. Fifty (50%) percent or more of the existing building is affected by interior remodel, repair, or rebuild. 6 2015 d. A combination of remodel, rebuild, or repair with additions or add-ons is equal to or greater than fifty (50%) percent of the original building. e. A second story, with sleeping rooms, is added to the existing structure. This policy will include existing code requirements for buildings over 5,000 square feet and existing R-1 Occupancies. section 10.508. SPRINKLER SYSTEM ALARMS. When serving more than twenty (20) sprinkler heads, automatic sprinkler systems shall be supervised by an approved U.L. certified central station service, per NFPA 72, for all occupancies except R-3. Exception: R-l and R-3 occupancies with sprinkler systems with less than 100 heads. 3115.2.6. AMENDMENT. Section 78.103(c) is hereby added to Article 78 of said Fire Code to read as follows: PUBLIC DISPLAY. APPROVAL BY FIRE CHIEF. Supervised public displays of fireworks or pyrotechnic displays by a jurisdiction, fair, association, amusement park, other organizations, or for the use of fireworks by artisans, in pursuit of their trade, may be permitted, subject to the following requirements. a. The approval, by the Fire Chief, of a permit for public display. b. No permit shall be issued until the Fire Chief receives documentation regarding the competence of the operator of the fireworks, insurance, location of display, and other factors 7 2015 pertinent to the proposed display concerning the safety to persons and property and proposed conditions to the permit required by the Fire Code, or otherwise deemed necessary by the Fire Chief. c. Permits for public display may be subject to regulations and conditions approved by the Fire Chief as part of any action on the permit, and the applicant shall be required to adhere to all such conditions. d. The Fire Chief may, in the exercise of his discretion, deny any application, pursuant to the City's concern to protect health, safety, and welfare. e. That the City Council shall have the right to appeal any decision of the Fire Chief. SECTION 2. That a subsection (g) is hereby added to Section 3133.4 to read as follows: (g) If after sufficient notice, compliance cannot be obtained, the City will have the property cleared and a lien will be levied against said property. For purposes of this section, thirty (30) days shall be considered sufficient time for compliance. SECTION :3. That a new section 3134 is hereby added and sections 3134 and 3134.1 are hereby renumbered to 3134.1 and 3134.2 to read as follows: 3134. BUILDING CONSTRUCTION GENERAL. Buildings or structures, hereafter erected or constructed in Fire Zone 4, shall have exterior construction equal to or greater than a one (1) hour fire resistive rating. 8 2015 3134.1. SPARK ARRESTERS. EQUIPMENT. 3134.2. ENFORCEMENT. SECTION 4. That Section 8130.13 of Chapter 16 of the Uniform Building Code are hereby amended to read as follows: section 1601. GENERAL. Buildings or structures, including additions and remodeling, hereinafter erected, constructed, moved within or into the hazardous fire areas as established by resolution of the City council, shall comply with the following requirements of this section: (a) ROOFS. Roof coverings shall be as specified in Chapter 32, section 3203(a) and Appendix Chapter 32, section 3209 of the Uniform Building Code. (b) EXTERIOR WALLS. Exterior walls of all buildings or structures shall have a fire-resistive rating of not less than one- hour. All glazed openings including but not limited to windows, skylights, doors, greenhouses, atriums or sunrooms shall be dual- pane and meet California State Title-24 Energy U-Values when required. EXCEPTION: 1. Except where otherwise required by this Code, exterior walls need not have a fire-resistive rating when any of the following conditions exist: a. Exterior walls that front on a public way having a width of not less than 40 feet. b. The building or structure is of Type 1 or II construction. 9 2015 2. Glazed openings when consisting of assemblies of leaded, faceted or carved glass when used for decorative purposes. (c) PROJECTIONS. Eave overhangs, exterior balconies, decks and similar architectural appendages extending beyond the floor area as defined in the Uniform Building Code, section 407, shall be of one-hour fire-resistive construction. Underfloor areas not provided with a continuous surrounding exterior wall shall be of one-hour fire-resistive construction. EXCEPTION: 1. Except where otherwise required by this Code, projections need not have a fire-resistive rating when any of the following conditions exist: a. Projections that front on a public way having a width of not less than 40 feet. b. projections of Type I or II construction. (d) VENTILATION. Where determined necessary by the enforcement agency, enclosed attics and enclosed rafter spaces formed where ceilings are applied directly to the underside of roof rafters shall have cross ventilation for each separate space by ventilating openings protected against the entrance of rain. The net free ventilating area shall not be less than 1/150 of the area of the space ventilated and shall be installed in one of the following methods. a. By dormer vents placed in the lower 1/3 of the roof rafter span length. 10 2015 b. By dormer vents which are half of the required area placed in the lower 1/3 of the roof rafter span length and the remaining half of the required area placed in the upper 2/3 of the roof rafter span length. c. By a combination of a or b above and gable vents placed in gable end walls. EXCEPTION: Except where otherwise required by this Code, eave vents may be installed on building eaves which front on a public way having a width of not less than 40 feet. All vented openings shall be covered with corrosion-resistant metal mesh with mesh openings of 1/4 inch in dimension. SECTION 5. That section 8130.18 is hereby amended to read as follows: 8130.18. AMENDMENT. Roof Covering Requirements. section 3203 of Chapter 32 of the Uniform Building Code is amended to read as follows: section 3203 (a) . GENERAL. Class A fire-resistive roof coverings as specified in section 3204(a) on all structures in the hazardous fire areas, regardless of occupancy group or construction type. Class A or B fire-resistive roof coverings as specified in section 3204(a) or (b), shall be used on all structures in the non- hazardous fire areas, regardless of occupancy group or construction type. 11 2015 EXCEPTION. Ordinary roof coverings may be used in the non- hazardous fire areas on Group M, Division 1 occupancies not exceeding 120 square feet in floor area and 7 feet in height at its highest point. (b) STRUCTURAL ADDITIONS: (i) Roofs of existing structures or buildings shall be entirely covered with Class A roof covering as specified in section 3204(a) when any cumulative combination of additions, alterations, replacements, repairs or reroofs to the existing roof is made which exceeds 25% of the original roof area during the lifetime of the building or structure. (c) STRUCTURAL ADDITIONS IN NON-HAZARDOUS FIRE AREAS: (i) 25% or Less - Roofs for structure or building additions which together with those installed for additions during the previous 12 month period do not cumulatively exceed 25% of the area of the roof as it existed at the beginning of said 12 month period, and any alterations, replacements or repairs to the existing roof, required because of the addition, which do not together exceed 25% of the area of the existing roof, may be made with material like the material on the existing roof if said material was legal when installed and if not legal when installed, then said covering as specified in section 3204(a) or (b). (ii) Over 25%-Less than 50% - Roofs for structure or building additions which together with those installed for additions during the previous 12 month period do cumulatively exceed 25% but are cumulatively less than 50% of the area of said roof as it existed 12 2015 at the beginning of said 12 month period, and any alterations, replacements or repairs to the existing roof required because of the addition shall be Class A or B fire-resistive roof covering as specified in section 3204(a) or (b). (iii) 50% or More - Roofs for structure or building additions which together with those installed for additions during the previous 12 month period are cumulatively 50% or more of the area of said roof as it existed at the beginning of said 12 month period, and any alterations, replacements or repairs to the existing roof required because of the addition shall be Class A or B fire-resistive roof covering as specified in section 3204(a) or (b), and if said required alterations, replacements or repairs together exceed 50% of the area of the existing roof, then the entire roof shall be replaced with the fire-resistive roof covering. SECTION 6. That section 8130.30 of the Arcadia Municipal Code is hereby amended to read as follows: section 8130.30. AMENDMENT. section 3209 of Chapter 32 of the Appendix of said Uniform Building Code is amended to read as follows: section 3209(a). GENERAL - All reroofing shall be Class A fire-resistive roof coverings as specified in section 3204(a) on all structures in the hazardous fire areas, regardless of occupancy group or construction type. 13 2015 All reroofing shall be Class A or B fire-resistive roof coverings as specified in section 3204(a) or (b), on all structures in the non-hazardous fire areas, regardless of occupancy or construction type. EXCEPTION: Ordinary roof coverings may be used in the non- hazardous fire areas on Group M, Division 1 occupancies not exceeding 120 square feet in floor area and 7 feet in height at its highest point. (b) REROOFS IN HAZARDOUS FIRE AREAS: (i) Reroofs of existing structures or buildings shall be entirely covered with Class A roof covering as specified in section 3204(a) when any cumulative combination of additions, alterations, replacements, repairs or reroofs to the existing roof is made which exceeds 25% of the original roof area during the lifetime of the building or structure. (c) REROOFS IN NON-HAZARDOUS FIRE AREAS: (i) 25% or Less Reroofs for structure or building additions which together with those installed for reroofs or additions during the previous 12 month period do not cumulatively exceed 25% of the area of the roof as it existed at the beginning of said 12 month period, and any alterations, replacements or repairs to the existing roof, required because of the reroof or addition, which do not together exceed 25% of the area of the existing roof, may be made with material like the material on the existing roof if said material was legal when installed and if not legal when installed, then said covering as specified in Section 14 2015 3204(a) or (b). (ii) Over 25%-Less than 50% Reroofs for structure or building additions which together with those installed for reroofs or additions during the previous 12 month period do cumulatively exceed 25% but are cumulatively less than 50% of the area of said roof as it existed at the beginning of said 12 month period, and any alterations, replacements or repairs or reroofs to the existing roof shall be Class A or B fire-resistive roof covering as specified in section 3204(a) or (b). (iii) 50% or more Reroofs for structure or building additions which together with those installed for reroofs or additions during the previous 12 month period are cumulatively 50% or more of the area of said roof as it existed at the beginning of said 12 month period, and any alterations, replacements or repairs or reroofs to the existing roof shall be Class A or B fire- resistive roof covering as specified in section 3204(a) or (b), and if said alterations, replacements, repairs or reroofs together exceed 50% of the area of the existing roof, then the entire roof shall be replaced with the fire-resistive roof covering. SECTION 7. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of same to be published in the official newspaper of said City within fifteen (15) days after its adoption. 15 2015 Passed, approved and adopted this 16th day of August 1994. lP't!'~~#.
