ARCADIA CITY PLANNING COMMISSION
REGULAR MEETING
Tuesday, March 13, 1990
The Planning Commission of the City of Arcadia met in regular session on Tuesday, March 13, 1990 at 7:30
p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Larry
Papay presiding.

MINUTES
MOTION
It was moved by Commissioner Amato, seconded by Commissioner Clark to approve the Minutes of
February 27, 1990 as published. The motion passed by voice vote with none dissenting.
MOTION
It was moved by Commissioner Clark, seconded by Commissioner Hedlund to read the resolution by title
only and waive reading the full body of the resolution. The motion passed by voice vote with none
dissenting.
The City Attorney announced that pursuant to Code Section 549569(a), the Commission met in closed session
tonight to discuss the existing City law suit vs. Ellis.

PUBLIC HEARING V -90 -001
1031 Golden West Ave.
Bade Construction Co., Inc.
Consideration of a zone variance to permit a single - family
residence on a 4,465 sq. ft. lot which is zoned R -3
(multiple - family zone).
The staff report was presented.
Staff said that based on the building permits there are 2 structures on the lot to the west.
The public hearing was opened.
Milton Bade, 909 S. Santa Anita, said that they are in agreement with all of the conditions in the staff report.
He stated that the lot is too small for a multiple - family development and if not developed, it will remain in its
present condition.
Harold Ellis, 1504 S. Eight, spoke in opposition. He felt that the proposed development would not be
appropriate on the lot and would create an odd situation. He said that the lot doesn't meet the width, area or
depth requirements for R -3 and is too small for development. He didn't think that the City should allow
substandard developments in order to bring the property in equality with the surrounding properties. An R -1
development should be on an R -1 zoned lot and not on an R -3 property. He felt that the City didn't have the
legal authority to allow such a variance.
No one else spoke in favor of or in opposition to this item.
MOTION
It was moved by Commissioner Hedlund, seconded by Commissioner Clark to close the public
hearing. The motion passed by voice vote with none dissenting.
Commissioner Clark felt that this is an exceptional case and unless it is developed as proposed nothing else can
be done with the property. He didn't think that the second -story rear setback modification was significant.
Commissioner Hedlund thought that putting 2 dwellings on the lot would create a problem and if a house was too
big it would be compatible with the surrounding dwellings.
In answer to a question, Ms. Butler stated that there are no special front yard setbacks off of Golden West
Avenue.
Commissioner Szany agreed and said that the density was appropriate and Commissioner Amato felt that it is
the best use of the lot.
Chairman Papay commented that it is a special situation and was in favor of the proposal.
MOTION
It was moved by Commissioner Clark, seconded by Commissioner Amato to approve V -90 -001
subject to the conditions in the staff report.

PUBLIC HEARING TPM 90 -002

Min -Su Hsieh
Consideration of a tentative parcel map for a 2 -unit
residential condominium project.
The staff report was presented and the public hearing was opened.
Min -Su Hsieh, 120 W. Lemon, said that they are in agreement with all of the conditions in the staff report.
There were no additional persons desiring to speak in favor of or in opposition to the proposal.
MOTION
It was moved by Commissioner Szany, seconded by Commissioner Clark to close the public
hearing. The motion passed by voice vote with none dissenting.
The consensus of the Commission was favorable.
MOTION
It was moved by Commissioner Szany, seconded by Commissioner Clark to approve TPM
90 -002 subject to the conditions in the staff report.

PUBLIC HEARING T.A. 90 -001
Consideration of a text amendment to clarify, amend and
add the following regulations to the R -O, R -M and R -1
zones:
A. Amend and clarify the wording of "Single- Family
Dwellings ".
B. Amend the wording of 'Building Height" to incorporate
the wording from the General Provisions section of the
zoning ordinance.
C. Add wording relating to "Equipment and Facilities"
which is currently in the General Provisions section of
the zoning ordinance.
D. Add wording relating to "Swimming Pools and Spas"
which is currently in the General Provisions section of
the zoning ordinance.
E. Clarify the wording for "Equine Animals" in the R -O and
R -1 zones.
F. Clarify the wording for "Animals and Fowl" in the R -1
zone.

The staff report was presented.
In answer to questions from the Commission, staff said that no portions of the structure can exceed the height
limits. Mechanical equipment must be placed on the back side of the roof or dwelling or have to be screened so
it won't be visible from the street.
The public hearing was opened.
Harold Ellis, 1504 S. Eighth, submitted photos of his property and the areas where he keeps his horses. He
thought that limiting property owners to 5 horses is not correct and deprives him of the use of his property.
He said that his property is maintained and there is ample room for the number of horses that he keeps. He
commented that at times he has had between 12 -14 horses on his property and the pictures taken by the Police
Department. He felt that restricting any property owner of the full use of his property is ridiculous and
unconstitutional. He didn't think that babies should be counted and he said that this is an imposition on any one
who owns horses. He commented that there is no support in the staff report for recommending the keeping of 5
horses and thought that there should be factual basis on that number. He said that he would take legal action if
necessary if he was restricted to 5 horses on his property.
No one else spoke in favor of or in opposition to the lot line adjustment.

It was moved by Commissioner Szany, seconded by Commissioner Amato to close the public
hearing. The motion passed by voice vote with none dissenting.
Commissioner Hedlund said that most of the numbers appear to be the same from the previous text amendment
regarding the maintenance of horses. The only new numbers seem to be in regard to spas and swimming pools.
Commissioner Clark felt that this provides clarity as compared to the existing and makes it easier to
understand.
Mr. Woolard said that the existing horse regulations restrict the number of horses to 5 per lot and extra time
was given to baby horses before separating them but baby horses were never in addition to 5 that can be kept.
The City proposed changes to the keeping of horses and reviewing each case through the CUP process, but horse
owners were against it and didn't want any changes.
Mr. Miller said that the City recognizes the need for keeping baby horses with their mothers but to allow
somebody with 5 mature horses and 5 baby horses would create an enforcement nightmare. He stated that
ample time is given to property owners to comply. Notices are given and he noted that there are no
modifications for equine animals. The number of horses is irrelevant to this text amendment, since this text
amendment only deals with clarifying the wording for "equine animals ".
The consensus of the Commission was favorable.

of T.A. 90 -001 to the City Council.

PUBLIC HEARING T.A. 90 -002 Consideration of a text amendment to:
A. Amend the Lighting requirements in the CPD -1, C -O,
C -1, C -2, C -M and M -1 zones, to allow for 20 foot
high light standards.
B. Amend the Inside and Outside Storage Refuse
requirements in the CPD -1, C -O, C -1, C -2 C -M and
M -1 zones.
C. Amend the real estate sign regulations in the CPD -1, C-
O, C -1, C -2 C -M and M -1 zones.
The staff report was presented and the public hearing was opened.
No one spoke in favor of or in opposition to the text amendment.

It was moved by Commissioner Szany, seconded by Commissioner Amato to close the public
hearing. The motion passed by voice vote with none dissenting.
Commissioner Amato was glad to see the changes.
MOTION
It was moved by Commissioner Clark, seconded by Commissioner Amato to recommend approval
of T.A. 90 -002 to the City Council.

Consideration of a 6 -month time extension for a 16 -unit
residential condominium.
MOTION
It was moved by Commissioner Clark, seconded by Commissioner Amato, to grant a six month time
extension to September 8, 1990.

Commissioner Szany abstained.
RESOLUTION 1432
Mr. Woolard read the title of the resolution.
A resolution denying CUP 90 -002 for a proposed 46 -lot
residential planned development with related parking and
building setback modifications at 702 -822 N. First Avenue and
105 -119 Haven Avenue.
MOTION
It was moved by Commissioner Hedlund, seconded by Commissioner Amato to adopt Resolution
and to formally affirm the decision of February 27, 1990, reflecting the findings of the
Commission and the votes thereon.

MATTERS FROM COUNCIL
Councilman Lojeski discussed the latest developments regarding the following, (1) the Derby Restaurant, (2)
the property located at northwest corner of 5th and Huntington, (3) the property located at Second and
Huntington. He thanked the Commission for all their help through his term and said that he has had a very
fulfilling 8 years serving on the Council.
MATTERS FROM COMMISSION
In regard to a question from Commissioner Clark, Mr. Miller said that he discussed the matter with the City
Attorney at Monrovia and Mr. Woolard said that before the City can take any action, the property owner has to
give consent.
Commissioner Hedlund felt that a study should be conducted in increasing lot size requirements for R -2 and R-
3 properties. He suggested giving bonuses similar to the changes to the R -O and R -1 properties. He
commented that he would like to see the elimination of subterranean and tuck under parking and would prefer
surface parking.
Chairman Papay said that by eliminating subterranean or tuck under parking would reflect the height
requirements.
Commissioner Amato said that he would like to see greater setbacks.
Mr. Woolard stated that the Commission can make a motion to relay their concerns to the City Council and
Council can then direct staff to conduct a survey.
