The Planning Commission of the City of Arcadia met in regular session on Tuesday, December 10, 1991, at 7:30
p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Tom
Clark presiding.

Consideration of a conditional use permit and parking
modifications for improvements which will alter the lavour
and operations of the previously permitted automotive
repair garage at 125 W. Live Oak.
Staff stated that the garage building is used for the repairing of automobiles that have already been
dropped off by customers. During an ordinary day, the garage will have already been occupied by vehicles
that they will be working on and should somebody come in for an estimate or to drop off a car, there should b`
no immediate need for access or egress from the garage space. The Fire Dept. has noted, in one of their
conditions, that the fire hydrant may have to be relocated and that may negate any on street parking space.
There have been no parking problems at this site. The amount of square footage that currently exists, could
accommodate approximately 35 parking spaces, however this area has not been striped or landscaped. The
proposal is an improvement. The applicants drawing includes parking space at the rear of the building, but
staff feels that those spaces will not be functionally available to customers of the retail building, thus they
are not included in the account.
The public hearing was opened.
Alex Marquez, 546 Frontenac, Los Angeles, the architect on the project, said that they are in agreement with
all of the conditions in the staff report and thought that this would be an improvement over the existing
condition.

PUBLIC HEARING TA 91 -006
The Los Angeles Turf Club, Inc.
Consideration of a text amendment amending Section
9273.1.10 of Division 3 in the S-1 Special Use Zone to read:
"Horse racing, live during daytime hours or via satellite
feed during daytime or evening hours, with or without pari-
mutuel wagering on the results thereof."
The staff report was presented.
In response to questions from the Commission, Mr. Woolard said that the Police Dept. does not have to
monitor the traffic signals, like they do during the racing season, but they do monitor the traffic volumes and
the number of cars that are there for each day that there is a racing activity taking place. If there is a lot of
volume, it may require that some of the signals be operated by the Police, however, staff does not feel that
that would happen.

Art Hershey, Los Angeles . urf Club, 285 Huntington, said that they are in agreement with the restriction on
one night a week. The need for this is to accommodate the thirteen weeks of friday night racing which will
be coming out of Hollywood Park in the spring, following the closure of the winter meet. They would like to
keep their options open, in case they were to increase it to more than one night a week, if there is a need. He
anticipated a crowed of 4500 to 5000 during this time - approximately 2000 cars from 5:00 p.m. to 11:00 p.m.
and did not think that the impact would be great.

MOTION
It was moved by Commissioner Amato, seconded by Commissioner Szany to re -open the public
hearing. The motion passed by voice vote with none dissenting.
Raymond Floyd, 1300 Quail, Newport Beach, said that the S & P Co., who owns this property, is in favor of
the proposed use. He felt that there is ample parking on the site and they are aware of the operation which
is contemplated and noted that the use will not be in conflict with the other uses on the site which include
both office and retail uses. Mr. Floyd thought the limitation of 12 students at any one time would be too
restrictive and wondered if that could be increased. He was concerned that if they held more than one
seminar at one time, they would be in violation of the CUP.
Chairman Clark noted that the applicant is not present and said that that number is an average and the
Commission may make adjustments.
Staff said that it was hoped that the applicant would be present to answer some questions, since much is not
known of the operation of the business, other than what was stated on the CUP application.

Commissioner Szany was in agreement with limiting the number of students to 15 on weekdays and 25 on
weekends.
Commissioner Amato said that they could revise the CUP, at a later date, to increase the number of students.

Consideration of a modifications for a proposed 7 -unit
residential condominium project.
The staff report was presented.
Staff said that the two driveways will be together and that the applicant can not use the neighboring
driveway. The primary reason for modification "C ", regarding the deletion of a required landscape area next
to the driveway, is to accommodate an existing easement. The landscaping would not be required if there
going to be a community driveway.
The public hearing was opened.
Ming Nang Chen, 404 E. Las Tunas, San Gabriel, said that they are in agreement with all of the conditions or
the staff report. He noted that according to code, they can build up to 11 units on the site, however, they
chose to build 7 -units to provide a nicer development. He remarked that the narrow width of the lot has
made it a necessity for them to request the modifications. The project will be two-story, residential
condominium project with on grade parking and with ample open space. The proposed project looks more I k
a R -2 development, even though the property is zoned R -3. Much effort has been given to the design of the
project to provide a high quality development. He thought that their emphasis on design and cons tructio n
would be an asset to the community.
In response to a question from Commissioner Szany, Mr. Chen said that the living room window looks drrck
onto the driveway.

In response to a comment „ y Commissioner Amato, staff said that modification "C" is not physically possible.
Staff noted that both staff and the applicant have spoken with the property owner to the east in hopes that
possibly a community driveway would have been agreed upon, if that would have occured, this application
would not be before the Commission, because it would fully comply with Code, but at this time the property
owner to the east does not wish to get involved in any way.
Chairman Clark thought the requested modifications are minor and the project is not as dense as it could be.
Commissioner Szany agreed with the exception that there would be a very long driveway and suggested
narrowing the driveway to reduce the driveway by 2', making it 13' wide and put landscaping in front of the
windows.
Commissioner Daggett agreed and said the property owners would have nothing to look at from their living
room window.
Chairman Clark agreed with Commissioner Szany's suggestion but wondered if the Fire Dept. might have
some problems.
Staff said that the project is subject to their review and approval. It was noted that 12.5' driveways have
been permitted in the past and the Fire Inspector has commented that this would be adequate for either a
12.5' or a 15' driveway width would be adequate. Staff said that the two driveways will have to abut for
adequate access to the neighboring units tot he east of the site.

to the conditions in the staff report with the additional condition that a minimum driveway width
of 12.5' be maintained to accommodate a 2± landscape along the driveway.

Consideration of an appeal of the Santa Anita Oaks Assoc.
Architectural Review Board's denial of a proposed two -
story single- family residence.
The staff report was presented.
Staff said that with the exception of the fence height, the proposed house complies with code.
The public hearing was opened.
John Pintorelli, 317 E. Foothill, Arcadia, the attorney representing the applicant stated that the plans for
the proposed house were submitted to the Architectural Review Board (ARB) and a hearing was held on
September 17th, at which time certain issues were raised by the ARB with regard to privacy of neighbors to
the east. The architect made modifications to the building to address the privacy issue and the project was
brought back to the ARB on November 4th. The ARB noted, in their findings, that the applicant did a good
job of dealing with the privacy issue, by eliminating windows on the east side and by adding a wall to the

rear balcony and at the sa,.te time, at the request of the ARB, the applicant changed some materials used in
some of the windows and reduced the amount of stone work to be used on the house. The ARB approved the
changes to the materials on the house. The ARB then determined that the house would not be harmonious or
compatible with the neighborhood. He said that they are addressing an objection, based upon an overall
incompatibility of the structure to the neighborhood, surrounding the proposed construction site, which in
affect presents a total block to the construction. He noted that there are several homes with different
architecture in the area and submitted a picture board and the rendering of the house and pointed out several
homes on the picture board which would be similar to the proposed house. In his opinion, it would be
difficult to be in compliance with this neighborhood, much less out of compliance with it. The applicant
feels that any reasonable request to accommodate the concerns of the immediate neighbors will be addressed
and the concerns which were addressed have already been dealt with and thought that the overall
incompatibility with the neighborhood overstates the case entirely.
Mike Owen, 120 W. Sycamore, spoke in favor of the house and thought that it would be a nice development.
Vicki Barberi, 210 N. Central, Glendale, the architect of the project, stated that the actual house will be
approximately 7,750 sq. ft. and clarified that the remainder of the square footage is comprised of the 4 -car
garage, entry porch, open balcony and the terrace.
Patricia Queen, 105 W. Sycamore, said that this house will be very much incompatible with the area and
said that the proposed house is twice the size of her home. She submitted pictures of the homes in the area
and explained that the house would be inconsistent with the neighborhood. She noted that the ARB,
Homeowner's Association (HOA) and property owners want to preserve the quite neighborhood and their
privacy as well as the trees. She thought that house would be massive and the property would be overbuilt,
that it would be architecturally inconsistent due to its size, materials. She was afraid that she would be
looking at a mass of a house instead of trees. She also submitted a letter of opposition by the Mr. and Mrs.
Roncellie who were unable to attend the meeting.
Dr. Lee Grund, 1240 Ramona, said the integrity of the area is at stake and thought that the project would
resemble a state prison. He remarked that he bought into the area because of the nice neighborhood and felt
that this house would not fit in well.
Frank Tranzow, 1230 Ramona, spoke in opposition and said that he has a large lot and his lot is crowded by
just having a 3,500 sq. ft. house, a pool and a cabana. He felt that the beautiful and small house should be
preserved. He concurred with the ARB's decision in that the house would be incompatible.
Gene Gregg, 1210 Rodeo, wondered if this would be a spec home or if the owner would live in the house?
Mr. Miller stated that the Planning Commission deals with the architecture of the house and its
compatibility. This is a land use issue and it is irrelevant who will reside there.
Bartling Anderegg ,1225 Ramona, was concerned about the three oak trees on the side of the property wanted
to preserve them. He was concerned about a monster house being built in his backyard and thought that was
disgraceful.
In rebuttal, Mr. Pintorelli said that only one tree with a 14" trunk will be removed but it will be replaced by
two trees that are going to be in 48" pots and will definitely replace the one which will be moved. They feel
that the visual appearance of the property will be of a tree ladened property. The house is going to be
substantially blocked by view by the trees on the property and they do not believe that the overall
appearance of the property will be dominated by the structure. They did not feel that the structure will
substantially alter the appearance of the property from the stand point of trees. The ARB does not object to
the external material proposed. He said that they are dealing with the aesthetics of the house. Even
though there are many single - family ranch style homes in the area, that is not the predominant usage of the
area. They did not think that the construction of this home is going to, in any way, attack the compatibility
or the consistency of the neighborhood.

Ms. Barbieri explained that presently the northwest side of the property does not have any trees and there is
concrete and an old shack which will be removed and landscaped. She said that a lot of attention has been
given to the landscaping around this structure. The 30" oak tree will not be trimmed.

In answer to a question by Commissioner Szany, Mr. Miller said that the Commission is only dealing with
compatibility as it pertains to materials, the exterior building appearance which includes the appearance of
any structure including roof, wall or fence. Some of the items are subjective. He commented that the findings
that were submitted by the ARB, do not give a great deal of guidance, are deficient and do not explain any of
the findings. They do not elaborate the reasons for their findings and the only specific reason for denial is a
general conclusion. He thought that in the future the ARB should pay more attention to explaining the
reason for denial and their basis for their denial. He remarked that since the project meets all code
requirements, the Commission should make findings as to why it is incompatible if it is denied.
In answer to a question by Commissioner Daggett, staff said that the front yard setback was never an issue of
concern.
Chairman Clark said that this is a very emotional issue. The project does comply with code and he read a
portion of the resolution which would pertain to the Commission's decision. He remarked that aesthetics
and compatibility are very subjective. He noted that what is attractive to someone, may not be attractive to
someone else. He remarked that both the Council and the Commission have worked at increasing setback
requirements to try and accommodate this type of a situation.
Commissioner Amato thought that it is unfair to deny the house due to its size.
Commissioner Daggett said that this house does not seem to violate anything that is written.
Commissioner Szany agreed with Commissioner Amato. He noted that the pictures that were presented
contained both photographs of homes that are compatible and ones that are not compatible. The materials
are somewhat compatible with the area. He felt that the architect took into consideration, the sensitivity
of the neighbors with leaving the trees and working around all the trees, especially on the east property
line, which he thought was important. He was concerned with the height of the fence.
MOTION
It was moved by Commissioner Szany, seconded by Commissioner Amato to approve MP 91 -012 and
determine that the house is harmonious and compatible with the neighborhood and overrule the
Santa Anita Oak's Association ARB denial and have staff prepare the appropriate resolution
incorporating the Commission's decision and findings and to eliminate the modification request for
fencing within the front yard area.

Consideration of a modifications for a proposed 17 -unit
residential condominium project.
The staff report was presented.
Staff said that the Fire Dept. did not have any problems with the width of the driveway in the back.
The public hearing was opened.
Laural Erpenbeck, 139 Orange Grove, said that her overall objective in developing this project was to make
each unit as home like as possible and visualized this project as a "village" with an elegant, somewhat
Victorian appeal and everything was done to achieve that goal. There is plenty of central common area.
The kitchen and the family room are very spacious and overlook the greenery and the patio. Each home has
a formal dining area and the front entry way opens for company entertaining. She thought that this project
would provide a charming cluster of homes of elegant design and would be an asset to the City. This project is
situated on a visible corner lot with lots of frontage, thus the importance for a good design.

Staff said that if a project has 10 or more units, that 2% of the total lot area be in one common recreational
area. The applicants design provides two recreation areas which exceeds the 2% by 51 sq. ft. Stairs and
trash enclosures are not a part of the 2 %.
Chairman Clark thought that the modifications are very minor and it looks like a very attractive project.
He thought that two recreations are nice and was not concerned with the removal of the trees, since many
more would replace them and Commissioner Szany agreed.

Consideration of an appeal of the Santa Anita Village
Association's Architectural Review Board's condition of
approval for a new 3,400 sq. ft. two -story residence. The
condition of approval being appealed is the requirement of
the smaller front portico as opposed to the design preferred
by the owners.
The staff report was presented.
Staff explained the differences between the exhibits.
The public hearing was opened.
Ken Burgess, 130 LeRoy, the architect of the project said that when the project was originally submitted, the
porch was 14' high. The ARB expressed concerns over the building and the porch was reduced to 10' and the
diamond shaped windows were eliminated for more conventional windows. They have agreed to use brick in
lieu of the stone on the elevation. He submitted pictures of similar type porches in the area.
Gary Kovacic, 947 Coronado, ARB member, spoke in opposition. There are about 600 single - family houses in
the Village and the average home is 1,700 sq. ft. With minor exceptions, there are detached garages and
each house is separated, at least, on one side by a driveway. There are approximately 30-40 two -story
homes, some of which are additions and some that are new construction. The average size of those homes are
approximately 2,600-3,500 sq. ft. The ARB's goal is to protect the architectural character in the
neighborhood, even though that is subjective. The proposed house is 3,400 sq. ft. two -story structure with an
additional 760 sq. ft. 4-car tandem garage, a total of 4,160 sq. ft. and a large portico. There is no driveway
separating the house from its neighbors and it is proposed to be built to its full envelope provided by the
setbacks. The house is substantially larger than the other homes in the immediate area and all of the
neighbors are against the project due to its size and appearance. The ARB felt that the portico should be
reduced in size so that it is less conspicuous, something that tied in with the existing roof line of the garage.
The architect addressed the ARB's concerns and made some changes to the original plan which then the A R 3
felt was more acceptable. The ARB does not think that the original portico is in keeping with the
neighborhood and does not maintain the architecture character of the area. The revisions proposed by the
architect to try to make it more inconspicuous are in the right direction. Since this is a large house, the
portico will make the house seem even more massive, especially due to the narrow width of the lot. The
ARB prefers Exhibit 2, which has the roof tied in and one of the pillars is eliminated. The structure has no
relation at all to what is on the street.
Wendell Chapmen, 930 Coronado, submitted a petition request a denial of the appeal. He remarked that the
project is not compatible or in harmony with area. The proposed house is going to be twice the size of the
houses in the immediate area.
Mike Cook, 943 Coronado, said that less than 1% of the homes in the Village have portico. Although th,
do not want to stop change in the area, a 1% would not be a sufficient precedent to approve the portico.

Commissioner Szany agreed with the ARB in that the portico should not be flamboyant and it should blend
with the house and Commissioner Daggett agreed.

Chairman Clark thought teat Exhibit 2 would be a better alternative for the house. He remarked that the
ARB did a fine job in preparing their findings.

It was moved by Commissioner Szany, seconded by Commissioner Amato to deny MP 91 -014 and
uphold the ARB's condition and direct staff to prepare appropriate resolution incorporating the
Commission's decisions and findings.

Gary Kovacic, 947 Coronado, remarked that he feels good about living in an HOA, since by an HOA they are
able to control, to a certain degree, some of the developments. He urged the City to create HOAs for the
southern portion of the City which is unprotected.
TIME EXTENSION Consideration of a one -year time extension for CUP 90 -019,
for the new Ralph's Supermarket at 16 E. Live Oak Ave.

MATTERS FROM COUNCIL
Councilman Fasching said that it is unfortunate the south part of the City does not have an ARB. He
considered the HOA a definite plus to the City.
He noted that at the last Council meeting, the Council reverted to voluntary water conservation in lieu of
mandatory conservation. The primary reason for that is that the city did not have a proper system in place
to handle a mandatory conservation. They found that sometimes people were conserving water for the first
three billing cycles, sometimes even the fourth cycle, and then getting hit with a penalty in the fourth or
fifth cycle but having a great conservation cycle in the first three cycles. The Council decided that this was
a very unfair situation, so it was decided, in view of the fact that the City had a 22% overall conservation of
water within the City thus far, that after December 3rd there will be no more penalty for over usage of
water. Approximately $300,000 will have been collected by the end of the December. With the 22% savings
and the winter months approaching, as far as water is concerned, staff will be working on updating the
software system in the Water Dept. which will enable residents to have a carry over system for people in
water conservation in a mandatory situation. Effective December 3rd, there will be no penalties phase in the
water conservation program.
With regard to the CableVision, Councilman Fasching stated that CableVision has started to show a line
item in the bill, a CableVision franchise fee to the City. This was something that the cable company
informed the City of approximately a month ago, that they were going to increase the rate by 5%. Since the
inception of CableVision in Arcadia, they have had a 5% franchise fee payable to the City. To cover up this
5% franchise fee to the City, which has been in existence, they have now shown it as a line item effective
December lst. This covers up the fact that they have increased the rate, and are showing the money that
they have paid the City, since they have been here, as a line item. This would tend to make the consumer
think that the City is receiving the franchise fee. A letter has been written to the cable company, indicating
that the City objects to this item.
He further stated that the Council has some very important issues to deal with within the next 5 years. One
of these issues is the extension of the Blue Line from Pasadena through the City to Duarte or Azusa. He said
that the Council is working very diligently to get that extension accomplished.
The mall expansion will include Nordstroms and May Co. and the owners of the mall have requested the
participation of the City in the amount of $15 million and a consultant working for the City is informing the
City of necessary actions.
Within the next 10 years, the National Guard property will become available and the Council will consider
a Civic Center which would encompass a new City Hall and Police Building.
Another priority item is the expansion of the Library. It seems as if the State of California will reject any
type of funding for this project. So, the City will be forced to take a look at how the Library can be
modernized without any other agencies help.

In conclusion, Councilman Fasching stated that there are major items to be dealt with within the next 540
years, which would increase revenues for the City.
