MINUTES ARCADIA CITY PLANNING COMMISSION REGULAR MEETING Tuesday, January 23, 1990 The Planning Commission of the City of Arcadia met in regular session on Tuesday, January 23, 1990 at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Larry Papay presiding. PLEDGE OF ALLEGIANCE ROLL CALL: PRESENT: Commissioners Amato, Hedlund, Szany, Papay ABSENT: Commissioner Clark MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Amato to excuse Commissioner Clark from tonight's meeting. The motion passed by voice vote with none dissenting. MINUTES MOTION It was moved by Commissioner Szany, seconded by Commissioner Amato to approve the Minutes of January 9, 1990 as published. The motion passed by voice vote with none dissenting. MOTION It was moved by Commissioner Szany, seconded by Commissioner Amato to read all resolutions by title only and waive reading the full body of the resolution. The motion passed by voice vote with none dissenting. OTHERS ATTENDING: Councilman Charles Gilb City Attorney Michael Miller Planning Director William Woolard Senior Planner Donna Butler Associate Planner Corkran Nicholson Secretary Silva Vergel The City Attorney announced that the City Charter requires that for any action to be adopted or approved a majority of the entire membership must vote in favor of the particular motion. If the required three votes are not obtained the motion would fail. If the required three votes are not obtained (1) an applicant may request continuance and it is up to the Commission to decide whether or not they want to grant it; (2) the matter could be heard and then deferred for final decision pending participation of the absent Arcadia City Planning Commission 1/23/90 Page 1 members as long as they review the records of these proceedings which would be made available to them or (3) the matter could simply go forward to the City Council. CONTINUED PUBLIC HEARING TPM 90 -001 325 E. Duarte Rd. Robert & Rose Nese Consideration of a tentative parcel map for a 3 -unit residential condominium project. The staff report was presented and the public hearing was opened. Brad Ducich, 1026 S. Eighth, said that they were in agreement with all of the conditions in the staff report. Timothy Still, 329 E. Duarte, #E, said that he was representing all of the owners in his complex. He expressed concerns over some construction methods used in the development and stated that demoliton of the building was started without a building permit, the water was not disconnected, the front wall was leaning against a tree in the front yard at a steep angle, piles of debris were left in the front yard which was very unsightly. He said that before coming to the meeting he noticed that there is a 3' deep hole close to the sidewalk which is marked off with a cloth hanging from some string, close to the sidewalk and it poses a very dangerous situation especially at night. He noted that there is a lot of pedestrian traffic including children going to school. In rebuttal, Mr. Ducich stated that all the problems that Mr. Still has talked of have been taken care of. There were no additional persons desiring to speak in favor of or in opposition to the item. MOTION It was moved by Commissioner Szany, seconded by Commissioner Hedlund to close the public hearing. The motion passed by voice vote with none dissenting. Staff said that the owner has been notified of all the problems and he has responded to them by complying. MOTION It was moved by Commissioner Szany, seconded by Commissioner Amato to approve TPM 90 -001 subject to the conditions in the staff report. ROLL CALL: AYES: Commissioners Amato, Hedlund, Szany, Papay NOES: None ABSENT: Commissioner Clark Chairman Papay noted there is a ten day appeal period. PUBLIC HEARING CUP 89 -019 921 S. Baldwin Sizoo & Akiko Seshimo Consideration of a conditional use permit to operate a restaurant with seating for 38+ people. Arcadia City Planning Commission 1/23/90 Page 2 The staff report was presented and the public hearing was opened. Akiko Seshimo, 501 N. 4th, Montebello, said that they are in agreement with all of the conditions in the staff report. Tim Guduin, 15952 Miami Way, Pacific Palisades, said that he was representing the owners of 717- 727 Fairview and they were concerned about exhaust•fumes and wanted to know what type of cuisine would be served. He asked if another restaurant would be allowed in the center? In response Ms. Butler said that this will be a Japanese restaurant with a Sushi Bar. In regard to the exhaust system she said that they will have to comply with the Health Department's requirements. It was noted that another restaurant would not be encouraged, however, if somebody wanted to open a restaurant there they would have to go through the C.U.P. process which requires a public hearing. There were no additional persons desiring to speak in favor of or in opposition to the proposed use. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Hedlund was in favor of the restaurant. RESOLUTION 1431 A resolution granting CUP 89 -019 to operate a restaurant at 921 S. Baldwin. Mr. Woolard read the title of the resolution. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Amato to approve C.U.P. 89 -019 and to adopt Resolution 1431. PUBLIC HEARING MP 90 -001 412 Cortez Rd. James K. Francis Consideration of an appeal of the Santa Anita Village Homeowners Association's denial of an existing enclosed screened patio built without permits. The staff report was presented. Staff said that the addition does not have the appearance of an aluminium building. The building inspector did not think that this is a true aluminimum enclosure. An enclosure with windows needs permits and Architectural Review Board (ARB) approval. Arcadia City Planning Commission 1/23/90 Page 3 The public hearing was opened. James Francis, 412 Cortez Rd., said that the addition is not visible from the street or to the neighbors to the west and to the north. The neighbor to the east is the only one with a view of the patio and has no objection to it and feels that it adds to the appearance and to the value of the property. The ARB denied the addition without looking at the property. He submitted pictures of similar types of additions with permits that were given within the last six months and also 3 letters from adjoining neighbors expressing their support. In answer to Commissioner Hedlund's question, Mr. Francis explained that he had been denied a permit due to the flat roof and because the Village does not allow the construction of aluminimum awnings. He said that the bottom 3' of the addition is cement block painted to match the exterior of the house, 3' -4' of window and a 6" siding on top and said that there is absolutely no aluminimum used in the construction of the patio. He said that the roof has a slight pitch for run -off water and explained the T -Block roof which is 8 " -9" thick and commented that he has adequate insulation and water sealant on the roof. He noted that they invited the ARB to inspect the addition but nobody ever came to the house. Nancy Dorn, 1410 Rancho Rd., said that as a real estate agent she sees many homes and has seen several homes in the City with similar type of an enclosure which are inferior to Mr. Francis's and are also larger. She thought that it would be unfair if Mr. Francis's request was denied. Tom Crosby, 601 S. Old Ranch, Chairman of the Village ARB, explained that he doesn't go to each property that has filed the short form because it would be time consuming and since he can read the plans he relies on them in making decisions. He said that in reviewing the history of the addition he noted that the same plans were submitted in 1985 and were denied and he felt that since the new plans were identical they should not be approved. He commented that a brochure was submitted with the plans which showed the type of construction on similar type additions and he felt that the flat roof looked metalic (galvanized tin or aluminimum). The addition would not be architecturally compatible with the Village. He said that he was never asked to go and see the addition and since the short form did not have any of the required signatures he denied the application. Mike Miller, the City Attorney, stated that each application should be considered at its own merit. Since this was a new application, the history is irrelevant and should not have had any bearing on the new decision. Mr. Crosby should not have made a decision based on what happened in the past. Mr. Crosby said that the denial was based on the fact that the applicant did not get the required signatures and that the new plans were copies of the old plans. Mr. Crosby said that he has not seen the addition since its completion. William Woolard, the Planning Director, said that the ARB did not act appropriately. He explained that since the required signatures were not obtained, the ARB should have held a formal hearing which would require the notification of the homeowners within 100' of the property. In rebuttal, Mr. Francis said that the addition was built exactly as the plans were drawn. There were no additional persons desiring to speak in favor of or in opposition to the appeal. MOTION It was moved by Commissioner Szany, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. Commissinoner Hedlund felt that there was poor filing on the applicant's behalf. He didn't file a complete application and did not cooperate with the ARB. He felt that the applicant should submit a Arcadia City Planning Commission 1/23/90 Page 4 complete set of plans with the appropriate signatures to the ARB for review. Since none of the neighbors object to the addition then he didn't think that it should be a problem with getting the approval. Commissioner Amato agreed and said that it was not coordinated well. Commissioner Szany thought that there was no communication. He said that it would be very difficult for Mr. Crosby to go to each property that submits a short form and said that the ARB relies on the plans to make its decision. This is an awkward situation and since it cannot be seen through the street. He suggested that Mr. Crosby go and see the addition and that the application go back to the ARB for the proper procedure. It was the consensus of the Commission that the findings of the ARB were not accurate and because of the lack of communication between the ARB and the appellant this matter should be referred back to the ARB for appropriate review and findings. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Szany to remand this matter back to the ARB for appropriate review and findings. Huntington Dr. Arcadia Gateway Centre The staff report was presented. MOTION item, since his office was involved with its development. Consideration of a one -year time extension for monument signs. It was moved by Commissioner Amato, seconded by Commissioner Szany to approve a one -year time extension to January 26, 1991. Live Oak. Mr. Woolard read the title of the resolution. MOTION It was moved by Commissioner Amato, seconded by Commissioner Szany to adopt Resolution 1430 and to formally affirm the decision of January 9, 1990, reflecting the findings of the Commission and the votes thereon. MATTERS FROM COUNCIL Councilman Gilb said that the ground bredking for the Senior Citizens Center took place and anticipated the construction would be completed in approximately 15 months. MATTERS FROM COMMISSION None MATTERS FROM STAFF Mr. Woolard said that the Commission's next regular meeting will be on February 27, 1990 since there are no items on the agenda for the first meeting in February.
