MINUTES ARCADIA CITY PLANNING COMMISSION REGULAR MEETING Tuesday, September 25, 1990 The Planning Commission of the City of Arcadia met in regular session on Tuesday, September 25, 1990 at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Larry Papay presiding. PLEDGE OF ALLEGIANCE ROLL CALL: PRESENT: Commissioners Amato, Clark, Hedlund, Szany, Papay ABSENT: None MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to read all resolutions by title only and waive reading the full body of the resolution. The motion passed by voice vote with none dissenting. MINUTES MOTION It was moved by Commissioner Szany, seconded by Commissioner Amato to approve the Minutes of August 28, 1990 as amended. The motion passed by voice vote with none dissenting. CONTINUED PUBUC HEARING TPM 90 -007 143 Genoa St. Tritech Assoc. Consideration of a tentative parcel map for a 3 -unit residential condominium. The staff report was presented and the public hearing was opened. Alex Chang, 8730 E. Huntington Dr., San Gabriel, representing the owner David Hsu, explained that there are several changes in this proposal from the one that was previously before the Commission. Arcadia City Planning Commission 9/25/90 Page 1 The building has been reduced by approximately 700 sq. ft., the rear yard setback was increased from 10' -0" to 18' -0" and the side yard setback was increased from 13' -0" to 16' -0 ". He said that they agreed with all of the conditions in the staff report. It was noted that the tentative parcel map deals with the form of ownership and not the design of the building, therefore, the Commission made the following motion to review the modification application prior to the consideration for the tentative parcel map. MOTION It was moved by Commissioner Amato, seconded by Commissioner Szany to continue the public hearing for TPM 90 -007 and to hear it after item 3 on the agenda, MP 90 -011 which deals with the modifications for the subject property. PUBLIC HEARING MP 90 -011 143 Genoa St. Tritech Assoc. Consideration of modifications for a 3 -unit residential condominium project. The staff report was presented and the public hearing was opened. Alex Chang, 8730 E. Huntington Dr., San Gabriel, said that he was present to answer any questions from the Commission. There were no other persons desiring to speak in favor of or in opposition to this item. MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. Staff stated that the previous design was for a 5,209 sq. ft. building which has been reduced to 4,585 sq. ft., in this proposal. All three units have been reduced in size. Commissioner Clark stated that although he appreciates the applicant's efforts to reduce the building size and to increase the setbacks, he was concerned over the cumulative impact of developments on 50' wide lots and the deletion of the landscaped buffer. Commissioner Szany agreed and said that most of the modifications that were previously approved on 50' wide lots were for projects with an average of 3,600 sq. ft. and 7 bedrooms. The proposal is for a 4,500 sq. ft. building with 10 bedrooms. He thought that the modifications should be reevaluated and was concerned about the parking off the alley. He said that this is too much development on a 50' wide lot. Commissioner Hedlund was concerned about the cumulative impact of the number of bedrooms, did not like the deletion of the landscaped buffer and felt that the project is too intense for the property. Commissioner Amato agreed with all the statements made above and felt that the driveway should be widened. Chairman Papay was concerned about the square footage, the number of bedrooms and thought that the project was not appropriate for the property. CONTINUED PUBLIC HEARING TPM90 -007 Consideration of a tentative parcel map for a 3 -unit TPM 90 -007 residential condominium. 143 Genoa St. Tritech Assoc. Mr. Chang was present to answer any questions. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. Staff said that if the tentative parcel map is approved, the project will have to comply with all of the zoning regulations. Even though the Commission may approve this parcel map for 3 units, the applicant could reduce it down to 2 units. If a design does not meet Code and needs modifications, the Commission will again review the project. Mr. Woolard said that the Commission should keep in mind that the modification request and the tentative parcel maps are two separate items and are not linked together. The tentative parcel map is form of ownership. He noted that the applicant may appeal the Commission's decision to City Council. In response to a question from Chairman Papay, Mr. Chang stated that he would like the Commission to vote on the parcel map and he will work with the applicant for a new design. Commissioner Szany stated that would prefer less dense units and said that three units on a single lot are much better than eight on a double lot. He suggested units similar to ones that have been approved by the Commission in the past which has been an average of 3,600 sq. ft. and 7 bedrooms. Chairman Papay remarked that each project is reviewed separately and on its own merit. Commissioner Clark noted that any modification will come to the Commission for review. Commissioner Hedlund thought that this item should be continued. MOTION It was moved by Commissioner Clark, seconded by Commissioner Szany to approve TPM 90 -001 subject to the conditions in the staff report. PUBLIC HEARING TM 49990 407 E. Duarte Rd. Ming -Nang Chen Consideration of a tentative map for a 7 -unit residential condominium project. The staff report was presented and the public hearing was opened. Elias Saykali, 1740 E. Huntington Dr., Duarte, said that they are in agreement the conditions in the staff report. There were no other persons desiring to speak in favor of or in opposition to this item. MOTION It was moved by Commissioner Szany, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Clark said that based on the rendering presented by the applicant, it seems to be a nice development. MOTION It was moved by Commissioner Szany, seconded by Commissioner Amato to approve TM 49990 subject to the conditions in the staff report. PUBLIC HEARING CUP 90 -012 Consideration of a conditional use permit for an existing 125 W. Live Oak Ave. automotive garage which proposes to construct a 4,341 Tony Magusin sq. ft. metal shed at the rear of the building. The staff report was presented and the public hearing was opened. There were no other persons desiring to speak in favor of or in opposition to this item. The motion passed by voice vote with none dissenting. Staff said that the shed is not visible from neither Live Oak nor Las Tunas. The work has been done in the back for a long time and it was discovered when, the Fire Dept. on a routine inspection for hazardous waste, found the violation. It was noted that landscaping will be required. Staff remarked that the convalescent home to the south of the property, is the only residential use in the immediate area and is separated by Live Oak. Mr. Woolard said that the storage of materials and will be closely monitored by the Fire Department. Commissioner Clark was in favor of the use as long as the vehicles are not visible from the street. Commissioner Szany suggested a limit on the hours of operation from 7:00 a.m. to 7:00 p.m. Commissioner Amato remarked that he was not concerned about the hours of operation. MOTION It was moved by Commissioner Clark, seconded by Commissioner Szany to approve CUP 90 -012 subject to the conditions in the staff report with the additional condition that the hours of operation be limited to 7:00 a.m. to 7:00 p.m. ROLL CALL: AYES: NOES: Commissioners Amato, Clark, Hedlund, Szany, Papay None Chairman Papay noted that there is a five working day appeal period after the adoption of the resolution. PUBLIC HEARING CUP 90 -013 411 E. Huntington Dr., #103 Ruchanee Choksombatchai Consideration of a conditional use permit to operate a buffet style restaurant with seating for 16 persons and related parking modifications. The staff report was presented. Staff said that they can have take -out but want to have a buffet style restaurant. The application did not specify the servicing of alcoholic beverages and there was not a limit on hours of operation since it is a commercial area and there are no residential properties in close proximity. The public hearing was opened. Ruchanee Choksombatchai, 3096 Hacienda Dr., Duarte, agreed with all of the conditions in the staff report. There were no other persons desiring to speak in favor of or in opposition to this item. The motion passed by voice vote with none dissenting. Commissioner Hedlund thought that no more eating establishments should be allowed at the site. Mr. Woolard explained that if an application for an eating establishment is filed the Planning Dept. can not refuse to accept the application and eating establishments can not be prohibited without due process. Staff informed the Commission that Subway Deli has filed an application for the site with seating for 8 persons. MOTION It was moved by Commissioner Szany, seconded by Commissioner Hedlund to approve CUP 90 -013 subject to the conditions in the staff report. PUBLIC HEARING MP 90 -010 407 S. Second Ave. Herand Shahbazi Consideration of modifications for a 4 -unit residential condominium project. The staff report was presented and the public hearing was opened. Herand Shahbazi, 740 E. Wilson, Glendale, the designer of the project said that there will be security gates opened by remote control and guests can use the intercom system which will be installed. There were no other persons desiring to speak in favor of or in opposition to this item. MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. The consensus of the Commission was favorable. Commissioner Szany abstained from this item. PUBLIC HEARING TM 48724 702 -822 N. First Ave. and 105 -119 Haven Ave. John Plount Consideration of a tentative map for a residential planned development which will create 40 residential Tots and 4 common area lots. The common area lots will accommodate the private streets and recreational /leisure areas. The staff report was presented. Staff said that the streets will be private but will have to comply with City standards. It was noted that covenants can not be recorded to assure that the streets remain as private streets. Staff remarked that the proposal before the Commission is identical with the exception of the two additional conditions added by the City Council. The public hearing was opened. John Plount, 464 S. Cataract, San Dimas, said that he is in agreement with all of the conditions in the staff report and said that the CUP added the streets as a part of the total development. There were no other persons desiring to speak in favor of or in opposition to this item. MOTION It was moved by Commissioner Szany, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Hedlund felt that the project is too intense, the houses are too big, too many bedrooms and noted that he was aware that this is only for the form of ownership. Commissioner Amato agreed and Chairman Papay stated that the tentative map only deals with form of ownership and not the design of the proposed homes. MOTION It was moved by Commissioner Clark, seconded by Commissioner Papay to approve TM 48724 subject to the conditions in the staff report. Arcadia City Planning Commission 9/25/90 Page 7 PUBLIC HEARING TPM 90 -010 375 -379 W. Duarte Rd. Chawkuo Chou Consideration of a tentative parcel map to create three Tots from two lots. The staff report was presented and the public hearing was opened. Engles Shen, 600 W. Main, Alhambra, said that they are in agreement with all of the conditions in the staff report and said that the new construction will comply with the setback requirements. Barbara Cogorno, 365 W. Duarte, asked if at a later a street could be proposed to the north of her property that would extend from Holly to Park? Staff said that due to the existing conditions to the north, Ms. Cogorno's property could not be split on its own. If enough lots are acquired, a cul -de -sac could be possible. Mr. Woolard explained that the City does not put in the new streets. Developers at the time of construction put in the streets which have to comply with City standards. There were no other persons desiring to speak in favor of or in opposition to this item. MOTION It was moved by Commissioner Szany, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. Chairman Papay noted that after most of the Tots in the area are landlocked. AUDIENCE PARTICIPATION Pastor Mark Witte, Lutheran Church of the Cross, 66 W. Duarte, submitted some plans to the Commission for signs for the church and asked for their approval. He was informed by both the Commission and staff of the process to obtain an approval. Arcadia City Planning Commission 9/25/90 Page 8 TIME EXTENSION 133 E. Huntington Dr. A.L. Landsperger The staff report was presented. MOTION Consideration of a 6 -month time extension for a second story addition. It was moved by Commissioner Szany, seconded by Commissioner Amato to recommend a 6- month time extension to March 12, 1991. ROLL CALL: AYES: NOES: Commissioners Amato, Clark, Hedlund, Szany, Papay None PLANNING COMMISSION RECOMMENDATION MOTION Direction to Planning staff to review the City's Subdivision and Zoning regulations and the preparation of appropriate text amendments. It was moved by Commissioner Clark, seconded by Commissioner Amato to direct the Planning Department to initiate proceedings to change zones or regulations established by Chapter 2 of Title IX, whenever, in the exercise of their discretion, the public necessity, convenience, general welfare, or good zoning practice justifies such action. RESOLUTION 1442 A resolution granting CUP 90 -011 to operate an automotive garage at 152 -154 St. Joseph. Mr. Woolard read the title of the resolution. MOTION It was moved by Commissioner Amato, seconded by Commissioner Szany to adopt Resolution 1442 and to formally affirm the decisions of August 28, 1990 and the votes thereon. MATTERS FROM COUNCIL None Arcadia City Planning Commission 9/25/90 Page 9 MATTERS FROM COMMISSION After some discussion the Commission felt the following items should be discussed at the joint meeting with City Council: 1 . Side yard setbacks. 2. Number of bedrooms 3. Landscaping 4. Large lots - as described in the General Plan. 5. Tuck under parking for multiple - family dwellings. Commissioner Clark stated that he will not be at the October 23rd meeting. MATTERS FROM STAFF Staff noted that they have just received regulations from the City of Los Gatos in regard to new regulations for multiple - family dwellings which require handicap access. This requirement would translate to on -grade developments with on -grade parking which would reduce the number of potential units. Staff is reviewing the Los Gatos requirements.
