" 0 17 " HffE~LED 18 GIlD. 1I0/, ......"""" 19 20 21 22 23 24 25 26 27 28 29 30 31 32 I' II 1\ I 1 Ii 2 ' , !yo,d;2/0 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AR- CADIA REGULATING THE DISTRIBUTION OF ADVERTISING SAlWLES, HANDBILL , DODGERS, CIRCUL!RS, BOOKLETS AND OTHER NOTICES OF ADVERTISEMENT UPON THE STREETS OR PROPERTY OF THE RESIDENTS OF THE CITY OF AR- CADIA AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- FLICT THEREWITH. THE CITY COUNCIL OF THE CITY OF ARCADIA DO ORDAIN AS 3 .. 5 FOLLO\1S: 6 : 7 I I 81 I' 9 . SECTION 1: That it shall be unlawful for any person, firm or corporation to distribute within said City of Arcadia any advertising sample, handbill, dodger, circular, booklet or other notice of comercial advertising without first having obtained a permit in writing from the City Council of said City so to do, 'I"'. as hereinafter provided. SECTION 2: Any person, firm or corporation desiring to obtain a permit to distribute in the City of Arcadia any ad- vertising sample, handbill, dodger, circular, booklet or other notice of commercial advertising shall file an application in ~ ~--'__~o:........":~~. writing therefor with said City Council, giving the name and ad- ----~. dress of the applicant, a general description of the advertising samples, handbills, dodgers, circulars, bookeets or other notices of commercial advertising pr~posed to be distributed, and an agree r._. ment to distribute such matter in accordance with the provisions of this Ordinance and in accordance w+th the directions of the Ch~~f~f Police of said City of Arcadia. Any person, firm or corporation desiring to obtain such permit shall obtain a license therefor and pay said City of Arcadia the license fee provided for by any Ordinance or Ordinance of said City of Arcadia providing for licenses. SECTION 4: It shall be unlawful for any person, firm or corporation to distribute or throw upon any street, alley, or public place, or upon any private yard, lawn, driveway or side- walk of any residence, or upon any vacant property in said Oity of Arcadia, any advertising sample, handbill, dodger, circular, booklet or other notice of commercial advertising, provided that nothing in this Section shall prohibit the distribution and de- livery of any regularly issued newspaper or ma.ga~lne into the yard or upon the p~rches of residences within said Oity. SEOTION 5: Any person, firm or corporation that has obtained a permit from said Oity Oouncil so to do, and has paid ~'-, the license fee hereinbefore provided for, may distribute adver- _ __-..r-"___~,. ~ . - .".. tising samples, handbills, dodgers, circulars or other notices of , commsrcial advertising in said City of Arcadia by placing the same on the porches of any residence in said Oity of Arcadia in a re- ceptacle or device placed on such porch for that purpose, other than mail boxes, if any such receptacle or device there be; if none be provided, then in such a manner as such advertising sam- I pIes, handbills, dodgers, circulars, or other notices of commercia advertising will not be blown from such porch onto the lawns, Yards, streets, alleys or publio places in said City of Arcadia' , and provided further, that said Olief of Police of said City of Arcadia may direct the manner of placing such advertising samples, handbills, dodgers, circulars or other notices of commercial ad- vertising. ....PEA Lf~ .:~, -2- O~~ffi~ ~/tJ // -----~' SECTION 6: If the owner, oooupant or person in charge of any residenoe, court, apartment, hotel or other premises shall forbid the distribution of advertising samples, handbills, dodgers, oirculars, booklets or other notioes of oommeroial advertising on the premises owned or oooupied by him, or of whioh he is in charge, either by so advising the holder of any permit issued under the provisions of this Ordinanee or any of his or its ag.ents or em- ployees, or by posting and maintaining a sign on suoh premises reading "No Handbills" or words of similar import , it shall be unlawful for the holder of any such permit, his or its agents or employees, to distribute advertising samples, handbills, dodgers, ciroulars, booklets or other notioes of oommeroial advertising, on suoh premises and the violation of the provisions of this Section by the permitee, his or its agents or employees, shall be grounds for therevooation of any permit issued under this Ordinanoe. SECTION 7: The City Council of said City of Arcadia may at any time revoke the permit of any person, firm or corpora- tion issued under this Ordinance for a violation thereof for fail- ure to comply with the demand, request or notice of owner, occu- pant or person in charge of premises that no such advertising mat- ter be distributed on suoh premises or for failure to Obey reason- able direotions given by said Chief of Polioe as to the manner of distributing such advertising matter. SECTION 8: Any person, firm or corporation violating any of the provisions of this Ordinanoe shall be deemed guilty of a misdemeanor and upon oonviction thereof, shall be punished by a fine not exceeding the sum of $300.00 or by imprisonment in the 'City Jail of said City of Arcadia or in the County Jail of the County of Los Angeles, State of California, for a period not ex- oeeding three months or by both such fine and imprisonment. SECTION 9: All Ordinanoes or parts of Ordinances in oonflict with the provisions of this Ordinance are hereby repealed. The foregoing Ordinance was adopted at a regular meet- ing of the City Council of the City of Arcadia held on the 21st. day of March, 1928, by the affirmative vote of at least four Coun- cilmen, to-wit: AYES: Councilmen: Granville, Hawk, Holt, Multer and Schermerhorn, NOES: None, and signed and approved this 21st. day of March, 1928.
