MINUTES ARCADIA CITY PLANNING COMMISSION REGULAR MEETING Tuesday, October 15, 1991 The Planning Commission of the City of Arcadia met in regular session on Tuesday, October 15, 1991, at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Tom Clark presiding. PLEDGE OF ALLEGIANCE ROLL CALL: PRESENT: Commissioners Amato, Daggett, Hedlund, Szany, Clark ABSENT: None MOTION It was moved by Commissinoner Amato, seconded by Commissioner Szany to read all resolutions by title only and waive reading the full body of the resolution. The motion passed by voice vote with none dissenting. MINUTES MOTION It was moved by Commissioner Amato, seconded by Commissioner Hedlund to approve the Minutes of September 24, 1991 as published. The motion passed by voice vote with none dissenting. OTHERS ATTENDING: Assistant Planning Director Donna Butler Assistant Planner James Kasama Assistant Planner William Stokes Secretary Silva Vergel CONTINUED PUBLIC HEARING CUP 91 -010 Consideration of a conditional use permit and parking 125 W. Live Oak Ave. and modifications for a 3,956 sq. ft. commercial building addition 120 -124 W. Las Tunas Dr. at 120 -124 W. Las Tunas Drive. The addition wil alter the Dietrich & Assoc. for layout and operations of the previously permitted Tony's Auto Body & Restoration automotive repair garage at 125 W. Live Oak. Staff stated that the applicant is not ready for the public hearing and has asked for an indefinite continuance. Staff suggests that this public hearing be tabled. Chairman Clark asked if there were any persons in the audience who wanted to speak in favor of or in opposition to this item and no one responded. MOTION It was moved by Commissioner Amato, seconded by Commissioner Daggett to table the public hearing. ROLL CALL: AYES: Commissioners Amato, Daggett, Hedlund, Szany, Clark NOES: None PUBLIC HEARING CUP 91 -015 Consideration of a conditional use permit to operate a 612 -614 E. Live Oak Ave. Karaoke studio with on -site consumption of alcoholic Kumquat Tree Inc. beverages. The staff report was presented. In response to questions from the Commission, staff said that the applicant might be able to explain to the admission requirements. It was noted that there doesn't seem to be any parking problems. The public hearing was opened. George Hsu, 822 S. Coldstream Court, Diamond Bar, said that they are in agreement with all of the conditions in the staff report. He stated that they have been in operation for two months. Their business hours do not interfere with the other business in the center since most of the businesses in the center are closed in the evening and that is when they are open. He did not foresee any problems with the parking. He explained that the ABC has different requirements for serving wine and they are only going to be serving beer only. He remarked that most of their clientele are from a younger generation and they do not have any age limitation. Identification will be required to purchase beer and it will not be sold to anyone under the age of 21. He noted that they have two different seating arrangements. They have several smaller rooms for private parties where the room is enclosed for smaller crowds of people (a group of friends) and the other is the main seating area where people have to wait in line to get on the stage and perform. He noted that they have complied with all of the Fire Department's requirements and have installed emergency lighting per their request. No one else spoke in favor of or in opposition to this item. MOTION It was moved by Commissioner Amato, seconded by Commissioner Szany to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Amato said that he visited the site and was impressed. Commissioner Hedlund was concerned with liquor being served to minors. Staff said that if the Commission moves to approve the CUP, condition 2 should be changed to "alcoholic beverages shall be limited to the sale of beer only." MOTION It was moved by Commissioner Amato, seconded by Commissioner Szany to approve CUP 91 -015 subject to the conditions in the staff report with the revised condition 2 stated above. PUBLIC HEARING MP 91 -006 2050 Vista Ave. Robert & Jacqueline Cooley, property owners Norma Iovine & Gina Chodos, appellants, property owners of 2058 Vista Ave. Consideration of an appeal of the Highland Home Owners Association's Architectural Review Board's approval of a 1,689 sq. ft., second floor addition. Staff suggested continuing the hearing to the Commission's next meeting (November 12th), since the City Attorney is not present to answer any legal questions that may arise as a result of the appeal. Chairman Clark opened the public hearing to allow any persons in the audience who will be unable to attend the Commission's next meeting to speak . No one spoke in favor or in opposition. The Commission was in favor of the continuance. MOTION It was moved by Commissioner Szany, seconded by Commissioner Daggett to continue the public hearing to the Commission's November 12th meeting. ROLL CALL: AYES: NOES: Commissioners Amato, Daggett, Hedlund, Szany, Clark None AUDIENCE PARTICIPATION Larry Rodriguez, 1122 Drake Rd., said that he thought he had a modification on the agenda for an a/c unit. Staff explained that his item was before the Modification Committee which meets at 8:15 in the morning. Staffindicated the request had been approved. PLANNING COMMISSION DETERMINATION The staff report was presented. That the proposed sale of Flood Control property adjacent to 2400 S. Eighth Avenue is consistent with the General Plan. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Amato to approve the sale of Flood Control property adjacent to 2400 S. Eighth Avenue and determine that the sale is consistent with the General Plan. MOTION A resolution granting CUP 91 -012 to operate an eating establishment at 411 E. Huntington Drive. A resolution granting CUP 91 -014 for a language center at 411 E. Huntington Drive. A resolution granting CUP 91 -013 for a truck driving school at Lots 2046 -2055 along Randolph Street in the Chicago Park area. It was moved by Commissioner Szany, seconded by Commissioner Amato to adopt Resolutions 1470, 1471 and 1472 and to formally affirm the decisions of September 24, 1991 and the votes thereon. MATTERS FROM COUNCIL None MATTERS FROM COMMISSION None MA'1"1'ERS FROM STAFF Memo regarding construction mitigation Ms. Butler summarized upcoming projects and said that a CUP has been filed requesting seating for 16 persons at a yogurt shop at 411 E. Huntington Drive. It was noted that the Council approved Zone Change Z -91 -009, changing the zoning from R -1 7,500 to R -1 12,500 and that a financial consultant was hired for the mall expansion. In response to a question from Commissioner Daggett, Ms. Butler stated that the City will benefit from the mall expansion, thus, the reason for hiring a financial consultant. In regard to the construction mitigation memo, Ms. Butler said that staff contacted the City of San Juan Capistrano and found out that they had adopted a construction mitigation plan for the specific project set forth in the report, due to the size of the subdivision. Arcadia City Planning Commission 10/15/91 Page 4 Commissioner Hedlund remarked that he was very concerned with contractors who leave their job site dirty and bring dirt and mud on City streets. He said that on one occasion a contractor was building a pool on Camino Real and there was cement all over the street and when cars would drive by dust would be kicked up and he felt that that is an imposition on the neighborhood. He said that it is the contractors' responsibility to clean up their job sites prior to leaving for the day and suggested posting a cash bond when pulling the permits and utilizing it to clean up the street if it is left dirty. He thought that the Public Works Department could use its street sweepers to do the cleaning. Chairman Clark thought that maybe wording should be added to the permits with regard to leaving the job site clean. Commissioner Amato felt that the one way to keep the site clean and have it maintained as such would be to shut the job down and he thought that that could be one way to get immediate response.
