REGULAR MEETING Tuesday, March 12, 1991 The Planning Commission of the City of Arcadia met in regular session on Tuesday, March 12, 1991, at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, 240 West Huntington Drive, with Chairman Larry Papay presiding. PLEDGE OF ALLEGIANCE ROLL CALL: PRESENT: Commissioners Clark, Hedlund, Szany, Papay ABSENT: Commissioner Amato MOTION It was moved by Commissioner Szany, seconded by Commissioner Clark to excuse Commissioner Amato. The motion passed by voice vote with none dissenting. MINUTES MOTION It was moved by Commissioner Szany, seconded by Commissioner Clark to approve the Minutes of February 12, 1991 as published. The motion passed by voice vote with none dissenting. OTHERS ATTENDING: City Attorney Michael Miller Planning Director William Woolard Secretary Silva Vergel PUBLIC HEARING TPM 91-002 251 Whispering Pines Summit and Lot 1 of Tract 42936 Charles Bluth The staff report was presented. Consideration of a tentative parcel map creating three single - family lots from two lots. William Woolard, the Planning Director, stated that the Fire Department does not have objections with the 18' wide flag lot which is part of Lot 2. The existing 20' easement to the south is the driveway going up to the residence and it provided access to the ridge before Tract 42936 was adopted. There is probably no reason to retain the 20' easement. The public hearing was opened. Charles Bluth, 251 Whispering Pines Summit, spoke in favor and noted that there will be 5 acres remaining which will be of no value to the existing parcel. No grading will be done and the new created lots will be bigger than 70% of most of the lots in phase one and two. The 20' easement was put in there originally for Fire Department access to the back hill area which no longer exists and asked that the easement be dropped. He was in agreement with all of the conditions in the staff report. No one else spoke in favor of or in opposition to this item. MOTION It was moved by Commissioner Szany, seconded by Commissioner Clark to close the public hearing. The motion passed by voice vote with none dissenting. Commissioner Clark remarked that he has no problems with the location on the hillside and he thought that the only real issue might be the flag lot and Mr. Woolard has noted that flag lots are accepted on hillsides. MOTION It was moved by Commissioner Clark, seconded by Commissioner Hedlund to approve TPM 91-002 subject to the conditions in the staff report. ROLL CALL: AYES: Commissioners Clark, Hedlund, Szany, Papay NOES: None ABSENT: Commissioner Amato Chairman Papay noted that there is a ten day appeal. PUBLIC HEARING TA 91-002 Consideration of a text amendment amending the real estate signs in the R -M and R-0 single - family zones and adding sign regulations to R -1 zone (to be consistent with the R-0 regulations). The staff report was presented. Commissioner Hedlund remarked that he has seen many "open house" signs on the sidewalks on Santa Anita Ave., Duarte Rd. and El Monte Ave. and thought that only one directional sign should be allowed. He said that about six months ago he took a picture of a condominium that had five "for sale" signs and just today he noticed that there were still four more at that same location. He remarked that another sign that he has seen advertises the management company and thought that that should also be addressed. Mr. Woolard said that signs for condominiums are a different issue and this text amendment only deals with single - family zones. In most condominiums this problem is taken care of by the homeowner's association and at some condominiums have a permanent board for the purpose of these type of signs. Mike Miller, the City Attorney, said that as a condition of approval, the CC &Rs, which are approved by the City Attorney's office, can require a board for such purpose for future developments in the multiple - family zoning. Commissioner Szany asked if the signs can remain until the property is sold? He thought that "temporary" should be clearly defined and should not be left more 1 -2 days. He wondered if directional signs that are left any longer than two days can be confiscated by the Police Department? Mr. Woolard said that realtors usually remove their signs because they do not want the City to remove them since it can be costly to the realtor. No one spoke in favor of or in opposition to this item. MOTION It was moved by Commissioner Clark, seconded by Commissioner Szany to close the public hearing. The motion passed by voice vote with none dissenting. MOTION It was moved by Commissioner Clark, seconded by Commissioner Szany to recommended approval of TA 91-002 to the City Council. ROLL CALL: AYES: Commissioners Clark, Hedlund, Szany, Papay NOES: None ABSENT: Commissioner Amato PUBLIC HEARING TA 91-003 Consideration of a text amendment amending the 'H' High Rise Overlay zoning regulations, creating five high rise overlays. The staff report was presented and the public hearing was opened. No one spoke in favor of or in opposition to this item. MOTION It was moved by Commissioner Clark, seconded by Commissioner Szany to close the public hearing. The motion passed by voice vote with none dissenting. Chairman Papay explained that this text amendment sets up five different "H" zones and not their location. MOTION It was moved by Commissioner Hedlund, seconded by Commissioner Szany recommended approval of TA 91-003 to the City Council. Huntington Dr. Celeste Foran Consideration of a six month time extension for the expansion of the existing restaurant. The staff report was presented. Mr. Woolard explained that if the time extension is not approved a new CUP would be required. Commissioner Clark said that he can be sympathetic with the lack of money but felt that this has been dragged out too long. Commissioner Szany remarked that the first deadline on the time table is in April and he thought that they should be granted the time extension. Chairman Papay said that they had one year to do the improvements and they did not comply so they asked for a six month time extension and now they are requesting another six months. He remarked that if they were doing some work and just couldn't quite make it, it would be quite different. Commissioner Hedlund stated that if they don't do anything they have to reapply. Mr. Miller remarked that the Commission does not have to grant the time extension because they are not entitled to their due process if the application has expired. MOTION It was moved by Commissioner Clark, seconded by Commissioner Szany to grant a time extension to CUP 89-011 subject to the time table in the staff report with the additional condition that if any one of the conditions are not met the CUP will expire and be deemed null and void. ROLL CALL: AYES: Commissioners Clark, Hedlund, Szany, Papay NOES: None ABSENT: Commissioner Amato MATTERS FROM COUNCIL None MATTERS FROM COMMISSION Commissioner Szany remarked that he was concerned about possible future subdivision of large lots in the Whispering Pines area and wanted to make it clear that the tentative parcel map which was approved tonight should not be cnsidered a precedent.
