MINUTES ARCADIA CITY PLANNING COMMISSION REGULAR MEETING Tuesday, November 27, 1990 The Planning Commission of the City of Arcadia met in regular session on Tuesday, November 27, 1990 at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Larry Papay presiding. PLEDGE OF ALLEGIANCE ROLL CALL: PRESENT: Commissioners Amato, Clark, Hedlund, Szany, Papay ABSENT: None MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to read all resolutions by title only and waive reading the full body of the resolution. The motion passed by voice vote with none dissenting. • MINUTES MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Szany to approve the Minutes of November 13, 1990 as published. The motion passed by voice vote with none dissenting. PUBLIC HEARING GP 90 -001 44 -50 Forest Ave., 612 -620 N. First Ave. & 701 -805 N. First Ave. John Plount & The City of Arcadia Consideration of a request to amend the Arcadia General Plan Land Use Element from Single- family Residential 0 -6 dwelling units per acre to Multiple - family residential 7+ dwelling units per acre. The staff report was presented and the public hearing was opened. John Plount, the applicant, 464 S. Cataract, San Dimas, was present to answer any questions. There were no other persons desiring to speak in favor of or in opposition to this item. Arcadia City Planning Commission 11/27/90 Page 1 MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Clark noted that this change will make the zoning consistent with the General Plan. MOTION It was moved by Commissioner Clark, seconded by Commissioner Hedlund to recommend approval of GP 90 -001 to the City Council. Grand View Ave. David Niemeyer Consideration of a tentative parcel map to create two Tots from one lot. The staff report was presented and the public hearing was opened. The applicant, David Niemeyer, 1420 N. Claremont, Claremont, said that they all of the conditions in the staff report. Chairman Papay remarked that the item before the Commission is the lot split be built on the property. are in agreement with only and not what will Richard Desjardins, 1845 N. Santa Anita, said that his property abuts the subject lot and that he was concerned with a 6' high wall that would be built on the property and said that since his property is approximately 3' lower, the wall would be almost 9' high on this property and would block his view. He was also concerned with possible drainage problems. He suggested to move up the tennis court 15' to allow and to place the wall further back which would reduce noise and allow addition room for drainage. Herb Shallenberger, 1125 E. Grandview, said that he has not seen the design of the house but would like to preserve his view of the valley. He noted that he would like to see the height restrictions enforced. Chairman Papay reiterated that the item before the Commission is the lot split and what may be built on the property is not being considered at this item. In rebuttal, Mr. Niemeyer said that he would like to maintain Mr. Shallenberger's view of the valley and said that he will design homes with entrances same level as the existing residence and will be low profile. He was in agreement with moving the tennis court up approximately 10'. Drainage devices would be installed. He also noted that a tree preservation plan would be submitted. In answer to a question from the Commission, he noted that the 40" oak tree will be retained. William Woolard, the Planning Director, asked if they would sign a covenant with regard to the setback of the tennis court since a covenant would be the only binding document requiring them to maintain the setback. Arcadia City Planning Commission 11/27/90 Page 2 Mr. Niemeyer was not in favor of the covenant and explained that they would not like to commit themselves to a set setback since they are not certain of the designs for the new homes. He remarked that although they will agree to moving the tennis court to the north, they are reluctant to signing a document to a specific setback. There were no other persons desiring to speak in favor of or in opposition to this item. MOTION It was moved by Commissioner Clark, seconded by Commissioner hearing. The motion passed by voice vote with none dissenting. Commissioner Amato said that the lot is large enough to be split. He was court and said that he would like to see the 10' setback maintained. Commissioner Clark agreed. Commissioner Hedlund said that the proposed plan has been well prepared and with the proper drainage he was in favor of the split and relyed on their sincerity to provide adequate landscaping. Commissioner Szany agreed with Commissioner Hedlund said that the applicant has been very considerate of his neighbors and said that he would like to see the 40" oak tree saved. Amato to close the public concerned about the tennis MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to approve TPM 90 -013 subject to the conditions in the staff report with the additional condition that a tree preservation plan be submitted to the Planning Department and as many trees be saved as possible and that the 40" oak tree be saved. Live Oak Ave. Los Angeles Cellular Telephone Co. The staff report was presented. Consideration of a variance for a sixty (60) foot tall monopole antenna support in lieu of the fifty (50) foot total height in the C -2 (General Commercial Zone). Staff commented that a condition can be added that the landscaping at the site be maintained. The public hearing was opened. Jerome Buckmelter, 6045 Slauson, Commerce, said that they are in agreement with all of the conditions in the staff report. He submitted a photo and described how a 60' pole would allow for more coverage than a 50' pole and said that the extra 10' is necessary, since a 60' pole would give a Arcadia City Planning Commission 11/27/90 Page 3 stronger signal than a 50' pole. He commented that the existing utility poles in the area are higher than the pole they propose. There were no other persons desiring to speak in favor of or in opposition to this item. MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Clark was in favor of the extra 10' and remarked that it is miserable to have a conversation with someone and fade in and out due to weak spots. Commissioner Amato agreed. MOTION It was moved by Commissioner Clark, seconded by Commissioner Amato to approve V -90 -003 subject to the conditions in the staff report. AUDIENCE PARTICIPATION None RESOLUTION 1448 A resolution denying MP 90 -013 for a proposed two - story dwelling with attached garage at 717 Cortez Rd. RESOLUTION 1449 A resolution granting CUP 90 -016 to allow the expansion of an existing auto body shop at 42 W. Live Oak Ave. RESOLUTION 1450 A resolution granting V -90 -002 to construct an attached enclosed patio and approve an existing detached spa with enclosure at an existing legal nonconforming single - family dwelling and detached two -car garage at 515 S. First Ave. RESOLUTION 1451 A resolution granting CUP 90 -017 to establish and operate an unmanned cellular telephone equipment facility at 206 E. Live Oak Ave. Arcadia City Planning Commission 11/27/90 Page 4 RESOLUTION 1452 RESOLUTION 1453 A resolution granting MP 90 -014 and sustaining an appeal of a denial by the Architectural Review Board of the Rancho Santa Anita Property Owner's Association for a detached gazebo and an attached arbor at 920 Fallen Leaf Rd. A resolution granting MP 90 -015 to utilize smoked transparent glazing on the east side of the multi -story office building at 800 S. Santa Anita Ave. Mr. Woolard read the titles of the resolutions. MOTION It was moved by Commissioner Amato, seconded by Commissioner Szany to adopt Resolution 1448, 1449, 1450, 1451, 1452 and 1453 and to formally affirm the decision of November 13, 1990 and the votes thereon.
