HomeMy WebLinkAbout2020 ORDINANCE NO. 2020 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING THE EXCEPTION CLAUSE TO SECTIONS 9251.2.12., AND 9252.2.21., OF THE ARCADIA MUNICIPAL CODE TO PROffiBIT HOUSES FROM HAVING MORE THAN A SINGLE-STORY DIRECTLY ABOVE ANY PROPOSED BELOW GRADE OR SUBTERRANEAN GARAGE IN THE R-O AND R-1 SINGLE-FAMILY RESIDENTIAL ZONES. WHEREAS, text amendment T.A. 94-003 was initiated by the City of Arcadia for the consideration of amending the parking regulations in the R-O and R-l zones to prohibit houses from having more than a single-story directly above any below grade or subterranean garage. WHEREAS, a public hearing was held on July 12, 1994, before the Planning Commission, at which time all interested persons were given full opportunity to be heard, and to present evidence, and WHEREAS, the Planning Commission of the City of Arcadia recommended approval of the text amendment as set forth in the Planning Division report to the City Council, and WHEREAS, the City Council conducted a public hearing concerning the text amendment on August 2,1994 and approved the text amendment. WHEREAS, the City Council determines that having more than one story directly above any below grade or subterranean garage is not appropriate in the R-O and R-l zones because of the impact on adjoining properties relating to the appearance and height of nonconforming three-story facades. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY ORDAIN AS FOLLOWS: Section 1. That the exception clause to Sections 9251.2.12., and 9252.2.21., be amended to read as follows: -1- 9251.2.12., and 9252.2.21. PARKING SPACE. EXCEPTION: The Planning Commission or the City Council (upon appeal) pursuant to the Modification regulations may grant a modification to allow below grade or subterranean parking space (s). This exception is subject to the condition that not more than one story shall be permitted directly above said parking with its height not exceeding the applicable regulation when measured from the finished floor level of the garage. Section 2. The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the official newspaper of the City of Arcadia within fifteen (15) days after its adoption.
